Probate Real Estate Agent in Orange, CA

Paula Aragone represents executors and administrators selling property in the City of Orange under court supervision, from pre war houses in the Old Towne historic district to hillside homes in the east, where the fire map decides what the estate has to disclose.

The short answer

Probate in Orange runs on the authority in the letters. Full authority under Probate Code 10402 means a Notice of Proposed Action and no hearing. Limited authority under 10403 means the court confirms the sale. What Orange adds is two maps: the historic district boundary, which governs every exterior change to a pre war or Eichler house, and the fire hazard map, which decides what a personal representative must disclose on a hillside parcel even when the sale is exempt from the usual forms.

Two Maps Decide an Orange Estate: the Historic District and the Fire Zone

The City of Orange holds one of the largest historic districts in California and a hillside edge that was evacuated when the Canyon Fire 2 burned in October 2017. A representative selling here has to know which side of each boundary the parcel sits on and, in the east, whether it is in the city at all.

Old Towne Orange was listed on the National Register of Historic Places on 11 July 1997, roughly one square mile around the Plaza that the Old Towne Preservation Association counts at more than 1,400 buildings from before 1941. It is also a local historic district under Orange Municipal Code Chapter 17.17, and exterior work there is measured against the Historic Preservation Design Standards for Old Towne, first adopted by Resolution 8488 in July 1995. The Design Review Committee makes final determinations on applications that meet the historic threshold, and the Planning Commission decides replacement structures proposed with a demolition.

The city added a second kind of district in December 2018. Ordinance No. 14-18 created a historic district overlay for the Fairhaven, Fairhills and Fairmeadow tracts, 340 Eichler houses built in the early 1960s that the ordinance describes as the largest concentration of Eichlers in Southern California. Post and beam frames, flat roofs, atriums, walls of glass and radiant heat piped through the slab: a condition set of its own, under design standards of its own.

Many houses in Old Towne and some in the Eichler tracts carry Mills Act contracts, recorded against title and binding the buyer under Government Code 50281. The city is not accepting new Mills Act applications while the program is under review, and it has written to holders who have not paid the annual fee or reported completed work. A contract already on a house therefore matters more than it used to, and a buyer cannot assume one can be started after closing.

The Canyon Fire 2 started on 9 October 2017 and burned 9,217 acres before it was contained on 17 October, destroying 25 structures and damaging 55, most of them in Anaheim Hills. Evacuation orders reached into the City of Orange, including every road and house on Windes Drive north of Santiago Canyon Road. East of there the canyons meet wildland, and the State Fire Marshal's maps now decide what an estate selling a hillside house has to say about it.

The city adopted the State Fire Marshal's local responsibility area map by Ordinance No. 07-25 in May 2025, replacing its earlier very high zone map. The County adopted its own map for unincorporated areas, Orange Park Acres included, by Ordinance No. 25-015 on 26 August 2025. The City of Orange runs its own fire department rather than the Orange County Fire Authority, and its Fire Prevention Bureau inspects weed abatement in March and September against a 100 foot clearance standard.

The disclosure law is where estates go wrong in both directions. Civil Code 1102.2 exempts probate court ordered sales and transfers by a fiduciary administering an estate or trust from the disclosure article that also carries the defensible space documentation of Civil Code 1102.19 and the fire hardening notice of 1102.6f. The exemption does not cover an individual trustee of a revocable trust who owned or lived in the home within the prior year. And an exempt sale still owes the very high fire hazard zone disclosure under Government Code 51183.5, through Civil Code 1103.1(b). Read the parcel on the current map before deciding which forms the estate signs.

The sequence

How a Probate Property Sale Works in Orange

The Probate Code sets the order and the deadlines. In Orange the retrieval work runs alongside them, because a design review history, a Mills Act file or a fire zone determination takes longer to assemble than the fifteen day notice takes to serve.

01

Get appointed, and find out which powers came with it

The letters state whether the representative holds full or limited authority under the Independent Administration of Estates Act. Full authority under Probate Code 10402 carries every power. Limited authority under 10403 withholds four, all of them about real property: sale, exchange, granting an option to purchase, and borrowing against it. Probate Code 10501(b) returns those four to court supervision.

02

Inventory the estate and hand the referee the district file

Probate Code 8800 puts the inventory and appraisal four months out from the issue of letters. A referee appointed under Probate Code 8920 values the real property for a commission of one tenth of one percent plus expenses under 8961, floored at 75 dollars and capped at 10,000 dollars per estate under 8963. In Orange he should know before he values the house whether it sits in Old Towne or an Eichler district and whether a Mills Act contract is recorded against it.

03

Secure the property and tell the insurer it is empty

Locks, mail redirection, utilities kept on and a call to the carrier, because a homeowners policy assumes an occupied house. On a hillside parcel in the east, keep the brush cleared as well: the Orange City Fire Department inspects weed abatement in March and September, and dry growth around an empty house is a citation and an insurance problem at once.

