Divorce Real Estate Agent in Irvine, CA

Paula Aragone handles Irvine dissolution listings where the two owners no longer agree, from the restraining orders on the summons through the master association, sub association and special tax lines that decide whether either spouse can afford to stay. The representation is of the sale, not of either party.

The short answer

An Irvine house cannot be listed on one signature while a dissolution is pending. The Automatic Temporary Restraining Orders in Family Code 2040, printed on Judicial Council form FL-110, restrain both parties from transferring, encumbering, hypothecating, concealing or in any way disposing of any property. Two routes exist and only two: the written consent of the other party, or an order of the court. Irvine then adds a second question, because the assessments on the parcel decide whether either spouse can qualify to keep it.

Three Assessments Decide Which of You Can Afford to Stay

Most cities put one number in front of a spouse who wants to keep the house. Irvine puts three, and they move together with the mortgage inside a lender's debt to income calculation.

Irvine was planned before it was built. UC hired William Pereira in 1957 to site a campus, the Irvine Company donated one thousand acres, and the city was organised into villages radiating from the university, each with its own schools and commercial centre, separated from its neighbours by six lane arterials. The city incorporated on 28 December 1971 and annexed the former MCAS El Toro in late 2003, adding 7.3 square miles.

The line that decides the money runs at roughly 1988. Pre 1988 villages such as University Park, Turtle Rock, El Camino Real, most of Northwood and most of Woodbridge carry little or no special tax. Villages built afterwards, and the Great Park neighbourhoods above all, were financed through Community Facilities Districts and carry a special tax line alongside master association dues and, very often, a sub association assessment as well.

That is where the dissolution turns. Under the Fannie Mae Selling Guide, a refinance that pays off the existing first mortgage and buys out a co owner is treated as a limited cash out refinance only where the property was jointly owned by all parties for at least twelve months before disbursement, all parties sign a written agreement stating the terms of the transfer and the disposition of proceeds, the retaining spouse receives none of the proceeds, incidental cash back stays within the greater of one percent of the new loan amount or 2,000 dollars, and the retaining spouse qualifies alone. Three assessment lines are counted in that qualification.

The second Irvine variable is the school boundary, and it does not follow the city line. Irvine Unified serves most of the city, but Tustin Unified serves Northpark and West Irvine, with Myford and Hicks Canyon elementaries, Pioneer Middle and Beckman High, and Santa Ana Unified serves several Irvine Business Complex buildings including The Plaza, Central Park West, The Marquee and The Metropolitan. Two separated households repeating two different answers to a buyer is a cancellation waiting to happen.

Build era decides what the inspection produces. The 1966 to 1979 villages carry the classic set: aluminium branch wiring in anything permitted from 1965 into the mid 1970s, Federal Pacific and Zinsco panels, galvanised supply lines, cast iron drains, original aluminium sliders and asbestos era flooring and ceiling texture. The 1980s and 1990s villages sit inside the polybutylene window that ran from 1978 to the middle of 1995. The 2000s villages rarely produce defects at all; their friction is assessments, architectural approval and solar agreements a buyer has to assume.

The honest difficulty in Irvine is that the city sells an ongoing obligation rather than only a house, and a dissolution makes that obligation harder to carry on one income. Architectural control is real, so anything one spouse changed without approval will be raised in the resale packet. The 2025 fire map, adopted by ordinance in June 2025 and effective 23 July 2025, expanded zones into Orchard Hills, Woodbury, Portola Springs, Quail Hill, Turtle Rock, Laguna Altura, Los Olivos and Irvine Spectrum, which puts AB 38 documentation into files that carried none at the last sale.

The process

How an Irvine Home Is Sold During a Dissolution

Every step below exists in an ordinary Irvine listing. What changes in a dissolution is that each one needs two signatures or a court order behind it, and that the assessments on the parcel have to be settled early, because they decide which of the two outcomes is even available.

01

Find out which of you the orders already bind

The restraining orders print on the face of form FL-110. Under Family Code 233 they reach the petitioner on filing of the petition and issuance of the summons, and the respondent on personal service or on a waiver and acceptance of service. They hold until judgment, dismissal or a further order. No listing calendar starts before that question is answered.

