What the Estate Can Convey, and What Dies With the Transfer


A probate referee values the property described to it. In this city several of the things a family believes it inherited are not property at all, and one of them ends the moment title moves.

Start with the rental permit, because it is the item most often misunderstood. Municipal Code Chapter 5.38 has been in force since 2 April 2013 and was last amended by Ordinance 25-09 on 17 June 2025. Outside the coastal zone the cap is 115 permits, of which no more than 60 may be non primary, with one permit per property owner, a two consecutive night minimum and a 30 consecutive day maximum. Coastal zone properties are governed by CDP22-0010. The ordinance states that the permit shall expire upon the date the title to such parcel transfers, with narrow exceptions for family transfers and transfers producing no new property tax assessment.

That is the opposite of the rule next door in Newport Beach, and it is the most valuable thing to tell a Dana Point estate early. The program itself is settled for now: Measure T, which would have repealed and replaced the ordinance and cut permits by roughly half, failed in November 2024 by 63.73 percent against to 36.27 percent in favour. On 6 May 2025 the council voted 4 to 1 to let staff approve primary, homestay and multifamily homestay rentals outside the coastal zone without council review, approved 15 waitlisted permits outside the coastal zone, and contracted a technology vendor to detect unpermitted rentals, with annual reporting replacing individual permit review from February 2026.

Then the memberships and the associations. Monarch Bay is roughly 214 homes behind a single 24 hour guard gate, and its defining amenity is a private members only beach club operated in partnership with the resort, which is a membership tied to the community rather than a right recorded against the deed. Niguel Shores is a master association containing the Sea Terrace I and Sea Terrace II townhome sub associations, each with its own board of directors. Ritz Cove runs a double guard gate with lighter common amenities. Beach Road in Capistrano Beach is a private guard gated road, which raises maintenance and access questions of its own.

All of that feeds one document. The referee is appointed from the State Controller's list under Probate Code 8920, paid one tenth of one percent of the value appraised plus expenses under 8961, with a floor of 75 dollars and a ceiling of 10,000 dollars per estate under 8963, and Orange County states the appraisal should return within 60 days. The referee does not investigate. It values what the representative describes, so the description has to distinguish the parcel from the permissions attached to it.

The consequence sits in Probate Code 10309(a). The court may confirm a private sale only where the property was appraised within one year prior to the confirmation hearing, the valuation date is within that year, and the sum offered is at least 90 percent of the appraised value. An appraisal that quietly assumed transferable rental income sets a floor no confirmable offer can reach, because the buyers who would pay for that income cannot inherit the permit. The estate then carries the property while a new appraisal or a new marketing period is arranged.

Keep the two baselines separate. The 90 percent floor is measured against the referee's appraisal. The overbid increment under Probate Code 10311(a) is measured against the accepted bid. They are different figures, and a representative who merges them will tell the family the wrong thing about what a bidder in the courtroom would have to beat.

The process

How a Probate Property Sale Works in Dana Point


The personal representative's sequence, written for a city where several of the things a family assumes it inherited do not survive the transfer. Establish what conveys before anybody sets a number on it.

Read the Letters and confirm the four withheld powers

Full authority under Probate Code 10402 carries every power under the Independent Administration of Estates Act. Limited authority under 10403 withholds four: sell real property, exchange real property, grant an option to purchase, and borrow money secured by an encumbrance on real property. Probate Code 10501(b) requires court supervision for exactly those. That line decides whether there is a hearing at all.

List what the estate actually owns before the referee is appointed

Separate the parcel from the permissions. The short term rental permit expires on transfer of title. A beach club membership is tied to the community rather than to the deed. Association amenities belong to the association. Write down what is real property, what is a membership and what is a licence, then hand that to the referee under Probate Code 8920.

Secure the property, correct the insurance and cancel the bookings

Tell the insurer the house is unoccupied, because an owner occupied policy may not respond to a vacant property. If the decedent was renting the house short term, stop taking reservations and deal with the ones already on the books. An estate that keeps operating a rental it cannot lawfully transfer is creating a problem for its own escrow.

Pick the route, knowing what each does to a buyer's underwriting

With full authority, Probate Code 10503 removes the confirmation requirements and a Notice of Proposed Action replaces the hearing. With limited authority the report of sale, petition, hearing and overbid all apply. In a market where a share of buyers underwrite rental use, the overbid risk and the permit question compound rather than cancel.