04

Decide between notice and a courtroom

Full authority means Probate Code 10503 lifts the confirmation requirements from the sale entirely, leaving only the Notice of Proposed Action. Limited authority means a published notice, a report of sale, a hearing and an open overbid. The decision is not the family's preference. It is whatever the letters already say, and it should shape the listing from day one.

05

Assemble the disclosures before the first showing

In Old Towne that means the permit jacket and the design review history for every exterior change, and any Mills Act contract. In the Eichler tracts it means the radiant slab, the roof and any alteration reviewed under the 2018 standards. In the eastern hills it means the fire hazard zone for the parcel and whether the parcel is city or county at all.

06

Fifteen days of notice, or a published notice and a report of sale

Under Probate Code 10586 the Notice of Proposed Action is mailed or personally delivered not less than fifteen days before the date it specifies, to the recipients in 10581. Under limited authority the notice of sale is published per Probate Code 10300 and Government Code 6063a, and the report of sale and petition follow under 10308.

07

The hearing, and anyone who wants to bid

Orange County examiners review petitions three to four weeks ahead, so a defective petition is usually caught in time. The court may confirm only at ninety percent or more of the appraised value under Probate Code 10309(a). A qualifying overbid under 10311(a) can then take the property, and the court accepts the highest qualifying offer under 10311(b).

08

Escrow, with the contract and the map read rather than assumed

A Mills Act contract is recorded and binds the buyer, so it belongs in the disclosure package, not in the preliminary title report. On a hillside parcel the very high zone disclosure goes in a separate writing even when the sale is exempt from the usual forms. Orange County documentary transfer tax is 1.10 dollars per 1,000 dollars of net consideration.

09

Account to the court and distribute

Probate Code 12200 requires a petition for final distribution or a status report not later than one year after letters, or eighteen months where a federal estate tax return is required. Compensation under Probate Code 10800 for the representative and 10810 for the attorney runs on identical tiers and both are payable from the estate.

Where we work

Orange Neighbourhoods, and What Each Puts Into the Inventory

Orange runs from houses built around the Plaza in the 1880s to hillside planned communities finished this century, with county islands in between. The neighbourhood decides which file the estate has to pull first.

Old Towne

National Register district since 1997, about one square mile around the Plaza, with a local district and design standards since 1995. Pre 1941 construction: raised foundations, original wood windows, detached garages. Vinyl windows and fences, and solar panels or synthetic turf visible from the street, are the violations the preservation association sees most.

The Plaza

The commercial core, listed on the National Register separately in 1982. An estate holding a building or a mixed use parcel on or near the Plaza meets historic review on every exterior change.

Cypress Street

One of the oldest residential areas in the city, centred on the 400 block of North Cypress Street beside the Cypress Street Schoolhouse, listed on the National Register in 2015. Check whether a parcel falls inside the Old Towne boundary before describing it either way.

Fairhaven, Fairhills and Fairmeadow

340 Eichler houses in three tracts, built in the early 1960s and made a historic district overlay by Ordinance No. 14-18 in 2018. Fairmeadow straddles Cambridge Street north of Taft Avenue, Fairhaven sits at the base of Lemon Heights and Fairhills lies south of Santiago Canyon Road.

Mabury Ranch

Around 400 houses built in phases from 1978 to 1980, with a gated section added in the early 1990s, under a homeowners association and backing onto Santiago Creek. Lots run from about 8,000 to more than 20,000 square feet.

Serrano Heights

Hillside planned area in north east Orange, approved in 1986 for 730 acres and about 2,400 units with 469 acres of open space. It carries Community Facilities District No. 91-2, whose special tax ends after the thirtieth year a parcel is taxed as developed.

Santiago Hills

Covered by the Santiago Hills Landscape Maintenance Assessment District, formed in 1987 and levied every year, with rates raised after a 2015 ballot. The assessment is a line on the tax bill and belongs in the disclosure package.

Santiago Hills II and East Orange

Irvine Company planned communities approved in 2005, Santiago Hills II on 496 acres west of the 241 and 261 toll roads and East Orange on 6,334 acres beyond it. The approval required fuel modification next to wildland, so the fire map and the fuel modification zone both belong in the file.

Del Rio

Built under Community Facilities District No. 06-1, whose special tax ordinance was adopted in January 2007, in a plan that allowed up to 1,238 units across Anaheim and Orange. Confirm by parcel which city and which special tax apply.

Orange Park Acres

Founded in 1928 on 640 acres, now a mix of county and city land with generally 20,000 square foot minimum lots and equestrian facilities. The unincorporated part has County permits, the County fire map, the Orange County Fire Authority and, in places, septic rather than sewer.

