Probate Real Estate Agent in Irvine, CA
Paula Aragone represents personal representatives selling Irvine property under letters from the Orange County Superior Court, beginning with the one line in those letters that decides whether the sale needs a hearing at all.
A probate sale in Irvine is a sale by the personal representative appointed by the Orange County Superior Court, and how it runs depends on one line in the letters. Full authority under the Independent Administration of Estates Act means no confirmation hearing and no overbid, subject only to a Notice of Proposed Action. Limited authority means the court confirms the sale, the price has to reach ninety percent of the probate referee's appraisal, and anyone can bid in the room.

The Referee Values One House. The Floor Under Your Sale Follows Whatever Set He Compared It To.
Under limited authority the appraisal is not an opinion, it is a floor. Probate Code 10309(a) will not let the court confirm below ninety percent of it, so a comparison drawn across the wrong part of Irvine becomes a legal constraint on the estate.
Irvine was planned before it was built. UC hired William Pereira in 1957 to site a campus, the Irvine Company donated a thousand acres, and the city was organised into villages radiating from the university, each centred on its own schools and separated from its neighbours by six lane arterials. A referee given only a city name is being asked to value a product that does not exist.
Two failure modes follow, and they fail in opposite directions. An appraisal built high, from a village with better schools or newer stock, sets a ninety percent floor the market will not reach, and the estate sits unsold while the representative explains to the heirs why a fair offer cannot be confirmed. An appraisal built low sets a floor so far under the market that the sale invites an overbid, and the buyer who paid for the inspection loses the house in a courtroom.
The three items the referee should be given before the appraisal, not after, are the village, the school attendance area and the assessment stack. That last one is the master association assessment, any sub association assessment, and any Community Facilities District special tax. All three appear on the tax bill or in the resale packet, and all three are already known to the estate by the time the inventory is due.
The line that changes the assessment stack runs at roughly 1988. The pre 1988 villages, University Park from 1966, Turtle Rock from 1967, El Camino Real, Northwood and most of Woodbridge, generally carry little or no special tax. The villages built later, and above all the Great Park neighbourhoods on the former MCAS El Toro annexed in 2003, were financed through Community Facilities Districts and carry a special tax line alongside two layers of association dues.
That matters to a personal representative for a reason beyond disclosure. Three assessment lines sit in a lender's debt to income calculation next to the mortgage, so a Great Park listing can appraise cleanly and still lose its buyer at qualification. Under confirmation that costs the estate a hearing date, not just a week.
Build era decides what the inspection turns up, and the estate is better placed knowing first. The 1966 to 1979 villages carry aluminium branch wiring in anything permitted from 1965 into the mid 1970s, Federal Pacific and Zinsco panels, galvanised supply, cast iron drains and asbestos era flooring and ceiling texture. The 1980s and 1990s villages sit inside the polybutylene window that ran from 1978 to the middle of 1995. Post tension slabs appear from the 1970s onward and must never be cut for a plumbing repair without a scan.
How a Probate Property Sale Works in Irvine
A probate sale is a court supervised administration with statutory deadlines attached to it. These are the steps in the order the Probate Code actually imposes them, and the first one decides how long the rest of them take.
Petition, then read the letters you were issued
A petition for probate produces letters, and the letters say whether the representative holds full or limited authority under the Independent Administration of Estates Act. Probate Code 10402 grants all powers. Probate Code 10403 withholds four: selling real property, exchanging it, granting an option to purchase it, and borrowing against it. Read the box that was ticked before anything is listed.
File the inventory and brief the probate referee
Probate Code 8800 requires the inventory and appraisal within four months after letters issue. A probate referee from the State Controller's list, appointed under Probate Code 8920, values the real property, and Orange County expects it back within sixty days. The commission is one tenth of one percent of the value appraised plus expenses, floor seventy five dollars, ceiling ten thousand dollars per estate, under 8961 and 8963.
Secure the house and put the carrier on notice
Change the locks, redirect the post, keep water and power connected, and tell the insurer the property is unoccupied, because a homeowners policy is written around an occupied house. In Irvine, also give the master association and any sub association a current contact, since architectural notices and assessment statements keep arriving addressed to the decedent.
