During a dissolution, neither owner can list a Costa Mesa house alone. The City Puts the Permit History in Writing at Point of Sale


Costa Mesa is the only one of these cities that issues its own report on a house when it is sold. In a dissolution that document does more than satisfy a code section: it settles an argument.

Municipal Code Title 5, Chapter VIII sets it out. Section 5-120 requires the owner of a residential building to obtain a report of the residential building records from the city on entering into an agreement of sale, and to file the application within three days of entering that agreement. Section 5-119 describes what the report covers: the zoning of the building, the number of dwelling units permitted under that zoning classification, and other information relevant to use, occupancy and construction.

Section 5-121 sets fees by council resolution, adds an inspection fee where the owner consents to an inspection, and gives the city thirty days from a completed application and payment to issue. Section 5-123(b) requires the owner to deliver the completed report to the buyer before the transaction completes, with the buyer executing an acknowledgment that is filed with the city within thirty days after closing. Section 5-124 lists ten categories of exempt transaction, including the first sale of an unoccupied building, foreclosures, court ordered transfers, and transfers between spouses or into trusts.

One caution belongs alongside all of that. A widely circulated compilation of California presale inspection cities does not list Costa Mesa, while the ordinance sits in the current codification. The correct handling is to confirm current administration, fee and turnaround directly with Building and Safety at the start, rather than assuming either that it is required or that it is dormant. In a file with two signatories and a thirty day escrow, a three day filing window and a thirty day issuing window are not details to discover late.

The reason this matters more here than the same ordinance would elsewhere is the housing stock. More than 75 percent of Costa Mesa housing was built before 1980, specifically 79 percent of owner occupied units and 77 percent of rentals. Lots are the city's advantage, with a median around 7,405 square feet on the Eastside and around 6,969 on the Westside, materially larger than comparable Irvine or Tustin Legacy product. Big lots and old houses produce additions, and additions produce permit questions.

The two halves of the city are not one market. Eastside sits east of Newport Boulevard toward the Back Bay, median build year around 1961, midcentury ranch with Colonial Revival and modern farmhouse infill, with East 17th Street as its commercial spine. Westside runs to a median build year around 1960 and holds Orange County's first tract housing from the late 1940s and 1950s, along with Craftsman, California Bungalow, Spanish Colonial Revival and midcentury modern, plus the 19 West, Mesa West Residential Ownership and Mesa West Bluffs overlays that put residential next to commercial and industrial block by block.

The honest difficulties are the same facts read the other way. A 1950s or 1960s house here commonly carries galvanised supply lines, cast iron drains, an obsolete panel, aluminium branch wiring in anything permitted from 1965, and original aluminium windows, and inspection reports arrive at the moment two people are least able to agree who pays. The sewer lateral is the owner's responsibility past the point of connection with the Costa Mesa Sanitary District main, usually in the middle of the street, with no point of sale certification programme to fall back on. And in March 2025 Costa Mesa was one of five Orange County cities newly mapped into fire hazard severity zones, at Moderate and High but no Very High, which nobody in a flat coastal city expected.

How a Costa Mesa Home Is Sold During a Dissolution


In most cities the permit history surfaces during a buyer's inspection. In Costa Mesa the city itself produces a document about it at point of sale, so the order of work here is built around getting that answer before either party builds a number on top of it.

Work out who is bound, and from when

Under Family Code 233 the restraining orders reach the petitioner on filing of the petition and issuance of the summons, and the respondent on personal service or on a waiver and acceptance of service. They hold until judgment, dismissal or a further order of the court. The answer sets what either party may do next without the other, which is very little.

Set the listing authority down on paper

Selling a family residence is not a transaction in the usual course of business, so the sale needs written consent or a court order. A usable order names the property and its legal description, the broker, the list price and the authority to reduce it, who may accept an offer, who signs each instrument, and how the net proceeds are disbursed to two people.

Pull the permit history before either of you names a number

Costa Mesa lots are large enough to build on and most of the housing predates 1980, so additions, patio enclosures and garage conversions are ordinary here. Search the city permit records by address and parcel number, request the jacket and approved plans where the online record is thin, and compare the result against the Assessor's recorded square footage.