El Modena and North El Modena

Citrus country from the 1880s, suburban from the late 1950s and only partly annexed, so unincorporated enclaves remain. In August 2026 the council voted to study annexing them with Olive Heights and Santiago Creek, a process that runs through LAFCO and can take six to eighteen months or longer.

Olive and Olive Heights

Founded in 1887, with an unincorporated pocket of about 33 acres surrounded by Orange and houses older than the 1930s. County records, not city records, for anything inside the island.

Villa Park

A separate city since 1962, ZIP 92861, bordered by Orange, with lots averaging about half an acre and schools from Orange Unified. Confirm which city issued the permits before requesting records.

Every one of these is a record that existed before the death and that nobody in the family had a reason to look at until the court asked.

Exterior work was done without review

In Old Towne and the Eichler districts, exterior changes are reviewed against district design standards before the work. The violations the Old Towne Preservation Association sees most are vinyl windows and fences, solar panels or synthetic turf visible from the street, and original walkways, rafter tails, trim, doors or chimneys replaced.

Demolishing a historic garage without review or permits is on the same list. An estate cannot undo what the decedent did, but it can pull the permit and review history, describe the house accurately and price it for a buyer who may be asked to restore it.

The Mills Act contract surfaced in escrow

A Mills Act contract is recorded, runs at least ten years, renews every year and binds the buyer under Government Code 50281 and 50282, with a 12.5 percent cancellation fee under 50286. Because Orange is not accepting new applications while the program is under review, a buyer cannot count on starting one after closing.

The city has also written to contract holders who have not paid the annual fee or reported completed work, roughly forty properties by the preservation association's count. If the decedent's contract is one of them, find out where it stands before the listing describes the tax savings.

A county island was treated as the city

LAFCO lists six unincorporated islands inside Orange's sphere: El Modena, Lincoln Glassell, North El Modena, Olive Heights, Orange Park Acres and Santiago Creek. They carry Orange mailing addresses and are governed by the County, with the Sheriff and the Orange County Fire Authority rather than the city's police and fire.

Permits and permit history sit with OC Public Works, the fire zone comes from the County's map, and parts of Orange Park Acres are on septic. A representative who requested the permit file from the city has lost weeks, and the annexation study under way means the answer may change during the estate.

The fire zone was read from the wrong map

The city adopted the State Fire Marshal's map by Ordinance No. 07-25 in May 2025 and the County adopted its own for unincorporated land by Ordinance No. 25-015 on 26 August 2025. Both replaced older maps, so a zone determination from an old natural hazard report may no longer be right.

A fiduciary sale is generally exempt from the defensible space documentation of Civil Code 1102.19, but not an individual trustee of a revocable trust who owned or lived in the home within the prior year, and not from the very high zone disclosure under Government Code 51183.5. Confirm the parcel in the state viewer and put the answer in writing.

The Eichler slab was never tested

Radiant heat in an Eichler runs through pipes embedded in the concrete slab. A leak shows up as a higher water bill, a warm spot, a crack in the floor or efflorescence, and repeated leaks are the warning that the system is near the end of its life.

A house that sat empty during probate may have had the heat off for months, so nobody noticed. A pressure test and a thermal scan before listing turn an unknown into a disclosed condition, which is what lets an estate hold its price.

The special tax was assumed from the neighbourhood name

Serrano Heights carries Community Facilities District No. 91-2, whose tax ends after the thirtieth fiscal year a parcel is taxed as developed, so two neighbours can have different years remaining. Del Rio carries CFD No. 06-1, Orange Unified has CFDs 2005-1 and 2005-2, and Santiago Hills carries a landscape maintenance assessment.

Old Towne and most of the older city carry none of these. Confirm by APN on the Orange County Treasurer Tax Collector's parcel map, where the charge appears under special assessment charges, and obtain the notice of special tax from the levying agency, because a line on the tax bill is not a disclosure.

The two routes

Serve the Notice, or Publish the Sale and Take It to a Judge

One of these is already decided by the letters. Both have a real cost, and a representative who can describe both to the heirs before the listing goes up spends far less time explaining them afterwards.

Selling under full authority

Probate Code 10402 gives a representative with full authority every power under the Independent Administration of Estates Act, and Probate Code 10503 states that the requirements applicable to court confirmation of sales of real property do not apply. No confirmation hearing. No ninety percent floor measured against the referee's number. No overbid in open court. The publication requirement in Probate Code 10300 also falls away, because 10503 exempts the sale.

What is left is the Notice of Proposed Action, mailed or personally delivered not less than fifteen days before the date it specifies under Probate Code 10586. It goes to each known devisee and each known heir whose interest would be affected, anyone who filed a request for special notice, and the Attorney General where the state's interest is affected, all under 10581. Written consent under 10582 or a written waiver under 10583 removes the requirement for that person.