Market it on what conveys, not on last year's income

Chapter 5.38 states that the permit shall expire upon the date title to the parcel transfers, with narrow exceptions for family transfers and transfers producing no new property tax assessment. Marketing a rental history as though it were transferable income invites a cancellation, a renegotiation or worse. Sell the property, disclose the permit rule, and let a buyer make their own application.

Give the notice, or file the report of sale and petition

Under full authority, Probate Code 10586 requires the Notice of Proposed Action mailed or personally delivered not less than 15 days before the date specified, to the recipients listed in 10581. Under the court track, Probate Code 10308 governs the report of sale and petition for confirmation, and if it is not filed within 30 days the purchaser may file it.

Take the hearing, and price the overbid into the offer you accept

Orange County examiners review petitions three to four weeks before the hearing, which is the last moment to cure a defect without moving the date. At the hearing the property is open under Probate Code 10311(a). The court accepts the highest qualifying offer, may decline to confirm and order a new sale, and may reject a higher bid on less favourable credit terms.

Open escrow with both association packages in hand

Where a master association and a sub association both apply, that is two sets of governing documents, two budgets and two reserve studies, from boards that do not share an office. Order them at listing. A confirmation escrow does not have room to wait for a second document package that nobody knew existed until the buyer's lender asked.

File for final distribution and close the estate

Probate Code 12200 requires a petition for final distribution or a status report not later than one year after letters, or eighteen months where a federal estate tax return is required. Statutory compensation under 10800 and 10810 is computed for both the representative and the attorney on the gross inventory value plus gains and receipts, without reference to encumbrances.

Smaller attached and detached communities on the resort side, built in the later 1980s and through the 1990s. Attached construction means shared components, and shared components mean association records rather than assumptions.

Niguel Shores

A gated master association holding the Sea Terrace I and Sea Terrace II townhome sub associations, each of which has a board of its own. Two sets of governing documents, two budgets and two reserve studies on any Sea Terrace sale.

Sea Terrace and the Salt Creek corridor

The corridor running from Niguel Shores down to Salt Creek Beach Park. This is where the master and sub association structure most often catches an estate that ordered only one document package.

The Strand at Headlands

Guard gated estates on the Dana Point Headlands, the newest large luxury tract in the city, with its own conservation and open space obligations attached to the community.

Lantern District

The walkable town core on the Lantern streets above the harbour, mixed single family, duplex and small multifamily, and the most rebuilt and infilled part of the city. Permit history questions are routine here.

Dana Point Harbor and the harbour adjacent blocks

The harbour is county owned and operated and is in the middle of a multi year revitalisation, so a listing here carries a construction disclosure and an amenity story at the same time.

Del Obispo and Del Prado corridor

The inland spine of commercial and residential frontage between the Lantern District and San Juan Capistrano. Mixed product, mixed eras, and school assignments that have to be verified by address.

Dana Hills

Hillside tracts inland of Pacific Coast Highway around Dana Hills High School, built mostly through the 1970s and 1980s. Squarely inside the window where polybutylene supply piping should be assumed until an inspector rules it out.

Capistrano Beach

The southern district running toward San Clemente, older and more mixed than Monarch Beach, taking in the bluff top Palisades area. Coastal erosion here is a present condition, and it belongs in the estate's disclosure file.

Beach Road

A guard gated private road in Capistrano Beach whose homes sit directly on the sand, a product type with few parallels in Orange County. Private road maintenance and access arrangements are part of what a buyer is acquiring.

What actually delays it

Six Things That Cost a Dana Point Estate Its Hearing or Its Buyer

Each of these is a question about what conveys. Answered at the start they cost an afternoon. Answered in escrow they cost the date.

The rental income was marketed and the permit cannot follow it

Municipal Code Chapter 5.38 states that the short term rental permit shall expire upon the date the title to the parcel transfers, with narrow exceptions for family transfers and transfers producing no new property tax assessment. An estate that presents a rental history as transferable income is describing something it cannot deliver. The correction, once a buyer's own research finds it, is a renegotiation at best. Say it plainly in the marketing, and let the buyer make their own application on their own risk.

