Probate Real Estate Agent in Santa Ana, CA

Paula Aragone represents executors and administrators selling Santa Ana property under court supervision, including tenant occupied houses under the only rent stabilization ordinance in Orange County and historic homes that carry a Mills Act contract.

The short answer

Probate in Santa Ana runs on the authority in the letters. Full authority under Probate Code 10402 means a Notice of Proposed Action and no hearing. Limited authority under 10403 means the court confirms the sale. What Santa Ana adds is occupancy and history: a personal representative may inherit a tenant protected by the city's rent stabilization and just cause ordinance, or a registered historic house whose Mills Act contract binds the buyer.

An Estate Can Inherit a Tenant, and a Contract With the City

Santa Ana is the only city in Orange County with rent control, and most of its homes are rented. It also holds three National Register historic districts. A representative can take over both on the day letters issue, and neither shows up in a listing photograph.

The City Council adopted the Rent Stabilization and Just Cause Eviction ordinances on 19 October 2021 and they took effect on 19 November 2021. Voters approved Measure CC in November 2024, and the ballot text provides that later changes to the ordinance also need voter approval. Only 44.6 percent of the city's housing units are owner occupied in the Census Bureau's 2020 to 2024 estimates, so a decedent's house is often somebody's rental.

Just cause protection starts once a tenant has lawfully occupied the unit for 30 days, not the twelve months state law uses. A no fault termination, such as an owner or family move in, withdrawal from the rental market or a substantial remodel, requires relocation assistance equal to three months of the tenant's rent, or a waiver of the final three months. The ordinance lists no just cause ground for selling the property, so a sale by itself does not end a tenancy.

A single family house or condominium can be exempt from the rent cap under the Costa Hawkins Rental Housing Act, and from just cause only if the owner is not a corporation or investment trust and the tenant was given the written notice the ordinance prescribes. An estate usually cannot prove the decedent ever delivered that notice. The allowable increase from 1 September 2026 to 31 August 2027 is 2.87 percent, the lesser of 3 percent or 80 percent of the change in the consumer price index.

Every landlord registers every rental unit with the city each year, through the Rent Stabilization Division at 801 West Civic Center Drive. The 2026 fee was 100 dollars per unit through 31 July and 104 dollars after. An exemption has to be claimed and approved, and until the city approves it the unit is treated as covered. While registration is incomplete the ordinance bars accepting rent or evicting. After a sale the seller notifies the city within 30 days of close of escrow and the buyer registers within 60.

The second inheritance is historic. Downtown was listed on the National Register in 1984, French Park in 1999 and Floral Park in 2023, and the city has kept its own Register of Historical Properties since 1998. Exterior alterations other than paint, relocation and demolition of a registered property are reviewed first, and since July 2026 the Planning Commission has been the hearing body for Mills Act and register applications.

A Mills Act contract is recorded against title, runs at least ten years, renews itself each year and binds every successor in interest under Government Code 50281 and 50282. The city describes property tax savings of up to 50 percent and inspects participating homes at least every five years. Cancelling costs 12.5 percent of current fair market value under Government Code 50286. None of that is a reason to avoid the house. It is a reason to put the contract in front of the buyer on day one.

The sequence

How a Probate Property Sale Works in Santa Ana

The Probate Code sets the order and the deadlines. In Santa Ana the retrieval work runs alongside them, because a rental registration, a tenant file or a Mills Act contract takes longer to assemble than the fifteen day notice takes to serve.

01

Get appointed, and find out which powers came with it

The letters state whether the representative holds full or limited authority under the Independent Administration of Estates Act. Full authority under Probate Code 10402 carries every power. Limited authority under 10403 withholds four, all of them about real property: sale, exchange, granting an option to purchase, and borrowing against it. Probate Code 10501(b) returns those four to court supervision.

02

Inventory the estate and hand the referee the occupancy file

Probate Code 8800 puts the inventory and appraisal four months out from the issue of letters. A referee appointed under Probate Code 8920 values the real property for a commission of one tenth of one percent plus expenses under 8961, floored at 75 dollars and capped at 10,000 dollars per estate under 8963. In Santa Ana he should know before he values the house whether it is tenant occupied and whether a Mills Act contract is recorded against it, because both change what a buyer pays.