Have counsel fix the character of the property

Family Code 760 makes property acquired during marriage community and 770 makes what was owned before marriage separate. Family Code 2581 presumes joint title taken during marriage is community. Where community earnings reduced a premarital loan, Moore and Marsden applies, and where separate money went into a down payment or improvements, Family Code 2640 does. Lawyer work, every time.

Instruct one appraiser, and say which side of Newport Boulevard

Family Code 2552 values the estate as near as practicable to the time of trial, with the exception in 2552(b) available on thirty days notice and for good cause. Eastside and Westside carry different build eras, different lot sizes and different adjacency, so an instruction that treats the city as one market produces a number the other side can attack.

File for the Report of Residential Building Records on time

Municipal Code section 5-120 requires the owner to obtain the report from the city on entering into an agreement of sale, and to file the application within three days of entering that agreement. The city issues the report within thirty days of a completed application and payment. Two separated signatories and a thirty day escrow do not leave room for a late start.

Put it on the open market and keep one channel

Broad exposure protects both parties, because a quiet sale at a soft number is the one each side will later say the other arranged. Fix in writing who holds the showing calendar, who approves a price reduction and how a disagreement is settled. Where one party still lives in the house, access terms belong in the order rather than in a text message.

Give offers a rule you both agreed in advance

Every counter, every repair credit and every extension needs the same two signatures the listing needed. Agree a written threshold before the first showing: a price at or above which acceptance is automatic, a fixed response window, and a named tiebreaker. Without one, an ordinary three day response becomes two weeks of correspondence and the buyer walks.

Deliver the report, then disburse on a set formula

Section 5-123(b) requires the owner to deliver the completed report to the buyer before the transaction completes, with the buyer's acknowledgment filed with the city within thirty days after closing. Escrow then acts only on instructions both principals signed. Conflicting instructions produce an interpleader, so the judgment should state the formula and the instructions should repeat it.

Build era, lot size and what sits on the next parcel change materially across this city. These are the areas that come up most often when one house has to be valued for two people.

Eastside Costa Mesa

East of Newport Boulevard toward the Back Bay, median build year around 1961, midcentury ranch with Colonial Revival and modern farmhouse infill, and the largest median lot of the two main quadrants at roughly 7,405 square feet.

The 17th Street corridor

East 17th Street is the Eastside commercial spine and its everyday errand and dining street. It is the strongest non school amenity argument on that side of town and it holds the buyer pool steady when a listing takes longer than one.

Westside Costa Mesa

Median build year around 1960 and a median lot near 6,969 square feet. Orange County's first tract housing appeared here in the late 1940s and 1950s, and boat builders and manufacturers along 19th Street have been partly converted to lofts.

19 West

A Westside overlay zone designated as a revitalisation area, permitting residential or mixed use. Adjacency has to be checked parcel by parcel, because noise, odour and vibration from a neighbouring use are a valuation question, not a footnote.

Mesa West Residential Ownership and Mesa West Bluffs

Two further Westside overlays. Together with 19 West they are the reason a Westside valuation has to be built block by block, which matters when two parties are each convinced the other has picked a convenient comparison.

Mesa Verde

Bounded by the freeway, Harbor Boulevard, Victoria Street and the Santa Ana River, bisected by Adams Avenue, largely developed in the 1960s and 1970s, anchored by Mesa Verde Country Club, which opened in January 1959, with the Fairview Channel running to Fairview Park.

Mesa del Mar

An early 1960s tract north of the Fairgrounds with consistent single and two story ranch product on regular lots, one of the most cohesive mid 1960s neighbourhoods in the city and therefore one of the easier ones to appraise cleanly.

College Park

Next to Orange Coast College and the Fairgrounds, established, with varied lot shapes and a mix of original construction and newer infill. The infill is exactly where a permit history search earns its cost in a contested file.

Halecrest

Mid 1950s, one of the earliest planned communities in the area, conceived by Herman Hale and originally named College Estates. Cottage and ranch designs on raised foundations, and Halecrest Park is a private swim and tennis club rather than a mandatory association.

