Divorce Real Estate Agent in Newport Beach, CA
When a marriage ends and there is a house in Newport Beach, the property becomes the hardest thing in the file. Paula Aragone handles these sales for both sides at once, so neither spouse feels the agent is working against them.
No, you cannot sell a Newport Beach house during a divorce on one signature. From the moment a divorce is filed, California law freezes the property. Neither spouse can sell, refinance or borrow against the house alone. That freeze is called the Automatic Temporary Restraining Orders, and it is printed on the summons both of you receive, Judicial Council form FL-110, under Family Code section 2040. There are only two ways forward: your spouse agrees in writing, or a judge orders the sale. That is the whole gate. Everything else on this page is about getting through it without losing money or time.
| Can one spouse sell alone | No. The divorce filing freezes the property for both of you |

In Newport Beach, the Dock Is a Second Asset
Most Orange County divorce sales involve one asset, the house. Newport Beach is built around a working harbour, and that adds a second asset, a second regulator and a second set of signatures.
If the property has a pier or a dock, the city treats that permit as its own thing. Before a sale closes, Newport Beach inspects the pier, issues a deficiency letter if it fails, reinspects after the repair, and requires a transfer application signed by the seller, the buyer and any joint permittee. Those signatures are due at the close of escrow. The application takes five to fifteen working days once it is submitted.
None of that is difficult. It is only expensive when it starts late. On a waterfront listing we open the pier file the same week the house goes on the market, so a failed inspection has time to become a repair instead of a delay that costs both spouses a buyer.
The second issue is the settlement itself. If the judgment says the house is sold and divided but never mentions the dock permit, the parties have divided an incomplete asset. That comes back after the divorce is final, when nobody wants to reopen anything.
The other Newport specific item worth knowing is the Residential Building Records report. The city used to require it before a sale and made it voluntary on 28 November 2023. It contains the permit history and, if the owner authorises it, a code enforcement inspection covering permits, zoning and life safety.
In an ordinary sale it is a nice to have. In a divorce it is worth pulling on purpose, because unpermitted work is the single most common thing one spouse uses against the other. A city report turns a fight about a garage conversion into a line item with a cost attached.
Newport also has a short term lodging permit programme that is capped citywide, closed to new single family permits since 2004, and transferable to a buyer only if the application is filed within sixty days of the title transfer. If the house has one, it is real value, and missing that window destroys it with nothing looking broken.
How a Newport Beach Home Is Sold During a Divorce
Nine steps, in the order that actually works when two people are not getting along. Most of it is ordinary. The parts that are not are marked.
Confirm who has the authority to sell
Before anything else, we establish whether both spouses agree in writing or whether a court order is needed. A listing signed by one spouse while the freeze is in place is not valid. This is the step people skip, and it is the one that costs months.
Agree on one agent, or agree on how to pick one
The cheapest path is one neutral agent both sides accept. When each spouse hires their own, the house gets two opinions of value, two strategies and no decision. If your attorneys prefer, they can interview together on one call.
Establish what the house is actually worth
California divides the community estate by value, so the number matters more here than in an ordinary sale. Value is set as close as practical to the time of trial under Family Code section 2552, which is why an old appraisal rarely settles the argument.
Separate the dock from the house
If the property has a pier or a dock, it is a second asset with its own city permit and its own transfer process. It has to be named in the settlement separately from the parcel, or the judgment is incomplete.
Pull the records before anything goes public
Permit history, unpermitted work, association documents, any short term lodging permit. In a divorce these surface as accusations between spouses. Pulled early, they are just facts, and they get handled quietly.
Prepare the house without one spouse funding it alone
Paint, repair and staging cost money that neither side wants to advance. We agree in writing beforehand how those costs are shared or reimbursed at closing, so the work happens instead of stalling.
List it, and communicate to both sides identically
Every showing, every offer and every price conversation goes to both spouses and both attorneys at the same time, in writing. Nobody learns something second. That single habit prevents most of the blowups.
Take the offer through both signatures
Both spouses sign the acceptance, the disclosures and the deed. Family Code section 1102 requires both on any conveyance of community real property, so a single signature does not close escrow.
Close, and direct the proceeds the way the order says
Escrow does not split money on a handshake. The instructions have to match the written agreement or the judgment. We coordinate that with both attorneys before the closing date, not on it.