03

Secure the property, and find out who lives there

Locks, mail redirection, utilities kept on and a call to the carrier, because a homeowners policy assumes an occupied house. If someone is living in it, stop there: a tenant with 30 days of lawful occupancy has just cause protection in Santa Ana, and the locks are not the estate's to change.

04

Decide between notice and a courtroom

Full authority means Probate Code 10503 lifts the confirmation requirements from the sale entirely, leaving only the Notice of Proposed Action. Limited authority means a published notice, a report of sale, a hearing and an open overbid. The decision is not the family's preference. It is whatever the letters already say, and it should shape the listing from day one.

05

Assemble the disclosures before the first showing

For a rental that means the lease, the rent history, the city registration and any exemption notice the decedent served. In Floral Park, French Park, Heninger Park and the other registered areas it means the Mills Act contract, the review history and the permit jacket for every exterior change. On a detached rear garage it means the question of whether it is still a garage.

06

Fifteen days of notice, or a published notice and a report of sale

Under Probate Code 10586 the Notice of Proposed Action is mailed or personally delivered not less than fifteen days before the date it specifies, to the recipients in 10581. Under limited authority the notice of sale is published per Probate Code 10300 and Government Code 6063a, and the report of sale and petition follow under 10308.

07

The hearing, and anyone who wants to bid

Orange County examiners review petitions three to four weeks ahead, so a defective petition is usually caught in time. The court may confirm only at ninety percent or more of the appraised value under Probate Code 10309(a). A qualifying overbid under 10311(a) can then take the property, and the court accepts the highest qualifying offer under 10311(b).

08

Escrow, with the tenancy and the contract handed over properly

A buyer taking a tenant occupied house inherits the tenancy, the registration duty and the rent cap, and has 60 days to register. A buyer taking a Mills Act house inherits the contract. Neither should be discovered in the preliminary title report. Orange County documentary transfer tax is 1.10 dollars per 1,000 dollars of net consideration.

09

Account to the court and distribute

Probate Code 12200 requires a petition for final distribution or a status report not later than one year after letters, or eighteen months where a federal estate tax return is required. Compensation under Probate Code 10800 for the representative and 10810 for the attorney runs on identical tiers and both are payable from the estate.

Where we work

Santa Ana Neighbourhoods, and What Each Puts Into the Inventory

Santa Ana runs from Victorian and Craftsman houses built before 1910 to postwar tracts on former orange groves, across 65 named neighbourhoods. The neighbourhood decides which file the estate has to pull first.

Floral Park

National Register historic district since 2023, 673 resources of which 576 contribute, roughly bounded by Santiago Creek, 17th Street, Broadway and Flower Street. Mostly built by 1939 in Colonial Revival, Tudor, Spanish Revival and Storybook styles, often with a detached rear garage down a long driveway. More than 199 houses are on the local register.

French Park

Listed on the National Register in 1999 and protected by its own zoning, the SD 19 district. About twenty blocks northeast of downtown, built from the late 1890s to the 1920s in Victorian, Colonial Revival, Craftsman and Spanish Eclectic styles. Some large houses were divided into apartments in the 1940s, which can put an inherited house under the rent ordinance as a multi unit property.

Heninger Park

Santa Ana's second local historic district, adopted in May 1986 as SD 40, with exterior standards for every property. About 150 Craftsman bungalows built by the Heninger brothers from 1907 over twelve years, between First Street, McFadden, Flower and Sycamore.

Washington Square

Interwar bungalow, Spanish, Tudor and Craftsman houses, some under Mills Act contracts. Pre war construction means raised foundations and the original plumbing and wiring questions an inspector will ask.

Wilshire Square

More than 600 homes, begun in late 1922 and built mostly through the 1930s and 1940s in Tudor, Spanish Colonial, Mediterranean and Craftsman styles. No historic district designation was found, so review applies only to houses individually on the local register.

Park Santiago

Historically called the Northside, including the 1922 Edgewood Park subdivision. Early twentieth century Colonial Revival and Craftsman houses sit beside postwar housing on Spurgeon, Avalon, Buffalo and Catalina, so the condition set changes from one block to the next.