Hall of Fame

Sits alongside Halecrest as the north central established pair, with streets named for baseball figures. Same era and same inspection profile, which means the repair negotiation needs a decision rule agreed before the report arrives.

South Coast Metro

Attached product, condominiums and townhomes next to South Coast Plaza, the Segerstrom Center and the office employment core, straddling the Costa Mesa and Santa Ana boundary. Association records belong in the file at listing.

South Coast and Wimbledon Village

Attached communities inside the Metro area. The 1970s and 1980s attached inventory is where polybutylene supply piping, reserve studies and building envelope questions all arrive in the same week.

Bristol and Paularino

Mixed attached housing near South Coast Plaza and the arts venues. This is also part of the quadrant nearest John Wayne Airport, so any tract map or deed notice about aircraft operations needs to be delivered rather than assumed.

Downtown Costa Mesa

Along Newport Boulevard and the 19th Street area, small older lots and the oldest surviving housing in the city. Raised foundations, under floor access and original systems make the inspection longer than either party expects.

Freedom Homes and the Fairview area tracts

Post war tract names still used by local agents inside the broader quadrants. Consistent floor plans make a valuation defensible, which is worth a great deal when two appraisals are otherwise on the table.

Canyon Park, Republic Homes and Sea Bluff

The other tract names that appear in Costa Mesa listings. Confirm the association position parcel by parcel, because much of the single family side of this city has no association at all, unlike its neighbours.

What actually delays it

Six Points Where a Costa Mesa Divorce Sale Stalls

None of these are about the market. Each is a record the city, the district or the county already holds, obtained too late or not at all.

The city report was started after the escrow clock

Section 5-120 puts the application within three days of entering into the agreement of sale, and section 5-121 gives the city thirty days from a completed application and payment to issue the report. Those two windows sit almost exactly on top of a normal escrow.

In a dissolution the three days are the hard part, because the application, the fee and any consent to inspection all need agreement from two households that may only communicate through counsel. Decide who files and who pays before the property is even listed, and put that in the same document that authorises the sale.

The garage conversion has no permit behind it

Unpermitted additions and converted garages are the most common Costa Mesa escrow problem by a wide margin, because the lots are big enough to build on, the stock is old enough that much of the work predates current records, and the infill culture rewards square footage.

In a contested file this becomes a second argument on top of the first, over who did the work, what it cost and whether anyone applied. A city issued report and a permit jacket are neutral documents. They replace two competing accounts with one record, which is worth more in this situation than it would be in any ordinary sale.

The buyout was assumed to be exempt

Section 5-124 lists ten categories of exempt transaction, including court ordered transfers and transfers between spouses or into trusts. So an interspousal transfer inside a dissolution may sit outside the ordinance entirely.

That is a trap rather than a relief. The exemption, if it applies, ends at the interspousal transfer. When the retaining spouse sells to a third party two years later, the report is required then, on a house whose permit history was never examined because everyone thought the question had gone away. Confirm the position with Building and Safety rather than reasoning from the list.

Eastside and Westside were treated as one market

The two quadrants differ in median build year, median lot size and, on the Westside, in what the overlays allow on the adjoining parcel. A valuation built across the whole city is a number that neither party should accept and that a court will discount.

This is where two competing appraisals usually come from. One jointly instructed appraiser, given a written instruction that names the quadrant and the block, produces a transaction. Two appraisers instructed separately by two lawyers produce a hearing date.

Nobody looked at the sewer lateral

The Costa Mesa Sanitary District maintains about 224.2 miles of main, but the property owner is responsible for the lateral until past the point of connection with that main, which is usually in the middle of the street. There is no point of sale lateral inspection or certification requirement, only a voluntary inspection rebate programme.

On 1950s and 1960s stock under mature street trees, a video is inexpensive and a root intrusion finding is a routine repair negotiation. It becomes a problem only when it appears late, because a repair discovered after acceptance needs both parties to authorise the expenditure under the same rules that govern every other decision in the file.