Choose the route the letters allow
With full authority the representative sells like any other owner and Probate Code 10503 removes the confirmation requirements entirely. With limited authority the sale goes to the court, which means a referee appraisal that must hold, a published notice, a report of sale and a hearing. That choice sets the marketing, the timeline and the contract the buyer signs.
Expose it, and keep the record of the exposure
In Irvine that means marketing built inside the correct village and school attendance area rather than across the city, because the arterials separate genuinely different products. Keep every offer, every showing record and every counter. Under confirmation the court is entitled to see that the market was tested, and heirs are entitled to check the number independently.
Serve the Notice of Proposed Action, or file the report of sale
Under full authority, Probate Code 10586 requires the notice to be mailed or personally delivered not less than fifteen days before the date it specifies, to the people listed in 10581. Under limited authority the route is instead a report of sale and petition for confirmation under Probate Code 10308, which the purchaser may file if the representative does not within thirty days.
The hearing, and the overbid if there is one
Orange County examiners review petitions three to four weeks before the hearing, so defects surface early enough to fix. At the hearing, Probate Code 10311(a) allows a higher offer of at least ten percent more on the first ten thousand dollars of the original bid and five percent more on the balance. Title does not pass until the court confirms.
Close escrow with the order attached
Under confirmation, escrow closes on the court order and the buyer's lender will want it in file before funding, which is why the order is ordered conformed the same week it is signed. Orange County documentary transfer tax is 0.55 dollars for each 500 dollars of net consideration over 100 dollars, which is 1.10 dollars per 1,000 dollars.
Account, then distribute
Probate Code 12200 requires a petition for final distribution or a status report not later than one year after letters, or eighteen months where a federal estate tax return is required. Statutory compensation under Probate Code 10800 for the representative and 10810 for the attorney is calculated on the gross inventory value and both are payable.
What the Referee Should Be Told Before He Values an Irvine Parcel
Each village carries its own schools, its own assessment structure and its own inspection profile. These are the ones that appear most often in Orange County probate files.
University Park
The first village, 1966. Greenbelts, low density, walkable to UCI, generally no special tax. Original ownership is common here, so the inventory usually describes a house nobody has updated in decades.
Turtle Rock
First hillside village, 1967, laid out to hold the ridgelines. Generally no special tax, and inside the 2025 fire hazard zone expansion, which adds defensible space documentation to the estate's disclosure obligations.
El Camino Real
1970, Heritage Park and the Irvine Fine Arts Center. Older stock, generally no special tax, and a high proportion of original purchasers, which usually means original panels, original supply lines and original glazing.
Northwood
1970, defined by the century old eucalyptus windrows, with the Hicks Canyon and Venta Spur trails. Most of it free of special tax. This is the most common long held family home in an Irvine estate.
Rancho San Joaquin
1972, the only active adult village, eighteen hole course beside Mason Regional Park. Age rules run with the community, so an heir who wants to occupy has to qualify before any distribution is planned around it.
Woodbridge
1975, four quadrants around two lakes with a large village association. The deepest buyer pool in the city, which is why a referee appraisal here is easier to support and an overbid here is more likely to appear.
Westpark
1987, the first Mediterranean themed village, coral stucco and terra cotta tile. It sits at the front of the polybutylene window, so the supply piping question reaches the estate before the pricing question does.
Walnut Village
1997, named for the walnut groves, greenbelts and Harvard Community Park. Late 1990s construction, so the friction is assessments and approvals rather than the classic defect list.
West Irvine
1997, holding twenty four historic buildings from the 1897 Irvine Ranch. Served by Tustin Unified with Myford Elementary and Beckman High, which an out of state representative will not know to say.
Oak Creek
1998, historic oaks beside the Spectrum medical corridor. Late 1990s districts apply here, so the Notice of Special Tax has to be obtained from the levying agency rather than read off the tax bill.
Northpark and Northpark Square
1999 and 2001, gated, on a pathway network. Tustin Unified serves both, with Hicks Canyon Elementary. A buyer who assumed Irvine Unified cancels, and under confirmation that costs a hearing date.
Shady Canyon
2001, roughly four hundred custom homes behind a guarded gate with a private golf club. The only true custom village, so a referee working from a village average produces a floor that means nothing here.
Quail Hill
2003, beside the seven hundred acre Quail Hill Preserve with its own retail centre. Inside the 2025 fire zone expansion, which brings AB 38 documentation into an estate sale that would not have needed it.