Morrison Park

Orange groves until the first tract went in around 1955. Midcentury single family houses, where the estate questions are the original electrical panel, the supply piping and later additions that may or may not have been permitted.

West Floral Park

Built from the 1920s to the 1950s in Spanish Colonial Revival, Tudor and Cape Cod styles, west of the Floral Park district. Check whether a given house is on the local register or under a Mills Act contract rather than assuming either way.

Downtown

The 1984 National Register district, mostly commercial. An estate holding a downtown building or a mixed use parcel meets historic review on the exterior and commercial questions inside.

Logan

One of the oldest neighbourhoods in the city, with residential and industrial zoning mixed since the 1950s. In May 2024 the city paused new or expanded industrial permits next to Logan and Lacy, which a buyer will ask about.

Lacy

East of downtown, modest vernacular cottages from around 1908, inside the study area of the Transit Zoning Code. Small lots and older construction make the permit history the first document to pull.

North Tustin with a Santa Ana address

Many 92705 addresses are unincorporated Orange County, not the City of Santa Ana. Zoning, permits and the permit history sit with the County, and the North Tustin Advisory Committee reviews some projects.

Santa Ana Heights

Annexed to Newport Beach, east of Irvine Avenue in 2002 and west on 1 January 2008. A house there is a Newport Beach house for permits and city requirements, whatever the old name suggests.

Every one of these is a record that existed before the death and that nobody in the family had a reason to look at until the court asked.

The tenant was treated as a problem to remove

A tenant with 30 days of lawful occupancy has just cause protection in Santa Ana, and the ordinance lists no ground for ending a tenancy because the property is being sold. A no fault termination costs three months of the tenant's rent in relocation assistance.

The practical choices are to sell with the tenant in place, disclosed and documented, or to negotiate a voluntary move out in writing with the estate's attorney. Either way the lease, the rent ledger and any deposit go into the estate file before a buyer's agent asks for them.

The registration was never completed

Every rental unit is registered with the city each year, and a unit claimed as exempt is treated as covered until the city approves the exemption. While registration is incomplete the ordinance bars the landlord from accepting rent or evicting.

An estate that finds a tenant in the house should check the registry status first. Registration costs about 100 dollars a unit. Collecting rent while unregistered, or serving a notice on an unregistered unit, is the mistake that turns into a dispute in the middle of escrow.

The exemption notice nobody can find

A single family house or condominium escapes the just cause rules only if the owner is not a corporation or investment trust and the tenant was given the written notice the ordinance prescribes, stating that the property is not subject to its just cause requirements.

A decedent who rented out a house for years may never have served it, and an estate cannot testify to what the decedent handed a tenant. Without the notice in the file, assume just cause applies and plan the sale around the tenancy.

The Mills Act contract surfaced in the title report

A Mills Act contract is recorded, lasts at least ten years, renews every year and binds the buyer. It carries inspections at least every five years and a cancellation fee of 12.5 percent of fair market value under Government Code 50286.

It is also a selling point, because the property is assessed on an income approach rather than market value and the city describes savings of up to 50 percent. A buyer who reads that in the marketing is pleased. A buyer who meets it in week three of escrow asks for time.

Exterior work was done without review

On the local register and in the SD 19 and SD 40 districts, exterior alterations other than paint, relocation and demolition are reviewed before the work. Replacement windows, a new fence or a converted garage without that review is a record problem, not a style preference.

In August 2026 the city introduced a Chapter 30 amendment adding a historic property transfer disclosure and demolition by neglect rules. Confirm whether it is in force and whether it reaches a fiduciary sale before listing, because the fiduciary exemption from the state Transfer Disclosure Statement in Civil Code 1102.2 does not answer that question.

The garage became a bedroom and nobody pulled a permit

Floral Park and the surrounding interwar neighbourhoods were built with detached rear garages, and many were converted over the decades. Check the permit history through the Building Safety Division's portal, which moved to a new system on 1 July 2026, before the listing describes the space.

A unit built before 1 January 2020 may be legalized under Government Code 66332, added by AB 2533, which limits denial to units that are substandard under Health and Safety Code 17920.3. That is a path to a clean description, not a reason to call an unpermitted room legal in the listing.