One association package arrived and there were two

The master association at Niguel Shores contains the Sea Terrace I and Sea Terrace II townhome sub associations, and each of those runs its own board of directors. That means two sets of governing documents, two budgets and two reserve studies, from two organisations that do not share an office or a timetable.

The buyer's lender will ask for both. Ordering them at listing costs nothing. Ordering the second one after an offer, inside a probate escrow with a confirmation date already set, is the kind of delay that moves a hearing.

The beach club membership was treated as part of the property

The Monarch Bay beach club is a private members only facility operated in partnership with the resort and tied to the community. It is a membership, with its own rules about status and transfer, not a right recorded against the parcel.

For the referee that distinction matters, because it changes what is being appraised. For the buyer it matters more, because a membership assumption that turns out to be wrong is exactly the kind of discovery that ends an escrow the estate cannot easily replace.

The bluff at Capistrano Beach is moving now, not eventually

The Capistrano Beach shoreline has lost its beach in places and has required emergency sand replenishment and nature based intervention at Capistrano Beach Park, with a seawall proposal contested before the Coastal Commission. In February 2024 a storm driven bluff failure left an ocean view home at the cliff edge, with the city's building inspector assessing the structures and a geotechnical engineer evaluating the slide.

Two legal facts frame the disclosure. After the Casa Mira decision, with review denied by the California Supreme Court on 12 March 2025, a structure built after 1976 has no Coastal Act entitlement to shoreline armouring. And under the Martin standard a bluff top setback is calculated to hold a 1.5 factor of safety over a 75 year project life.

There is no city report, so the permit history has to be built

Dana Point has no equivalent of the Newport Beach Residential Building Records report or the Laguna Beach Real Property Report, and it does not appear in the industry compilation of Southern California cities requiring a report or inspection at sale. Confirm that with the Permit Center rather than assuming it, because absence from a vendor list is weak evidence.

For a questioned addition the route is a City Clerk public records request combined with a Building and Safety records search at the permit counter, which is open for walk ins Monday to Friday, 8:00 am to 3:30 pm. Harbour related records go to OC Parks and the Harbor Department, because the harbour is county owned.

Nobody assumed polybutylene and the inspection did

From the sixth cycle Housing Element, 31 percent of the city's housing was built between 1970 and 1979 and 30 percent between 1980 and 1989, so the 1970 to 1989 window alone is 61 percent of the stock. Polybutylene supply piping ran from about 1978 into the mid 1990s, which covers most of the 1980s cohort.

Add Federal Pacific and Zinsco panels, aluminium branch wiring at the early end, cast iron drains and galvanised supply in the 1970s cohort, asbestos containing materials before 1980, and single pane aluminium windows throughout. An estate that assumes a clean report and gets a repair negotiation instead has lost the time between the offer and the hearing.

The decision

Two Routes Out of a Dana Point Probate


The Letters normally decide which one applies. The reason to understand both is that they attract different buyers, and in a city where rental use is part of the underwriting, that difference is larger than usual.

Selling under full authority

Under Probate Code 10402 a representative with full authority holds every power the Independent Administration of Estates Act grants, and Probate Code 10503 provides that the requirements applicable to court confirmation of sales of real property do not apply to the sale. No confirmation hearing, no 90 percent appraisal floor, no bid from the courtroom floor. The estate sells the way an ordinary owner sells and the escrow closes without a court date sitting in the middle of it.

The Notice of Proposed Action takes the hearing's place. Probate Code 10580 to 10592 govern it, and 10586 requires it mailed or personally delivered not less than 15 days before the date specified in the notice. Under 10581 the recipients are each known devisee whose interest would be affected, each known heir whose interest would be affected, anyone who has filed a request for special notice, and the Attorney General where the state's interest is affected.

Those fifteen days can be shortened. Probate Code 10582 excuses notice to a person who consents in writing and 10583 permits a written waiver, so an agreed family can take the delay and the objection risk off the table at once. The honest downside is that the same statute cuts the other way: under 10587 any recipient may object by delivering or mailing a written objection before the date specified or before the action is taken, whichever is later, and the representative is back before the court with a buyer already committed.

Full authority does not change what conveys. The rental permit still expires on the date title transfers, the beach club membership is still a membership, and the master and sub association documents still take as long as two boards take. Full authority buys a shorter back end, which means the questions about what the estate is actually selling have to be answered sooner, not later.