Newport Beach Neighbourhoods, and What Each One Adds to the File
The neighbourhood usually decides whether there is a dock permit, a ground lease, an association, a special tax or a lodging permit to sort out. These are the ones that come up most.
Balboa Peninsula
Ocean on one side, harbour on the other, the Wedge at the east end. The densest and most rental exposed part of the city, so the lodging permit question and the post separation rent accounting both usually arise here.
Peninsula Point
Built from the early 1920s with 1950s Balboa cottages filling in, Cape Cod and Eastern Seaboard styling, quieter than the rest of the peninsula. Old stock, so the inspection report is long and the repair negotiation needs a decision rule agreed in advance.
Balboa Island, Little Balboa Island and Collins Isle
Dredged 1908 to 1909 by William Stepp Collins. Thirty by eighty five foot lots, extraordinary density, and Collins Isle holding about eight homes behind a one lane bridge. Flood history here is structural rather than incidental.
Lido Isle
Master planned in the 1920s on a former mudflat with Via and Strada street names, community docks, private beaches, clubhouse and a yacht club founded in 1928. Community dock rights are an association question, not a private permit question.
Bay Island
The only island in the harbour with no car access, originally a duck hunting club, with about twenty six bayfronts and common gardens. Access and title structure here are unlike anything else in the city and need checking before a value is agreed.
Harbor Island
Roughly thirty to thirty four private residences on a single gated road, every property waterfront with one or more docks. This is the clearest case for treating the dock permit as a separately identified asset in the judgment.
Linda Isle
Formerly Shark Island, brought into the city in 1954, horseshoe shaped and developed in the 1970s, guarded, with roughly 106 waterfront lots each holding its own dock. Permit transfer and pier inspection sit on the closing calendar here every time.
Beacon Bay
Lower bay, community dock and slips, tennis and basketball. Historically a ground lease community, which makes the interest being divided a leasehold rather than a fee. Pull the title structure before either side commits to a number.
Promontory Bay
About sixty two custom waterfront homes, each with a private dock. A compact market where a quiet off market sale is very visible, which is one more reason to run a dissolution listing in the open.
Bayshores
Gated enclave of about 249 homes on the turning basin with private beaches and a children's park. Association records, gate access rules and showing logistics all need one agreed point of contact when the parties are living apart.
Dover Shores
A 1950s development on the west side of the Back Bay with waterfront homes and private community beaches. Also one of the neighbourhoods where morning departure noise from John Wayne Airport is a live disclosure conversation.
Newport Heights and Cliff Haven
Bluff top above Pacific Coast Highway, larger lots, older stock, walkable to Newport Harbor High. Elevated landslide risk in the San Joaquin Hills means a buyer may ask for slope documentation before removing contingencies.
Eastbluff
An Irvine Company era tract known for greenbelts, next to the Back Bay bluffs. Long held family homes here are the classic dissolution file: one spouse on title first, community earnings paying the loan down for decades.
Big Canyon
Opened in the early 1970s, a gated golf course community on a 414 acre village site across from Newport Center, with sub associations around the country club. Two sets of governing documents means two document orders and two sets of dues to reconcile.
One Ford Road
Built in three phases from 1999 to 2002 on the former Ford Aeronutronic site, 371 homes across six tracts plus eight custom homes on Troon Drive, with a 24 hour guard gate and shared amenities. Modern systems, so the friction is documentary rather than mechanical.
Harbor View Homes, the Port Streets
Family tract inland of MacArthur feeding Andersen Elementary, the most consistently school driven submarket in the city. School placement is one of the factors a court weighs on a request to defer the sale.
West Newport, Newport Shores and Balboa Coves
The northern end, with Newport Shores holding its own community association and Balboa Coves gated off Pacific Coast Highway with private docks. Mixed product, so character and permit questions have to be answered parcel by parcel.
Newport Coast
Annexed around 2001 and 2002, with guard gated villages including Crystal Cove, Pelican Crest, Pelican Hill, Pelican Point, Pelican Ridge, Pacific Ridge, Newport Ridge and Altezza. This is the city's Community Facilities District exposure and the area most affected by the 2025 fire map adoption.
Almost none of these sales fall apart over the house. They fall apart over sequence.
Newport Beach, California
After enough of these, the same six problems account for most of the delay and most of the lost money. All six are avoidable, and all six are cheaper to prevent than to fix.