02

Put the authority to list into writing

Selling a family residence is not a transaction in the usual course of business, so consent or an order is required. An order escrow can actually use names the property and its legal description, names the broker, sets the list price and the authority to reduce it, states who accepts an offer, states who signs, and states how the proceeds are disbursed.

03

Add up every assessment before anyone talks about staying

Pull the master association dues, any sub association dues and the special tax line by parcel number, then take the total to a lender. This is the Irvine step that has no equivalent elsewhere, and doing it in week one prevents a family spending three months negotiating a buyout that underwriting was never going to approve.

04

Sort what is community and what is separate

Family Code 760 makes property acquired during marriage community and Family Code 770 makes what was owned before marriage separate. Family Code 2581 presumes joint title taken during marriage is community. Where one spouse owned the house first and community earnings reduced the principal, Moore and Marsden applies. All of that is counsel's work, not the agent's.

05

Instruct one appraiser, inside the village

Family Code 2552 values the community estate as near as practicable to the time of trial, and the exception in 2552(b) needs thirty days notice and good cause. A comparison drawn across villages is close to meaningless in this city, so the instruction should name the village and the school attendance area before either side has seen a number.

06

Order the association packets and the special tax notice

Most Irvine parcels sit under a master association and frequently a sub association too, which is two document orders rather than one. Where the parcel is inside a Community Facilities District, Civil Code 1102.6b requires a good faith effort to obtain the notice from the City of Irvine as the levying agency. The tax bill line is not that notice.

07

Market it openly, on one calendar

Broad exposure protects both parties, because a quiet sale at a soft number is the transaction each side will later say the other arranged. Agree in advance who receives the showing calendar, who approves a price reduction, and how a disagreement is settled. Where one spouse still lives there, access terms belong in the order, not in a text message.

08

Decide offers with two decision makers and one rule

Every counter, every repair request and every extension needs the same two signatures the listing needed. The fix is a written threshold agreed in advance: a price at or above which acceptance is automatic, a fixed response window, and a named tiebreaker. Without it an ordinary three day response becomes a fortnight between lawyers and the buyer leaves.

09

Disburse on numbers agreed before the offer arrived

Escrow acts only on the written instructions both principals signed, and neither can change them alone. Conflicting instructions do not get resolved by the escrow holder, they get interpleaded and the money goes to the court. The clean structure is a judgment stating the disbursement formula, escrow instructions repeating it word for word, and form 593 handled in the same document.

Where we work

Irvine Villages, and What Each One Puts Into the Arithmetic

The village decides the assessments, the school attendance area, the buyer pool and the inspection profile. These are the ones that come up most often when two owners are dividing one house.

University Park

The first village, opened 1966, low density around greenbelts and walkable to UCI. Generally free of special tax, so a buyout here is underwritten on the mortgage and the association dues alone.

Turtle Rock

The first hillside village, 1967, homes arranged to hold the ridgelines. Generally no special tax, but now inside the zones Irvine expanded in July 2025, so defensible space documentation joins the disclosure package both parties sign.

El Camino Real

1970, named for the mission trail, with Heritage Park and the Irvine Fine Arts Center. Older stock, generally no special tax, and often held by one household for decades, which is where a Moore and Marsden question usually starts.

Northwood

1970, defined by the century old eucalyptus windrows. Most of it free of special tax. Long marriages and long held homes here produce the longest tracing exercises, because the loan was paid down across the whole marriage.

Rancho San Joaquin

1972, the only active adult village, beside Mason Regional Park. Age restrictions run with the community under the federal housing for older persons rules, so a spouse who wants to keep it has to qualify to live there as well as to finance it.

Woodbridge

1975, four quadrants around two lakes with a large village association. Mostly free of special tax and with the deepest buyer pool in the city, which makes it the easiest place to run a contested listing in the open.

Westpark

1987, the first Mediterranean themed village. It sits at the front of the polybutylene window that ran from 1978 to the middle of 1995, so the plumbing question arrives before either party has agreed on a number.

University Hills

Not fee ownership. The University of California owns the land and residents hold a leasehold through the Irvine Campus Housing Authority, with purchase restricted to University employees and a Maximum Resale Price calculated by ICHA.