Selling with court confirmation

Where the Letters grant limited authority under Probate Code 10403, four powers are withheld and every one is a real property power, with Probate Code 10501(b) requiring court supervision for exactly those. The sale opens with the referee's appraisal under Probate Code 8920, at one tenth of one percent of the value appraised plus expenses under 8961, with a floor of 75 dollars and a ceiling of 10,000 dollars per estate under 8963, and Orange County states it should return within 60 days.

After acceptance the representative files a report of sale and a petition for confirmation under Probate Code 10308, and if it is not filed within 30 days the purchaser may file it. Title does not pass until the court confirms. Probate Code 10309(a) permits confirmation of a private sale only where the property was appraised within one year prior to the confirmation hearing, the valuation date is within that year, and the sum offered is at least 90 percent of the appraised value.

The hearing is where the price can move. Probate Code 10311(a) requires a higher offer to be at least 10 percent more on the first ten thousand dollars of the original bid and 5 percent more on the amount of the original bid in excess of ten thousand dollars. On a 1,000,000 dollar accepted bid the minimum first overbid is 1,000,000 plus 1,000 plus 49,500, which is 1,050,500 dollars. The court accepts the highest qualifying offer, may decline to confirm and order a new sale, and may reject a higher bid on less favourable credit terms, with commissions excluded from the computation.

The overbid is a genuine advantage for the estate and a genuine deterrent for the buyer, and here the deterrent lands on a market already carrying a permit problem. A buyer who has ordered two association document packages, obtained a geotechnical opinion on a bluff parcel and accepted that the rental permit will not follow the sale is being asked to attend a hearing where a stranger can take the property with a 5 percent increment. Some will not bid at all, and those who do bid lower to leave room. Orange County examiners review the petition three to four weeks before the date at the Costa Mesa Justice Complex, so the file has to be finished long before anyone stands up.

A personal representative is protected by the record, not by the price. Beneficiaries seldom object to a number that was openly marketed and documented. They object to a sale that looks arranged, an appraisal built on a description nobody kept, or a delay nobody can explain. A referee given a complete and accurate description, a written log of every offer, and a file ready for the examiner are what answer that.

In Dana Point the added work is separating property from permission: a rental permit that expires on transfer of title, a beach club membership that belongs to a community, two association packages where a family expected one, and a bluff whose condition is a present fact rather than a projection. The honest part is that doing all of it does not guarantee a hearing date holds. Examiners raise items, boards take their time, and buyers withdraw. It does guarantee that the reason is not the estate's own description of what it was selling.

Dana Point Probate Sales, Answered


The questions personal representatives ask about a court supervised sale here, answered for California law and for what actually transfers in this city.

Is a full probate required, or does a smaller procedure cover it?

The date of death decides it, not the date you file. For deaths on or after 1 April 2025 the affidavit for personal property under Probate Code 13100 and 13101 reaches 208,850 dollars, the petition to determine succession to real property under 13151 to 13154 reaches 750,000 dollars but only for the decedent's California primary residence under AB 2016, and the affidavit for real property of small value under 13200 reaches 69,625 dollars. Those figures hold through 31 March 2028.

Does the short term rental permit survive a probate sale?

No. Municipal Code Chapter 5.38 states that the permit shall expire upon the date the title to such parcel transfers, with narrow exceptions for family transfers and transfers producing no new property tax assessment. That is the opposite of the rule in Newport Beach and it is the most common misunderstanding in this market. Confirm the current position with the city before relying on any exception, and never market the permit itself as part of the sale.

The estate has been renting the house. Should the referee value that income?

The referee values the real property, and the permit that made the income possible does not transfer. Describe the situation accurately: the physical property, the permit status, and the fact that the permit ends on transfer. An appraisal that quietly assumes transferable rental income sets a 90 percent floor under Probate Code 10309(a) that no confirmable offer can reach, because the buyers who would pay for that income cannot inherit the permission.

Can the estate distribute the house to a child and keep the permit?

Chapter 5.38 provides narrow exceptions for family transfers and for transfers producing no new property tax assessment, so the question is real rather than theoretical. It is also a city determination, not a real estate opinion, and the property tax side depends on a separate Proposition 19 analysis with the Orange County Assessor. Get both answers in writing before the estate makes a distribution decision on the strength of the permit.