Listing before the authority is settled
One spouse signs a listing agreement while the freeze is still in place. It is not valid, and by the time somebody notices, the house has been on the market with no legal footing.
The fix takes a single conversation: written consent from the other spouse, or a motion. Doing it first costs a week. Doing it after costs the listing.
Two agents, two prices, no decision
Each spouse brings their own agent, each one arrives with a number that pleases the person who hired them, and the gap between the two numbers becomes the argument.
One agent working for the sale rather than for a person removes the argument. If one side cannot accept that, the alternative is a joint appraiser, which is slower but still better than two competing opinions.
A quitclaim deed that does nothing to the mortgage
This is the most damaging misunderstanding in a divorce transaction. Signing the house over changes who owns it. It does not change who owes the loan.
The lender was never part of your divorce. Until there is a refinance or a written release of liability from the servicer, the departing spouse is still on the note, it still shows on their credit, and a late payment still lands on them.
The dock permit left until escrow
The pier inspection fails, the repair takes weeks, and the buyer walks while both spouses blame each other.
Opened at listing, the same problem is a repair with a timeline. There is nothing hard about it except when it starts.
Nobody agreed who pays to get it ready
The house needs paint, a repair and a clean out. Neither spouse will advance the money because neither trusts the other to reimburse it, so the house lists in the condition it is in and sells for less than it should.
A one page written agreement on preparation costs, signed before the work begins, solves this. The money comes off the top at closing.
Information reaching one spouse before the other
An agent calls one spouse first, out of habit. The other spouse finds out later and reasonably concludes the agent is on the other side. Trust does not come back after that.
Everything goes to both parties and both attorneys at the same time, in writing. It is not a courtesy, it is what keeps the sale moving.
Sell the House, or One Spouse Buys the Other Out
There are only two real outcomes. Each one has a cost that is easy to see afterward and hard to see now. Here is the honest version of both.
Selling and dividing the proceeds
This is the clean break. The house becomes a number, the number gets divided the way the agreement or the judgment says, and neither of you is financially tied to the other afterward.
It is also the option that ends the mortgage question permanently. Nobody is left on a loan for a house they no longer live in, which is the problem that follows people into their next purchase.
The cost is real. You both move, and in Newport Beach that usually means leaving the neighbourhood, because what your half buys is not what the two of you owned together. If there are school aged children, that is the part worth thinking hardest about.
There is also timing. A sale runs on the market's schedule, not on the court's, and pushing a coastal property to close by a hearing date rarely improves the price.
One spouse keeps the house
The house stays, the children stay in their school, and one person keeps the address. When it works, it is clearly the better outcome for the family.
It works when two things are true. The retaining spouse can qualify for the new loan on their income alone, and there are enough other assets to balance the division without draining everything.
Where it goes wrong is the loan. A buyout refinance is usually priced as a limited cash out refinance, which is better pricing, but only if the two of you have jointly owned the property for at least twelve months and there is a written agreement stating the terms. The retaining spouse is underwritten alone, on their income and their credit.
And be honest about the carrying cost. A house that was comfortable on two incomes is a different house on one. More than a few of these come back on the market within three years, and by then the divorce is over and there is no structure left to manage the sale.
The Whole Value Here Is Being Trusted by Both of You
Paula Aragone has worked in Orange County real estate for twenty three years, through more than nine hundred transactions, and holds the CPRES and SRES certifications along with a law school background that makes the paperwork side of these files familiar rather than intimidating.
In a divorce sale, none of that matters as much as one thing: both spouses have to believe the agent is not working against them. The representation here is of the sale. Not the husband, not the wife. Every showing, every offer, every number goes to both sides and both attorneys at the same moment, in writing, and there are no separate conversations.
That neutrality is also why attorneys refer these. A family law attorney does not want an agent who will be accused of coaching one client. They want somebody who documents everything, communicates identically to both parties, and does not need to be supervised.
One thing this office does not do is give legal or tax advice. What sits in the community estate, how it gets divided, what a reimbursement claim is worth, those are questions for your attorney and your accountant. What happens here is the property: what it is worth, what it needs, who has to sign, in what order, and how it closes without either of you feeling handled.
Divorce and the House in Newport Beach
Short answers first. If yours is not here, call and ask, or have your attorney call.
Can I sell my house during a divorce in California without my spouse agreeing?