The 2025 fire map reached a flat coastal city

Costa Mesa was one of five Orange County cities newly included in the March 2025 CAL FIRE maps, with Moderate and High zones and no Very High. Sellers here are the least likely in the county to expect it, because nothing about the terrain suggests it.

A High zone parcel triggers AB 38: defensible space compliance documentation under Civil Code 1102.19 and, since 1 July 2025, disclosure of available low cost retrofits, which of them the seller completed, and known vulnerabilities. Confirm the specific parcel against the state viewer rather than assuming the whole city, and expect the buyer's insurer to ask first.

The decision

Two Ways Out, and What Each Does to the Permit Question


Two outcomes. In Costa Mesa the second one carries a specific consequence, because the questions the city report would have answered do not disappear, they wait.

Sell the house

A sale converts a contested asset into a number, and a number can be divided under Family Code 2550 without either party depending on the other afterwards. It also forces the permit history into the open while both parties are still available to explain it, which on a house that has been added to twice in forty years is easier now than it will be later from two separate households.

The tax position is usually better while the marriage is intact. Under IRC section 121 the exclusion is 250,000 dollars per individual taxpayer and 500,000 dollars on a joint return where either spouse meets the ownership test, both meet the use test, and neither is disqualified by the two year look back. Both tests run on twenty four months out of the five years ending on the date of sale, so selling while still married and filing jointly in the year of sale can preserve the whole 500,000 dollars.

Design the close before it arrives. Both parties sign the escrow instructions and both must sign any amendment. If the two of them later give conflicting instructions the escrow holder does not choose, it interpleads and the funds sit with the court. State withholding is a standard 3 1/3 percent of the sales price on form 593 unless an exemption applies, including certification that the property qualified as a principal residence under section 121.

The honest downside: a sale is public, it moves at the speed of two signatures, and the report may surface work that has to be corrected or disclosed before anyone gets paid. Where children are settled at a Newport Mesa Unified school, moving twice is a real cost, and Family Code 3802 allows a court to weigh school placement and the emotional detriment of a move when one parent asks to defer the sale.

One spouse buys the other out

The arithmetic starts with fair market value at the applicable date, less encumbrances, which gives gross equity. Any Family Code 2640 reimbursement for traced separate property contributions comes off the top, along with any separate interest under Moore and Marsden, adjusted for Epstein credits and Watts charges. What is left is community equity and each interest is half. Whether hypothetical costs of sale are deducted when nothing is being sold is contested, so negotiate it rather than assume it.

The lender decides whether this is available at all. Under the Fannie Mae Selling Guide, a refinance that pays off the existing first mortgage and buys out a co owner is a limited cash out refinance, with better pricing, only where the property was jointly owned by all parties for at least twelve months before disbursement. All parties must sign a written agreement stating the terms of the transfer and the disposition of proceeds, the retaining spouse may not receive any of those proceeds, incidental cash back is capped at the greater of one percent of the new loan amount or 2,000 dollars, and the retaining spouse must qualify alone.

Removing a spouse from title and removing them from the loan are two separate acts, and conflating them is the most damaging error in a divorce transaction. A deed changes ownership. The note is a contract with a lender who is not a party to the divorce, so a judgment, a settlement agreement and a recorded interspousal transfer deed do not discharge liability. The two exits are a refinance or an assumption with an express written release of liability from the servicer, and the Garn St Germain Act generally prevents acceleration on a divorce related transfer, which is exactly why the deed records cleanly while the liability stays.

The honest downside is two sided here. On tax, a transfer between spouses incident to divorce is not a taxable event under IRC section 1041 and the receiving spouse takes carryover basis, so the whole built in gain lands on the buying spouse, who may have only 250,000 dollars of exclusion at the eventual sale. On disclosure, the questions the city report would have answered are simply deferred, and the spouse who kept the house answers them alone, later, without the other person's memory or paperwork.

A Record Neither Side Can Later Call Arranged

What Two Sellers Ask About a Costa Mesa Divorce Sale


Answers for California dissolution law and for the one city here that issues its own report on a house at point of sale.

Can one of us list the house while the divorce is pending?