The two routes

Serve the Notice, or Publish the Sale and Take It to a Judge

One of these is already decided by the letters. Both have a real cost, and a representative who can describe both to the heirs before the listing goes up spends far less time explaining them afterwards.

Selling under full authority

Probate Code 10402 gives a representative with full authority every power under the Independent Administration of Estates Act, and Probate Code 10503 states that the requirements applicable to court confirmation of sales of real property do not apply. No confirmation hearing. No ninety percent floor measured against the referee's number. No overbid in open court. The publication requirement in Probate Code 10300 also falls away, because 10503 exempts the sale.

What is left is the Notice of Proposed Action, mailed or personally delivered not less than fifteen days before the date it specifies under Probate Code 10586. It goes to each known devisee and each known heir whose interest would be affected, anyone who filed a request for special notice, and the Attorney General where the state's interest is affected, all under 10581. Written consent under 10582 or a written waiver under 10583 removes the requirement for that person.

For a tenant occupied Santa Ana house this route is a real advantage, because negotiating a voluntary move out, a lease buyout or a sale to a buyer who wants the tenancy is far easier without a hearing date sitting behind every conversation. It also lets the estate agree ordinary buyer requests, such as a longer inspection period on a pre war house, without asking the court.

The honest downside is that nothing external validates the price. An objection under Probate Code 10587, delivered or mailed before the specified date or before the action is taken, whichever is later, sends the representative to court anyway, after the marketing time has already been spent. The only defence is the record: broad exposure, every offer kept, and the notice served properly and early.

Selling with court confirmation

Limited authority under Probate Code 10403 leaves four powers with the court, and selling real property is the first of them. The sale is confirmed at a hearing at the Costa Mesa Justice Complex, 3390 Harbor Blvd., Costa Mesa. The probate assistance line is 657-622-8452 and the case access portal is at probatepublic.occourts.org. Orange County examiners review petitions three to four weeks before the hearing, which is genuinely useful because a defect surfaces with time to cure it.

The notice of sale is published under Probate Code 10300 in the manner set by Government Code 6063a: at least ten days, three publications, and at least five days intervening between the first and the last publication dates, completed before the day specified for the sale. Probate Code 10304 requires the notice to state whether the sale is private or by public auction, the time and place, and the street address or legal description. Narrow exceptions exist under 10301, 10302 and 10303.

The report of sale and petition for confirmation are filed under Probate Code 10308, and if the representative has not filed within thirty days the purchaser may. The court confirms only at ninety percent or more of the appraised value under 10309(a), with the appraisal made within one year prior to the hearing. Then the overbid under 10311(a): at least ten percent more on the first ten thousand dollars of the original bid and five percent more on the balance, so a 1,000,000 dollar accepted bid requires 1,050,500 dollars.

The honest downside is that the same mechanism helps the estate and hurts it. An overbid can lift the price in open court, which is exactly what it exists to do. It also thins the buyer pool badly, because a buyer who has paid for an inspection and an appraisal and then has to appear at a hearing where anyone can take the property for a fixed increment often declines to begin. On a tenant occupied Santa Ana house, where the buyer is also inheriting a rent capped tenancy, that combination is felt harder than elsewhere.

Why this office

The Representative Signs the Disclosure. Family Memory Is Not Evidence.

Paula Aragone has worked Orange County transactions for 23 years, across 900+ transactions and $900M+ sold, and she came to real estate after four years of law school. She holds the CPRES and SRES designations. That background is the reason estate and family law attorneys send probate files here rather than to a general listing agent.

CPRES is the Certified Probate Real Estate Specialist designation, and in a court confirmation sale it means the transaction is written the way the statute actually runs. A buyer has to be told before they write that the price must clear the ninety percent floor in Probate Code 10309(a), that a report of sale and petition will be filed under 10308, that a hearing will be set, and that an overbid computed under 10311(a) can take the property from them in the room. Discovering that at the counter offer stage loses the buyer and the hearing date together.