Niguel Shores has a master and a sub association. What does the estate have to produce?

Both packages. Niguel Shores is a gated master association containing the Sea Terrace I and Sea Terrace II townhome sub associations, and each sub association has its own board of directors. Is the Monarch Bay beach club membership part of what the estate conveys?

Treat it as a membership rather than a deed right. The club is a private members only facility operated in partnership with the resort and tied to the community, and membership status and transfer are governed by its own rules. That distinction changes what the referee is appraising and what the buyer believes they are acquiring. Confirm the current position with the association and the club, in writing, before it appears in any marketing material.

The property is on the bluff at Capistrano Beach. What does the estate disclose?

The present condition, not a forecast. The Capistrano Beach shoreline has lost its beach in places and has required emergency sand replenishment and nature based intervention at Capistrano Beach Park, with a seawall proposal contested before the Coastal Commission, and in February 2024 a storm driven bluff failure left an ocean view home at the cliff edge. Expect a buyer to ask for a geotechnical report, the erosion rate used and the setback analysis, and have that material assembled before an offer.

Can a bluff property here be armoured against erosion?

Do not assume so. Coastal Act Section 30235 requires shoreline protective devices to be permitted where needed to protect existing structures, and in the Casa Mira decision the court held that existing means existing before the Coastal Act took effect on 1 January 1977. The California Supreme Court denied review on 12 March 2025, so the restrictive reading is settled law. A structure built after 1976 has no entitlement to armouring. That is a disclosure and a valuation fact, not a theory.

Is there a city report to order before a Dana Point probate sale?

There appears not to be. Dana Point has no equivalent of the Newport Beach Residential Building Records report or the Laguna Beach Real Property Report, and it does not appear in the industry compilation of Southern California cities that require a report or inspection at sale. That is weak evidence, so confirm with the Permit Center. The statewide point of sale obligations still apply in full, including the Natural Hazard Disclosure Statement, smoke alarms, carbon monoxide devices and water conserving fixtures.

How do we reconstruct the permit history for an addition nobody can explain?

Through the city rather than through memory. The route is a City Clerk public records request using the city's form, combined with a Building and Safety records search at the permit counter, which takes walk ins Monday to Friday from 8:00 am to 3:30 pm at the Administration Building on Golden Lantern. Harbour related records are not the city's at all: the harbour is county owned, so those requests go to OC Parks and the Harbor Department.

The harbour is under construction through our listing period. What do we say?

Say both halves of it. The harbour is a county project in a multi year revitalisation, and the Coastal Commission issued the marina permit, so the city is not the approving body a buyer should be calling. The Wharf retailers close through the autumn of 2026, with Wind and Sea on 15 September 2026 and the remaining shops and restaurants on 31 October 2026, ahead of Phase 4 construction of the Wharf buildings. Dana Wharf Sportfishing, Whale Watching and Catalina Express relocate to temporary trailers and continue operating.

How do we tell whether we can sell without a hearing?

Probate Code 10402 grants a representative with full authority all powers under the Independent Administration of Estates Act. Probate Code 10403 withholds four: sell real property, exchange real property, grant an option to purchase real property, and borrow money secured by an encumbrance on real property. Probate Code 10501(b) requires court supervision for exactly those four. Full authority triggers Probate Code 10503, which removes the court confirmation requirements from the sale, subject only to the Notice of Proposed Action.

Who receives the Notice of Proposed Action, and can a beneficiary object?

Under Probate Code 10581 it goes to each known devisee whose interest would be affected, each known heir whose interest would be affected, anyone who has filed a request for special notice, and the Attorney General where the state's interest is affected, and 10586 requires it not less than 15 days before the date specified. Section 10582 excuses anyone who consents in writing and 10583 allows a written waiver. Under 10587 a recipient may object in writing before the specified date or before the action is taken, whichever is later, and the representative then needs a court order.

What is the 90 percent rule and how does the overbid work?

No, and conflating them is the most common error on the subject. The 90 percent floor in Probate Code 10309(a) is measured against the probate referee's appraised value. The overbid increment in Probate Code 10311(a) is measured against the accepted bid, whatever it turned out to be. Two baselines doing two different jobs. A family told otherwise will expect a courtroom bidder to have to clear a number nobody in the room is looking at.