West Irvine

1997, holding twenty four historic buildings from the 1897 Irvine Ranch. Served by Tustin Unified with Myford Elementary rather than Irvine Unified, which is the single assumption that cancels escrows in this village.

Oak Creek

1998, historic oaks beside the Spectrum medical corridor. Late 1990s districts apply here, so the notice of special tax has to be obtained from the levying agency rather than read off the annual tax bill.

Northpark and Northpark Square

1999 and 2001, gated, on a pathway network. Tustin Unified serves both, with Hicks Canyon Elementary, Pioneer Middle and Beckman High. Confirm the assignment in writing before either party repeats it to a buyer.

Shady Canyon

2001, roughly four hundred custom homes behind a guarded gate with a private golf club. No two parcels are truly comparable, so one jointly instructed appraiser matters more here than anywhere else in the city.

Quail Hill

2003, beside the seven hundred acre Quail Hill Preserve with its own retail centre. Inside the 2025 fire zone expansion, which adds an AB 38 obligation to a file that already needs two signatures on everything.

Turtle Ridge

2003, on the San Joaquin Hills with a coastal microclimate and ocean to mountain views. Modern systems and meaningful assessments, so the conversation here is about qualification rather than about repair credits.

Woodbury and Portola Springs

2004 and 2006. Both carry Community Facilities District special taxes and both sit inside the expanded fire map, so the disclosure stack and the lender's debt to income calculation are at their heaviest in these two.

Stonegate, Cypress Village, Laguna Altura and Eastwood

2011 to 2016. Modern construction, compact lots, layered assessments and tight architectural control. Anything one spouse changed without approval surfaces in the resale packet rather than in the inspection report.

Orchard Hills

2014, the highest point in the city among roughly nine hundred acres of working avocado orchards, with a gated Groves enclave. Special tax, ocean views and a 2025 fire zone designation in the same file.

Great Park Neighborhoods

Pavilion Park, Beacon Park, Parasol Park, Cadence Park, Novel Park, Rise, Solis Park and Luna Park, on the former MCAS El Toro. Financed through CFD 2013-3, which drops sharply once the bonds are repaid but never fully sunsets.

What actually delays it

Six Places an Irvine Dissolution Sale Loses Its Calendar

Irvine, California

Not one of these is a pricing problem. Each is a figure, a packet or a boundary that somebody assumed, in a file where an assumption has to be agreed by two households before it can be corrected.

The buyout was priced before anyone spoke to a lender

Half the equity is an arithmetic answer. Whether one spouse can borrow it is an underwriting answer, and in Irvine the underwriting includes the master association dues, any sub association dues and the special tax on the same line as the mortgage.

The buying spouse also has to qualify alone, on their own income, credit and debt to income, and may not receive any of the proceeds of the refinance. Establish that in week one. A family that negotiates a buyout for three months and then discovers it cannot be financed has lost a season of market time and a great deal of goodwill.

Only one of the two association packets was ordered

The city confirms the two tier model: many Irvine neighbourhoods sit under a master association and a sub association at the same time, governed by the Davis Stirling Act. The master usually maintains medians and private parks, the sub handles smaller landscape areas and the exteriors of attached buildings.

That is two sets of budgets, reserve studies and minutes, from two management companies, each needing an authorised request. When both spouses have to approve every request, ordering one packet and discovering the second in escrow costs weeks nobody has.

The special tax notice was read off the tax bill

Civil Code 1102.6b requires the seller to make a good faith effort to obtain a disclosure notice from each agency levying a Mello Roos special tax and to deliver it to the buyer. The line item on the annual Orange County bill is not that notice.

This is the most common Irvine disclosure defect in any sale, and in a dissolution it is worse, because the party who no longer lives in the house often never sees the tax bill at all. Confirm the district parcel by parcel by APN, then request the notice from the City of Irvine.

The school district was read off the city name

Irvine Unified serves most of the city, but Tustin Unified serves Northpark and West Irvine, and Santa Ana Unified serves several Irvine Business Complex buildings. Boundaries also move.