Turtle Ridge
2003, on the San Joaquin Hills with a coastal microclimate and ocean to mountain views. Modern systems, so the estate's exposure is the assessment stack and whatever the decedent changed without approval.
Woodbury and Portola Springs
2004 and 2006. Woodbury is built around a thirty acre Commons, Portola Springs around five enclaves framed by native habitat. Both carry special tax and both sit inside the expanded fire map.
Stonegate, Cypress Village, Laguna Altura, Eastwood
2011 to 2016. Compact lots, layered assessments and architectural control tight enough that any unapproved change made by the decedent will be raised in the resale documents.
Orchard Hills
2014, the highest point in the city among roughly nine hundred acres of working avocado orchards, with a gated Groves enclave. Special tax, ocean views, and inside the 2025 fire zone expansion.
Great Park Neighborhoods
Pavilion Park, Beacon Park, Parasol Park, Cadence Park, Novel Park, Rise, Solis Park and Luna Park, on the former MCAS El Toro. Financed through CFD No. 2013-3, which falls when the bonds are repaid but does not fully sunset.
Six Places an Irvine Probate Sale Loses Months It Cannot Get Back
Irvine, California
None of these are market problems. Each one is a statutory step taken out of order, and each one costs a hearing date rather than a week.
The referee was handed a city, not a village
A probate referee appointed under Probate Code 8920 values what he is given. Given an address and nothing else, he may build the comparison set across Irvine, and Irvine is not one market. Under limited authority that number becomes the ninety percent floor in Probate Code 10309(a), and the estate is bound by it.
Too high and no confirmable offer arrives. Too low and the estate invites a courtroom overbid on a property it has already spent months marketing. The fix costs nothing: send the village, the school attendance area, the association structure and the special tax status with the inventory rather than waiting to argue about the result.
Limited authority surfaced after an offer was accepted
Probate Code 10403 withholds exactly four powers from a representative with limited authority: sell real property, exchange real property, grant an option to purchase real property, and borrow money secured by an encumbrance on real property. Probate Code 10501(b) puts those four back under court supervision.
A buyer who wrote an offer expecting an ordinary escrow and then learns there will be a published notice, a report of sale, a hearing and an open overbid usually withdraws. Establishing the authority in week one, and writing the listing to match it, is the difference between one buyer and three.
The Notice of Proposed Action ran short of fifteen days
Probate Code 10586 requires the notice to be mailed or personally delivered not less than fifteen days before the date specified in it. The recipients under 10581 are each known devisee whose interest would be affected, each known heir whose interest would be affected, anyone who filed a request for special notice, and the Attorney General where the state's interest is affected.
The relief is written consent under 10582 and written waiver under 10583. Where a beneficiary will not consent, 10587 lets them object by delivering or mailing a written objection before the specified date or before the action is taken, whichever is later. Build the fifteen days into the escrow timeline at the start rather than discovering it in week three.
The ninety percent floor and the overbid were treated as one number
They have two different baselines and confusing them produces a listing that cannot work. The ninety percent test in Probate Code 10309(a) is measured against the referee's appraised value, and the appraisal has to have been made within one year prior to the confirmation hearing.
The overbid increment in Probate Code 10311(a) is measured against the accepted bid, not the appraisal. On a 1,000,000 dollar accepted bid the minimum first overbid is 1,000,000 dollars plus 1,000 dollars plus 49,500 dollars, which is 1,050,500 dollars. A representative who quotes one baseline while planning around the other will mislead the heirs and the buyer at the same time.
The resale packet was ordered after the report of sale was filed
Most Irvine parcels sit under a master association and frequently a sub association as well, both governed by the Davis Stirling Common Interest Development Act. The packet carries the budget, the reserve study, the minutes, the assessment figures a lender underwrites, and in the newer villages a disclosure of whether the developer still controls the board.
Under confirmation the report of sale and petition go on a calendar, and a defect found in the packet after that filing is a continuance rather than a negotiation. Order the documents in the first week of the listing. In an ordinary sale that saves two or three weeks. In a probate it saves a hearing.
A University Hills leasehold went into the inventory as fee land
The University of California owns the land in University Hills and homeowners hold a leasehold through the Irvine Campus Housing Authority. Purchase eligibility is restricted to full time University employees in a defined priority order, and ICHA calculates a Maximum Resale Price for a current owner.