No. Family Code 2040 restrains both parties from transferring, encumbering, hypothecating, concealing or in any way disposing of any property, community, quasi community or separate, without the written consent of the other party or an order of the court. A family residence is not sold in the usual course of business, so the statutory exception does not reach it. Every record owner also has to sign the listing agreement, and Family Code 1102 requires both spouses to join in any instrument conveying community real property.

We were not served on the same day. Does that change anything?

Family Code 233 gives the rule. They are effective against the petitioner on filing of the petition and issuance of the summons, and against the respondent on personal service of the petition and summons or on the respondent's waiver and acceptance of service. They stay in force until final judgment is entered, the petition is dismissed, or the court orders otherwise. The orders themselves are printed on the face of Judicial Council form FL-110.

What is the Report of Residential Building Records?

It is a document the city issues about the property at point of sale, under Municipal Code Title 5, Chapter VIII. Section 5-119 says it describes the zoning of the residential building, the number of dwelling units permitted under that zoning classification, and other information relevant to use, occupancy and construction. In practice it is the mechanism by which an unpermitted addition or a converted garage becomes an official record rather than a dispute between two people.

How quickly do we have to apply for the report?

There is an addition on the house and neither of us knows if it was permitted. What now?

Search the city permit records by address and parcel number first, then request the permit jacket, approved plans, inspection log and final where the online record is incomplete, which is common for pre digitisation permits. Compare what comes back to the Assessor's recorded square footage. Ordering the Report of Residential Building Records is the formal route and produces a city issued document rather than a stack of copies, which is exactly what a file with two disagreeing sellers needs.

Who is responsible for the sewer lateral?

The owner, and further than most people expect. Attached product in South Coast Metro, Wimbledon and newer infill carries conventional associations, and Halecrest's swim and tennis club is a private club rather than a mandatory association.

Why would a flat coastal city be in a fire hazard zone?

Because the state remapped it. Costa Mesa was one of five Orange County cities newly included in the March 2025 CAL FIRE maps, with Moderate and High zones but no Very High. Which high school does the house feed into?

Newport Mesa Unified serves both Costa Mesa and Newport Beach, with Costa Mesa High School and Estancia High School as the comprehensive high schools and Costa Mesa Middle and TeWinkle Middle serving the city. Specific pockets, primarily on the Eastside, are reported to feed Newport Harbor High instead. That claim is brokerage sourced and boundaries change, so confirm by parcel number with the district before either party or any listing repeats it.

Community earnings paid the loan on a house one of us already owned. What then?

Under Moore and Marsden, and it is counsel's calculation. Family Code 770 makes property owned before marriage separate, but where community earnings reduced the loan principal the community acquires a proportional interest under In re Marriage of Moore (1980) 28 Cal.3d 366 and In re Marriage of Marsden (1982) 130 Cal.App.3d 426, with appreciation before the marriage staying entirely with the owner spouse. In re Marriage of Mohler (2020) 47 Cal.App.5th 788 fixes the community percentage as of the date of separation.

I paid for the addition with money I inherited. Do I get it back?

If you can trace it to a separate source, yes, in nominal dollars. Family Code 2640 reimburses separate property contributions to the acquisition of community property, and the statute expressly includes payments for improvements as well as down payments and payments that reduce loan principal. Interest, maintenance, insurance and taxes do not qualify. The reimbursement carries no interest and no adjustment for change in monetary values, and it cannot exceed the net value of the property at the time of division.

Is the house valued as of separation, or later?

Family Code 2552(a) makes the default a valuation as near as practicable to the time of trial, not the date of separation and not the date of filing. Under 2552(b), on thirty days notice and for good cause shown, the court may value all or part of the estate at a date after separation and before trial to accomplish an equitable division. The practical consequence is that the community usually shares any movement in value between separation and trial.

Why is this slower than an ordinary listing?

Because the extra time is procedural rather than market driven. It is the court calendar, the two signature requirement on every document, the permit history search, the city report application and its thirty day issuing window, and any Request for Order needed to authorise a step nobody will consent to. Get the consent or the order first, start the permit work before listing, and the marketing period itself runs at normal speed.