No. Once a divorce is filed, the Automatic Temporary Restraining Orders under Family Code section 2040 stop either spouse from selling, refinancing or borrowing against the property alone. You need your spouse's written consent or a court order. There is no third option.
What are the ATROs and when do they start?
They are the standard restraining orders printed on the divorce summons, form FL-110. Under Family Code section 233 they bind the spouse who files as soon as the petition is filed, and they bind the other spouse the moment they are served. They stay in force until the judgment is entered or the case is dismissed.
Who has to sign the listing agreement?
Both spouses, unless a court order says otherwise. A listing signed by one spouse while the restraining orders are in place is not enforceable, and finding that out after the house has been marketed is far more expensive than settling it first.
Can one spouse force the sale of the house?
A judge can order a sale, yes. California requires the community estate to be divided equally under Family Code section 2550, and where it cannot be divided any other way, or neither spouse can qualify to buy the other out, the court can order the house sold. That is a request your attorney makes, not something an agent can do.
What if my spouse refuses to sign the deed at closing?
Your attorney can ask the court to appoint an elisor, a court officer who signs in place of the refusing party. It works, but it adds time and cost, so it is worth raising with your attorney early rather than discovering the problem the week escrow is due to close.
How is the house valued in a divorce?
By fair market value, set as close as practical to the time of trial under Family Code section 2552. In practice that is usually a joint appraiser both sides accept, or two appraisals with the gap negotiated. An agent's opinion of value informs the conversation but does not settle it.
Can I buy out my spouse instead of selling?
Often yes, if you can qualify for the new loan on your own income and the rest of the estate can be balanced around it. The lender underwrites you alone. Note that a buyout refinance usually needs the two of you to have jointly owned the property for at least twelve months to get the better pricing, and needs a written agreement stating the terms.
Does a quitclaim deed remove my spouse from the mortgage?
No, and this is the costliest misunderstanding in these files. A deed changes ownership. The loan is a separate contract and the lender was never part of your divorce. The only two ways off the note are a refinance, or a written release of liability from the servicer. Until then the debt stays on the departing spouse's credit.
What happens to the dock or the pier permit?
It transfers separately from the house. Newport Beach inspects the pier, may issue a deficiency letter requiring repair, and needs a transfer application signed by seller, buyer and any joint permittee, with signatures due at close of escrow. Start it at listing. The permit also has to be named in the settlement, not folded into the word house.
Do we owe capital gains tax when we sell?
It depends on your filing status and how long each of you lived there, which is an accountant question. The general rule under Internal Revenue Code section 121 is that a married couple filing jointly can exclude up to five hundred thousand dollars of gain on a main home, and a single filer up to two hundred and fifty thousand, subject to ownership and use tests. Whether you still file jointly in the year of sale changes the answer, so ask your accountant before you set a closing date.
Who pays the mortgage while the divorce is pending?
Whatever the two of you agree or the court orders. If one spouse pays community debts from their own post separation money, they may be entitled to reimbursement, and a spouse living in the house alone may be charged for that use. Those are called Epstein credits and Watts charges. Your attorney handles them; they matter here because they change what each side nets at closing.
Can we wait and sell after the children finish school?
Sometimes. California allows a deferred sale of home order, often called a Duke order, which lets the custodial parent and the children stay in the house temporarily. Courts look at whether it is economically feasible and whether it genuinely serves the children. It is a request for your attorney to make.
Do you represent me or my spouse?
Neither, and that is the point. The representation is of the sale. Both spouses and both attorneys receive the same information at the same time in writing. If you want an agent who will advocate for you against your spouse, that is a legitimate choice, and this is not that service.
Can my attorney call you instead of me?
Yes, and that is often the easier start. Many of these begin with a call from a family law attorney rather than from a spouse. Your attorney can call, ask what the property side would involve, and bring you in afterward.
What is the Residential Building Records report and do we need it?
It is a Newport Beach report containing the permit history and, if you authorise it, a code enforcement inspection of permits, zoning and life safety items. It became voluntary in November 2023. In a divorce it is worth pulling deliberately, because it turns arguments about unpermitted work into documented items with a cost, which is much easier to divide.
How long does a divorce home sale take in Newport Beach?
Once the authority to sell is settled, the sale itself runs on a normal timeline. What stretches these files is everything before the listing: agreeing on an agent, agreeing on value, and getting consent or an order. Six months from first call to closing is a fair planning assumption, and it is much shorter when both attorneys are involved early.