In Santa Ana the second half of the work is retrieval. The lease, the rent ledger, the city registration and any exemption notice the decedent served. The Mills Act contract and the review history for a registered house. The permit jacket, approved plans, inspection log and final from the Building Safety Division at 20 Civic Center Plaza, or through a public records request to the City Clerk where the online file is thin. The special tax status confirmed by APN with the Orange County Treasurer Tax Collector, a few blocks away at 601 North Ross Street.

None of this is legal or tax advice and this office gives neither. What it produces is a file the estate's attorney, the examiner and the heirs can all read: what the property is, what is recorded against it, how it was exposed, and what every offer was. Statutory compensation under Probate Code 10800 and 10810 is computed on gross inventory value without reference to encumbrances and both the representative and the attorney are paid from it, which is a further reason to build that file once, properly.

Frequently Asked

Santa Ana Probate Property, Answered

The questions executors and administrators ask about a Santa Ana estate, answered for California law and for this city specifically.

Does the estate have to open a probate at all?

It depends on the date of death and the size of the estate. For a death on or after 1 April 2025, Probate Code 13100 allows an affidavit for personal property up to 208,850 dollars, Probate Code 13151 allows a petition to determine succession to real property up to 750,000 dollars for the decedent's California primary residence only under AB 2016, and Probate Code 13200 allows an affidavit for real property of small value up to 69,625 dollars. Those figures run from the date of death and hold through 31 March 2028.

How do I know whether I have full or limited authority?

It is stated in the letters the court issued to you. Probate Code 10402 gives full authority, meaning every power under the Independent Administration of Estates Act. Probate Code 10403 gives limited authority, which withholds four powers, all about real property: selling it, exchanging it, granting an option to purchase it, and borrowing money secured by an encumbrance on it. Probate Code 10501(b) keeps those four under court supervision. Read the letters before you interview an agent, not after.

Who has to receive a Notice of Proposed Action, and when?

Under Probate Code 10581 it goes to each known devisee whose interest would be affected, each known heir whose interest would be affected, anyone who has filed a request for special notice, and the Attorney General where the state's interest is affected. Probate Code 10586 requires it to be mailed or personally delivered not less than fifteen days before the date specified in the notice. Probate Code 10582 removes the requirement for anyone who consents in writing and 10583 allows a written waiver.

Does Santa Ana's rent control apply to an inherited house?

It can. The city's Rent Stabilization and Just Cause Eviction ordinances took effect on 19 November 2021 and were confirmed by voters as Measure CC in November 2024. A single family house or condominium is generally exempt from the rent cap under the Costa Hawkins Rental Housing Act, but it escapes the just cause rules only if the owner is not a corporation or investment trust and the tenant received the written exemption notice the ordinance prescribes. Without proof that notice was served, plan as though just cause applies.

Can the estate ask a tenant to leave so the house can be sold?

Not simply because it is being sold. The ordinance lists no just cause ground for a sale, and protection begins once a tenant has lawfully occupied the unit for 30 days. No fault grounds such as an owner or family move in or withdrawal from the rental market require relocation assistance of three months' rent. Many estates sell with the tenant in place or negotiate a written voluntary agreement. Talk to the estate's attorney before any notice is served.

Does the rental have to be registered with the city?

Yes. Every landlord registers every rental unit each year with the Rent Stabilization Division, and an exempt unit is treated as covered until the city approves the exemption. The 2026 fee was 100 dollars per unit through 31 July and 104 dollars after. While registration is incomplete the landlord may not accept rent or evict, and after a sale the seller notifies the city within 30 days of close of escrow and the buyer registers within 60.

What happens to a Mills Act contract when the house is sold?

It goes with the house. The contract is recorded, runs at least ten years, renews each year and binds every successor in interest under Government Code 50281 and 50282, with inspections at least every five years. Cancelling costs 12.5 percent of current fair market value under Government Code 50286. The Orange County Assessor's Special Properties Division, at 714-834-2727, can explain how the income approach valuation affects the tax bill.

Is Floral Park or French Park historic, and does that change the sale?

Both are National Register districts, French Park since 1999 and Floral Park since 2023, and Downtown since 1984. French Park is also protected by its own zoning, SD 19, and Heninger Park by SD 40. For a house on the local register, exterior alterations other than paint, relocation and demolition are reviewed first. The sale itself is not reviewed, but a buyer who plans changes needs to know, and an unreviewed alteration already made is a disclosure item.