In a dissolution the damage is doubled, because two households answer the same question separately and a buyer hears two different things. Confirm the assignment by address with the district, put the answer in writing, and let both parties and both attorneys work from the same sentence.

University Hills was treated as ordinary ownership

The University of California owns the land. Residents hold a leasehold through the Irvine Campus Housing Authority, purchase eligibility is restricted to full time University employees in a defined priority order, and ICHA calculates a Maximum Resale Price for a current owner.

In a dissolution that has consequences neither party expects. The asset being divided is a restricted leasehold rather than a fee, its value is not set by the open market, and a spouse who is not a University employee may not be able to keep it at all. Read the lease and the ICHA rules before either side proposes a number.

One party paid for work the other never agreed to

Family Code 2040 requires each party to notify the other of proposed extraordinary expenditures at least five business days before incurring them, and to account to the court for all extraordinary expenditures. A new roof, a repipe or an architectural application is exactly that kind of expenditure.

In an Irvine village there is a second approval on top of the first. Work on an exterior elevation, a driveway, a fence or a window usually needs architectural approval from the association, and unapproved work will be raised at resale. Get both approvals in writing before the invoice, not after.

The decision

Sell the Irvine House, or Refinance and Stay in the Village

There are two real outcomes. Each carries a cost that is easy to see two years later and hard to see now, and in Irvine the assessments push on both of them.

Sell the house

A sale turns a contested asset into a number, and a number can be divided under Family Code 2550 without either party depending on the other afterwards. It also ends the shared exposure to the master association, the sub association and the special tax, which is the running cost that makes an Irvine house harder to hold on one income than the mortgage alone suggests.

The tax position is usually better while the marriage is intact. Under IRC section 121 the exclusion is 250,000 dollars per individual taxpayer and 500,000 dollars on a joint return where either spouse meets the ownership test, both meet the use test, and neither is disqualified by the two year look back. Both tests run on twenty four months out of the five years ending on the date of sale, so selling while still married and filing jointly in the year of sale can preserve the whole 500,000 dollars.

The mechanics have to be designed before escrow opens. Both parties sign the escrow instructions and both must sign any amendment. If they later give conflicting instructions the escrow holder does not choose between them, it interpleads and the funds sit with the court. State withholding is a standard 3 1/3 percent of the sales price on form 593 unless an exemption applies, including certification that the property qualified as a principal residence under section 121.

The honest downside: a sale is public, it moves at the speed of two signatures, and it forces both households onto a schedule a buyer sets. Where children are settled in an Irvine school placement, that cost is real, and a court is entitled to weigh it under Family Code 3802 on a request to defer the sale.

One spouse buys the other out

The arithmetic starts with fair market value at the applicable date, less encumbrances, which gives gross equity. Any Family Code 2640 reimbursement for traced separate property contributions comes off the top, along with any separate interest established under Moore and Marsden, adjusted for Epstein credits and Watts charges. The remainder is community equity and each spouse's interest is half. Whether hypothetical costs of sale are deducted when no sale is happening is contested, so treat it as negotiable rather than settled.

The lender is the part that surprises people, and in Irvine it is the part that most often ends the discussion. Under the Fannie Mae Selling Guide the buyout refinance is priced as a limited cash out refinance only where the property was jointly owned by all parties for at least twelve months before disbursement. All parties must sign a written agreement stating the terms of the transfer and the disposition of proceeds, the retaining spouse may not receive any of those proceeds, incidental cash back is capped at the greater of one percent of the new loan amount or 2,000 dollars, and the retaining spouse must qualify alone. Master dues, sub association dues and the special tax all count against that qualification.

Removing a spouse from title and removing them from the loan are two separate acts, and conflating them is the most damaging error in a divorce transaction. A deed changes ownership. The promissory note is a contract with a lender who is not a party to the divorce, so a judgment, a settlement agreement and a recorded interspousal transfer deed do not discharge liability. There are two ways out: refinance, or an assumption with an express written release of liability from the servicer. The Garn St Germain Act generally stops the lender from accelerating on a divorce related transfer, which is why the deed records cleanly while the liability quietly stays.