That is not an open market asset and it must not be inventoried, appraised or marketed as one. Establish the ICHA position before the referee is engaged, because a referee appraisal of a restricted leasehold as though it were fee property produces a floor that the ICHA mechanism will never allow anyone to pay.
Notice of Proposed Action, or a Hearing at 3390 Harbor Blvd.
The letters decide which of these applies, and each one has a genuine cost. The point of naming both honestly is that the representative can explain the choice to the heirs before it is made rather than after.
Selling under full authority
Full authority under Probate Code 10402 includes all powers under the Independent Administration of Estates Act, and Probate Code 10503 states plainly that the requirements applicable to court confirmation of sales of real property do not apply to the sale. There is no confirmation hearing, no ninety percent floor and no courtroom overbid. The publication requirement in Probate Code 10300 does not apply either, because 10503 exempts the sale.
What remains is the Notice of Proposed Action. Under Probate Code 10586 it goes out not less than fifteen days before the date specified, to the recipients named in 10581, and where every one of them consents in writing under 10582 or waives under 10583, that period effectively disappears. In practice a full authority sale in Irvine runs on an ordinary escrow calendar with fifteen days built into it.
The cost is measured in exposure rather than time. A representative selling without a hearing has no court sitting behind the price, so the record has to do that work: broad marketing, a documented valuation built inside the correct village, every offer kept, and the notice served properly on everyone entitled to it. That record is the representative's own protection, not a formality.
The honest downside is that full authority concentrates the responsibility. A beneficiary who objects under Probate Code 10587 before the specified date or before the action is taken can force the representative to seek court authorisation anyway, which lands the estate back on a hearing calendar having already lost the marketing time. Serve early, and find out who objects before a buyer is under contract.
Selling with court confirmation
With limited authority the four powers in Probate Code 10403 stay with the court, so the sale of the Irvine house is confirmed at a hearing. The mechanics are fixed. The property is appraised by the probate referee, the notice of sale is published under Probate Code 10300 in the manner set by Government Code 6063a, meaning at least ten days with three publications and at least five days intervening between the first and last, and publication must be complete before the day specified for the sale. The exceptions are narrow: Probate Code 10301, where property under 5,000 dollars may instead be posted at the courthouse for fifteen days, 10302, where the court may shorten the period to not less than five days, 10303, where the will directs or authorises the sale, and 10503, which exempts a full authority sale from publication altogether.
The report of sale and petition for confirmation follow under Probate Code 10308, and if the representative does not file within thirty days the purchaser may file it. Orange County probate examiners review petitions three to four weeks before the hearing, which is genuinely useful: defects surface with time to cure them. Probate is heard at the Costa Mesa Justice Complex, 3390 Harbor Blvd., Costa Mesa, the probate assistance line is 657-622-8452, and the case access portal is at probatepublic.occourts.org.
At the hearing the court may confirm only if the price is at least ninety percent of the appraised value under Probate Code 10309(a), with the appraisal made within one year prior to the hearing. Then the overbid under 10311(a): at least ten percent more on the first ten thousand dollars of the original bid and five percent more on the balance. On a 1,000,000 dollar accepted bid that is 1,050,500 dollars. The court takes the highest qualifying offer under 10311(b), may decline and order a new sale under 10311(c), may reject a higher bid on less favourable credit terms under 10311(d), and commissions are excluded from the computation under 10311(e).
The honest downside cuts both ways, and heirs should hear both halves. An overbid can genuinely help the estate, because the process is designed to find a better price in open court. It also deters serious buyers. A buyer who has paid for an inspection and an appraisal, and who then has to attend a hearing where anyone can take the house from them for a defined increment, frequently declines to start. Fewer buyers start, and the ones who do build the risk into the price they open at.
A Personal Representative Answers to a Court, Not to the Family
Paula Aragone has worked Orange County transactions for 23 years, across 900+ transactions and $900M+ sold, and she came to real estate after four years of law school. She holds the CPRES and SRES designations. That background is the reason estate and family law attorneys send probate files here rather than to a general listing agent.