Is a Santa Ana 92705 address always in the City of Santa Ana?

No. Much of North Tustin uses Santa Ana 92705 mailing addresses and is unincorporated Orange County, so permits and permit history sit with the County rather than the city. Santa Ana Heights was annexed to Newport Beach, east of Irvine Avenue in 2002 and west in 2008. Confirm the jurisdiction by parcel before requesting records, or the estate spends weeks asking the wrong agency.

Where is the probate hearing if the property is in Santa Ana?

At the Costa Mesa Justice Complex, 3390 Harbor Blvd., Costa Mesa, where Orange County Superior Court hears probate. The Central Justice Center in Santa Ana handles criminal, civil, traffic and small claims matters, not probate. The probate assistance line is 657-622-8452 and case information is at probatepublic.occourts.org.

Does Santa Ana require a point of sale inspection or report?

No presale report or point of sale inspection requirement was found for Santa Ana, and it does not appear on a title industry list of cities that require one. Confirm the current position with the Building Safety Division at 20 Civic Center Plaza before relying on it, because a compilation is not the code and requirements change.

Is a Santa Ana house in a fire hazard zone?

The State Fire Marshal's local responsibility area map for Orange County, released on 24 March 2025, shows no fire hazard severity zone inside Santa Ana, so the requirements that apply to high and very high zones in the foothills generally do not arise here. Flood is a separate question: check the FEMA map for the parcel, particularly near the Santa Ana River and Santiago Creek.

Which school district serves a Santa Ana address?

Santa Ana Unified serves most of the city, and the city notes that six neighbouring districts serve portions of it: Garden Grove, Tustin, Orange, Irvine, Newport Mesa and Huntington Beach Unified. Confirm by address with the district before it goes into marketing.

Can the family hold an estate sale of the contents at the house?

Yes, within the city's rules. Santa Ana treats an estate sale as one held when the resident has died or moved to a care facility and the home will be vacated or sold. Items must be kept out of public view, one sign is allowed in the front yard, and a business license is needed if the sale is run as a business but not when a relative is selling for the family.

How is the minimum overbid worked out?

Probate Code 10311(a) requires a higher offer to be at least ten percent more on the first ten thousand dollars of the original bid and five percent more on the amount of the original bid in excess of ten thousand dollars. So on a 1,000,000 dollar accepted bid the minimum first overbid is 1,000,000 plus 1,000 plus 49,500, which is 1,050,500 dollars. The increment is measured against the accepted bid. The ninety percent test is measured against the referee's appraisal. They are two different baselines.

Does the sale have to be advertised in a newspaper?

Under court confirmation, usually yes. Probate Code 10300(a) requires publication in the manner set by Government Code 6063a, which is at least ten days with three publications and at least five days intervening between the first and last publication dates, and 10300(b) requires publication to be complete before the day specified for the sale. Probate Code 10304 sets what the notice must say. The exceptions are 10301, 10302 and 10303, and under full authority Probate Code 10503 exempts the sale entirely.

What does the estate pay the representative and the attorney?

Probate Code 10800 sets the representative's compensation and 10810 sets the attorney's on identical tiers, and both are payable: 4 percent of the first 100,000 dollars, 3 percent of the next 100,000 dollars, 2 percent of the next 800,000 dollars, 1 percent of the next 9,000,000 dollars and 0.5 percent of the next 15,000,000 dollars. The base is gross inventory value plus gains and receipts, without reference to encumbrances, so a house appraised at 2,000,000 dollars carrying a 1,500,000 dollar mortgage counts at 2,000,000 dollars. That estate produces 33,000 dollars each and 66,000 dollars combined, plus any extraordinary fees.

How long will the estate be open?

No official source publishes a typical duration and it should never be stated as fact. The statutory anchors are these: the inventory and appraisal within four months after letters issue under Probate Code 8800, creditor claims due under Probate Code 9100 the later of four months after letters or sixty days after notice to that creditor, and a petition for final distribution or a status report not later than one year after letters under Probate Code 12200, or eighteen months where a federal estate tax return is required.