The honest downside is tax, and it is usually missed. A transfer between spouses incident to divorce is not a taxable event under IRC section 1041 and the receiving spouse takes carryover basis rather than a stepped up one. On a long held Irvine house that puts the entire built in gain on the buying spouse, who may have only 250,000 dollars of exclusion available at the eventual sale. A buyout at exactly half the equity is therefore not equal after tax.

Why this office

One Agent, Two Households, and Information That Arrives at the Same Time

Paula Aragone has worked Orange County transactions for 23 years, across 900+ transactions and $900M+ sold, and she came to it after four years of law school. She holds the CPRES and SRES designations. That background is the reason family law attorneys send dissolution listings here rather than to a general listing agent.

The position taken in these files is deliberately narrow. The representation is of the sale, not of either spouse. Both parties receive the same information at the same time and in writing, including every offer, every price recommendation and every document ordered from an association or from the city. Neither party is advised on what to accept in the division, because that is their own counsel's work and doing it from this chair would destroy the only thing that makes the listing function.

Neutrality is also what keeps the transaction alive. Dissolution listings rarely collapse over price. They collapse when one party comes to believe the agent is working for the other, and from that moment every showing request, every price adjustment and every repair credit is read as a manoeuvre. One channel, one calendar, both parties and both attorneys copied on everything, agreed in writing at the start, prevents most of it.

Nothing here is legal advice, and a listing agent is not a substitute for your own family law attorney. Character of property, Moore and Marsden analysis, Family Code 2640 tracing, Epstein and Watts accounting and the terms of any order authorising a sale are all lawyer work. What this office contributes is the part outside the courtroom: a valuation built inside the correct village and attendance area, the association and Community Facilities District paperwork ordered at listing rather than in escrow, broad exposure, and a record clean enough that neither side can later say the sale was arranged.

Questions

Irvine Dissolution Sales, Question by Question

Answers built for California dissolution law and for the way Irvine villages are assessed, taxed and drawn into school attendance areas.

My spouse has moved out. Can I list the Irvine house on my own?

No. Family Code 2040 restrains both parties from transferring, encumbering, hypothecating, concealing or in any way disposing of any property, whether community, quasi community or separate, without the written consent of the other party or an order of the court. Selling a family residence is not a transaction in the usual course of business, so the exception in the statute does not reach it. Moving out changes nothing about who has to sign.

At what moment did the restraining orders start applying to each of us?

Family Code 233 sets it out. The orders are effective against the petitioner on filing of the petition and issuance of the summons, and against the respondent on personal service of the petition and summons or on the respondent's waiver and acceptance of service. They stay in force until final judgment is entered, the petition is dismissed, or the court orders otherwise. They are printed on the face of Judicial Council form FL-110 under the heading of standard family law restraining orders.

Do the association dues and the special tax affect whether I can buy my spouse out?

Directly. A lender counts the master association dues, any sub association dues and any Community Facilities District special tax alongside the mortgage payment when it measures debt to income, and the buying spouse has to qualify alone. That is why an Irvine property can appraise cleanly and still fail at qualification. Pull all three figures by parcel number and take them to a lender before either party spends months negotiating a buyout number.

Does the Great Park special tax ever go away?

Not entirely. The City of Irvine states that the CFD No. 2013-3 charge can rise by up to two percent a year and that once the original bonds are repaid, typically around forty years, the charge drops by roughly 65 to 82 percent, with the remainder continuing for maintenance. A spouse planning to keep a Great Park home should build the long term figure into the decision using the city's own numbers rather than an estimate, and a buyer will raise it too.

Which school district serves our address?

Do not answer that from the city name. Irvine Unified serves most of Irvine, but Tustin Unified serves Northpark and West Irvine, with Myford and Hicks Canyon elementaries, Pioneer Middle and Beckman High, and Santa Ana Unified serves several Irvine Business Complex buildings including The Plaza, Central Park West, The Marquee and The Metropolitan. Confirm by address with the district and put the answer in writing, so two separated households are not giving buyers two different answers.

We own in University Hills. How is that divided?

Carefully, and with counsel reading the lease. The University of California owns the land and residents hold a leasehold through the Irvine Campus Housing Authority. Purchase eligibility is restricted to full time University employees in a defined priority order and ICHA calculates a Maximum Resale Price for a current owner. So the asset is a restricted leasehold rather than a fee, its resale value is not set by the open market, and a spouse who is not a University employee may have no route to keep it.