CPRES is the Certified Probate Real Estate Specialist designation, and what it means in a court confirmation sale is procedural rather than promotional. The listing has to be written so a buyer understands before they write that the price must clear the ninety percent floor in Probate Code 10309(a), that a report of sale and petition will be filed under 10308, that a hearing date will be set, and that an overbid calculated under 10311(a) can take the property from them in the room. An agent who leaves that until the counter offer loses the buyer and the calendar together.
The rest of the work is retrieval and sequence. The inventory feeds the referee, so the referee gets the village, the school attendance area, the master and sub association structure and the Community Facilities District status before he values the parcel, not after. The Notice of Special Tax comes from the City of Irvine as the levying agency under Civil Code 1102.6b, because the line item on the Orange County tax bill is not that notice. The resale packet is ordered in week one. The permit jacket, approved plans and inspection log come from Irvine Building and Safety at 1 Civic Center Plaza.
None of this is legal advice or tax advice and this office gives neither. What it produces is the record the representative can hand to the estate's attorney, to the examiner and to the heirs: how the property was exposed, what every offer was, and why the price is the price. Statutory compensation under Probate Code 10800 and 10810 is calculated on gross inventory value without reference to encumbrances, and both the representative and the attorney are paid from it, so the estate has every reason to want that record built properly the first time.
Irvine Probate Sales, Answered for the Personal Representative
The questions executors and administrators actually ask, answered for California law and for Irvine specifically.
Do we even need a probate to sell my parent's Irvine house?
That depends on the date of death and the size of the estate. For a death on or after 1 April 2025 the Probate Code 13100 affidavit collects personal property up to 208,850 dollars, the Probate Code 13151 petition to determine succession to real property reaches 750,000 dollars but only for the decedent's California primary residence under AB 2016, and the Probate Code 13200 affidavit for real property of small value reaches 69,625 dollars. Those figures run from the date of death, not the filing date, and they hold through 31 March 2028.
What is the difference between full authority and limited authority?
Probate Code 10402 gives a representative with full authority all powers under the Independent Administration of Estates Act. Probate Code 10403 withholds four from a representative with limited authority: selling real property, exchanging it, granting an option to purchase it, and borrowing money secured by an encumbrance on it. Probate Code 10501(b) keeps those four under court supervision. In practice full authority means no confirmation hearing and no overbid, subject only to a Notice of Proposed Action.
If I have full authority, does the court still have to approve the Irvine sale?
No. Probate Code 10503 states that the requirements applicable to court confirmation of sales of real property do not apply to a sale made under full authority. There is no hearing, no ninety percent appraisal floor, no courtroom overbid, and no publication requirement under Probate Code 10300, because 10503 exempts the sale from that too. What replaces all of it is the Notice of Proposed Action.
How much notice does a Notice of Proposed Action require?
Not less than fifteen days before the date specified in the notice, under Probate Code 10586, and it must be mailed or personally delivered. Under 10581 it goes to each known devisee whose interest would be affected, each known heir whose interest would be affected, anyone who has filed a request for special notice, and the Attorney General where the state's interest is affected. Probate Code 10582 removes the requirement for anyone who consents in writing, and 10583 allows a written waiver.
What happens if a beneficiary objects to the sale?
Probate Code 10587 lets a recipient object by delivering or mailing a written objection before the date specified in the notice, or before the action is taken, whichever is later. An objection does not end the sale, but it does mean the representative can no longer rely on the notice alone and will usually need to go to the court for authority. That is why the notice is served early, before a buyer is under contract and before marketing time has been spent.
Who is the probate referee and what does he cost the estate?
A probate referee is appointed from the State Controller's list under Probate Code 8920 and values the estate's real property for the inventory. The commission under Probate Code 8961 is one tenth of one percent of the value appraised plus expenses, with a floor of 75 dollars and a ceiling of 10,000 dollars per estate under 8963. Orange County states the referee should return the appraisal within sixty days.
Can we sell for less than the referee's appraisal?
Under court confirmation, not by much. Probate Code 10309(a) allows the court to confirm a private sale only if the property was appraised within one year prior to the confirmation hearing, the valuation date falls within that year, and the sum offered is at least ninety percent of the appraised value. Under full authority that test does not apply at all, which is one of the practical reasons the authority in the letters matters so much.
How is the overbid actually calculated?
Probate Code 10311(a) requires the higher offer to be at least ten percent more on the first ten thousand dollars of the original bid and five percent more on the amount of the original bid in excess of ten thousand dollars. So the minimum first overbid is the original bid, plus 1,000 dollars, plus five percent of the original bid minus ten thousand dollars. On a 1,000,000 dollar accepted bid that comes to 1,050,500 dollars. Note that this is measured against the accepted bid, not against the appraisal.
Where is an Orange County probate heard?
At the Costa Mesa Justice Complex, 3390 Harbor Blvd., Costa Mesa, CA 92626. The probate assistance line is 657-622-8452 and the case access portal is at probatepublic.occourts.org. Orange County probate examiners review petitions three to four weeks before the hearing, which means a defect in a petition is usually identified with enough time to correct it rather than at the hearing itself.
How long does an Irvine probate take?
No official source publishes a typical duration and nobody should state one as fact. What the statute contemplates is this: the inventory and appraisal within four months after letters issue under Probate Code 8800, creditor claims due under Probate Code 9100 the later of four months after letters or sixty days after notice to that creditor, and a petition for final distribution or a status report not later than one year after letters under Probate Code 12200, or eighteen months where a federal estate tax return is required. A California probate rarely closes in under four to six months.
What is the estate going to pay in statutory compensation?
Probate Code 10800 sets the representative's compensation and 10810 sets the attorney's on identical tiers, and both are payable. The tiers are 4 percent of the first 100,000 dollars, 3 percent of the next 100,000 dollars, 2 percent of the next 800,000 dollars, 1 percent of the next 9,000,000 dollars and 0.5 percent of the next 15,000,000 dollars. The base is gross inventory value without reference to encumbrances, so a house appraised at 2,000,000 dollars with a 1,500,000 dollar mortgage counts at 2,000,000 dollars. That estate produces 33,000 dollars each, 66,000 dollars combined, plus any extraordinary fees.
Does the referee need to know which Irvine village the house is in?
Yes, and it is the single most useful thing the estate can supply. Irvine was planned as villages radiating from UC Irvine, each with its own schools, its own retail centre and its own architectural theme, separated by six lane arterials. A comparison drawn across villages produces a number that is not a number, and under limited authority that number becomes the ninety percent floor the court is bound by. Send the village, the school attendance area and the assessment structure with the inventory.
Does the estate have to disclose the Mello Roos special tax?
Yes, and the tax bill will not do it. Civil Code 1102.6b requires the seller to make a good faith effort to obtain a disclosure notice from each agency levying a Mello Roos special tax or a 1915 Act assessment and to deliver it to the buyer. In Irvine that notice comes from the City of Irvine as the levying agency. Confirm the district parcel by parcel by APN against the Orange County Treasurer Tax Collector record first, because village level lists are leads and not disclosures.
The Irvine house is in the Great Park neighbourhoods. Will a buyer ask about the special tax?
Every time, and the estate should have the city's own figures rather than a neighbour's version. The City of Irvine states that the CFD No. 2013-3 charge can rise by up to two percent a year, and that once the original bonds are repaid, typically about forty years, the charge drops by roughly 65 to 82 percent, with the remainder continuing for maintenance. It falls a long way and then stays. A buyer who is told it disappears and later reads the city page will distrust the rest of the disclosure.
Can I tell a buyer the Irvine house is in Irvine Unified?
Do not answer that from the city name and do not let a buyer assume it. Irvine Unified serves most of the city, but Tustin Unified serves Northpark and West Irvine, with Myford and Hicks Canyon elementaries, Pioneer Middle and Beckman High, and Santa Ana Unified serves several Irvine Business Complex towers including The Plaza, Central Park West, The Marquee and The Metropolitan. Boundaries move, so confirm by address with the district before it appears in marketing or in anything filed with the court.
Is the Irvine property now in a fire hazard severity zone?
It may be, even if it was not before. Irvine adopted the updated CAL FIRE maps by ordinance in June 2025, effective 23 July 2025, replacing the 2012 map, and the update expanded zones into eight areas: Orchard Hills, Woodbury, Portola Springs, Quail Hill, Turtle Rock, Laguna Altura, Los Olivos and Irvine Spectrum. A High or Very High designation brings defensible space documentation under Civil Code 1102.19 and the fire hardening disclosure at transfer, and the buyer's insurer will ask about it first.