Do we need documents from two associations?

Often, yes. The city confirms that some Irvine neighbourhoods are covered by both a master association and a sub association, with the master maintaining medians and private parks and the sub handling smaller landscape areas and the exteriors of attached buildings. That is two sets of resale documents, budgets, reserve studies and minutes from two management companies. Order both at listing. When each request needs approval from two separated households, a late second packet costs real weeks.

Did the 2025 map put our village into a fire hazard zone?

It may be, even if it was not at the last sale. Irvine adopted the updated CAL FIRE maps by ordinance in June 2025, effective 23 July 2025, replacing the 2012 map, and the update expanded zones into Orchard Hills, Woodbury, Portola Springs, Quail Hill, Turtle Rock, Laguna Altura, Los Olivos and Irvine Spectrum. A High or Very High designation brings the AB 38 defensible space documentation under Civil Code 1102.19, and it will be the first question the buyer's insurer asks.

I bought the house years before we met. What does my spouse own now?

More of it than most people expect can be community. Family Code 770 makes property owned before marriage separate, but where community earnings reduced the loan principal during the marriage the community acquires a proportional ownership interest under In re Marriage of Moore (1980) 28 Cal.3d 366 and In re Marriage of Marsden (1982) 130 Cal.App.3d 426. Appreciation before the marriage stays entirely with the owner spouse. In re Marriage of Mohler (2020) 47 Cal.App.5th 788 confirms the community percentage stops growing at separation.

I used money from before the marriage for the down payment. Do I get it back?

If you can trace it to a separate source, yes, but only the nominal dollars. Family Code 2640 reimburses separate property contributions to the acquisition of community property, including down payments, payments for improvements and payments that reduce loan principal. Payments of interest, maintenance, insurance and taxes do not qualify. The statute says the reimbursement is without interest or adjustment for change in monetary values, and it cannot exceed the net value of the property at the time of division.

Which date does the court use to value the house?

Family Code 2552(a) makes the default a valuation as near as practicable to the time of trial, not the date of separation and not the date of filing. Under 2552(b), on thirty days notice and for good cause shown, the court may value an asset at a date after separation and before trial to accomplish an equitable division. The practical effect is that the community usually shares the movement in value between separation and trial, which is one argument for a single early appraisal both sides instructed.

The judgment says my spouse keeps the house. Why is the loan still mine?

Because the loan did not change when the title did. A deed changes ownership; the promissory note is a contract with a lender who is not a party to your divorce. A judgment, a marital settlement agreement and a recorded interspousal transfer deed do not discharge personal liability, so the debt stays on your credit report and counts against your debt to income ratio on any new purchase. The two ways out are a refinance or an assumption with an express written release of liability from the servicer.

Can the court order the Irvine house sold if one of us refuses?

There is no single statute titled order of sale, but Family Code 2550, 2601 and 2553 together give the court that authority. A sale is typically ordered where the estate cannot be divided equally any other way, where neither party can qualify to buy the other out, or where a party is dissipating the asset. After judgment, when the parties hold as tenants in common, partition under Code of Civil Procedure title 10.5 is the alternative route.

Is there a way to keep the children in the house for now?

That is a deferred sale of home order, often called a Duke order, under Family Code 3800 through 3810. The court must first find under 3801 that it is economically feasible to maintain the note payments, the taxes, the insurance and the condition of the home during the deferral, which in Irvine means the assessments as well. It then weighs the factors in 3802(b), including the child's grade and school placement and each parent's ability to obtain suitable housing. Under 3808, remarriage of the resident parent creates a rebuttable presumption that further deferral is no longer equitable.

How does escrow pay out when the two of us cannot agree?

Exactly as the signed instructions say, and not otherwise. Escrow is a limited agency governed entirely by the written instructions of the principals, and once joint instructions are signed neither principal can change them alone. If the parties give conflicting instructions the escrow holder is a neutral stakeholder rather than a referee, and its remedy is an interpleader that deposits the funds with the court. The clean structure is a judgment stating the disbursement formula and escrow instructions repeating it word for word.