For a Mills Act house in Old Towne or a hillside house in the east this route is a real advantage, because the disclosure work is already long and a hearing calendar on top of it stretches an estate past a year. It also lets the estate agree ordinary buyer requests, such as a slab test on an Eichler or a longer inspection period on a pre war house, without asking the court.

The honest downside is that nothing external validates the price. An objection under Probate Code 10587, delivered or mailed before the specified date or before the action is taken, whichever is later, sends the representative to court anyway, after the marketing time has already been spent. The only defence is the record: broad exposure, every offer kept, and the notice served properly and early.

Selling with court confirmation

Limited authority under Probate Code 10403 leaves four powers with the court, and selling real property is the first of them. The sale is confirmed at a hearing at the Costa Mesa Justice Complex, 3390 Harbor Blvd., Costa Mesa. The probate assistance line is 657-622-8452 and the case access portal is at probatepublic.occourts.org. Orange County examiners review petitions three to four weeks before the hearing, which is genuinely useful because a defect surfaces with time to cure it.

The notice of sale is published under Probate Code 10300 in the manner set by Government Code 6063a: at least ten days, three publications, and at least five days intervening between the first and the last publication dates, completed before the day specified for the sale. Probate Code 10304 requires the notice to state whether the sale is private or by public auction, the time and place, and the street address or legal description. Narrow exceptions exist under 10301, 10302 and 10303.

The report of sale and petition for confirmation are filed under Probate Code 10308, and if the representative has not filed within thirty days the purchaser may. The court confirms only at ninety percent or more of the appraised value under 10309(a), with the appraisal made within one year prior to the hearing. Then the overbid under 10311(a): at least ten percent more on the first ten thousand dollars of the original bid and five percent more on the balance, so a 1,000,000 dollar accepted bid requires 1,050,500 dollars.

The honest downside is that the same mechanism helps the estate and hurts it. An overbid can lift the price in open court, which is exactly what it exists to do. It also thins the buyer pool badly, because a buyer who has paid for an inspection and an appraisal and then has to appear at a hearing where anyone can take the property for a fixed increment often declines to begin. In Old Towne, where the buyer is also taking on a design review regime and perhaps a Mills Act contract, that combination is felt harder than elsewhere.

Why this office

The Representative Signs the Disclosure. Family Memory Is Not Evidence.

Paula Aragone has worked Orange County transactions for 23 years, across 900+ transactions and $900M+ sold, and she came to real estate after four years of law school. She holds the CPRES and SRES designations. That background is the reason estate and family law attorneys send probate files here rather than to a general listing agent.

CPRES is the Certified Probate Real Estate Specialist designation, and in a court confirmation sale it means the transaction is written the way the statute actually runs. A buyer has to be told before they write that the price must clear the ninety percent floor in Probate Code 10309(a), that a report of sale and petition will be filed under 10308, that a hearing will be set, and that an overbid computed under 10311(a) can take the property from them in the room. Discovering that at the counter offer stage loses the buyer and the hearing date together.

In Orange the second half of the work is retrieval. The design review and permit history for a house in Old Towne or the Eichler districts, and the recorded Mills Act contract with its fee and work history. The fire hazard zone for the parcel from the current map, and whether the parcel is city or county at all. The permit jacket, approved plans, inspection log and final from the Building Division at the Civic Center, 300 East Chapman Avenue, or through a public records request to the City Clerk where the online file is thin. The special tax status confirmed by APN and the notice obtained from the levying agency.

None of this is legal or tax advice and this office gives neither. What it produces is a file the estate's attorney, the examiner and the heirs can all read: what the property is, what is recorded against it, how it was exposed, and what every offer was. Statutory compensation under Probate Code 10800 and 10810 is computed on gross inventory value without reference to encumbrances and both the representative and the attorney are paid from it, which is a further reason to build that file once, properly.

Frequently Asked

Orange Probate Property, Answered

The questions executors and administrators ask about an estate in the City of Orange, answered for California law and for this city specifically.

Does the estate have to open a probate at all?

It depends on the date of death and the size of the estate. For a death on or after 1 April 2025, Probate Code 13100 allows an affidavit for personal property up to 208,850 dollars, Probate Code 13151 allows a petition to determine succession to real property up to 750,000 dollars for the decedent's California primary residence only under AB 2016, and Probate Code 13200 allows an affidavit for real property of small value up to 69,625 dollars. Those figures run from the date of death and hold through 31 March 2028.

How do I know whether I have full or limited authority?

It is stated in the letters the court issued to you. Probate Code 10402 gives full authority, meaning every power under the Independent Administration of Estates Act. Probate Code 10403 gives limited authority, which withholds four powers, all about real property: selling it, exchanging it, granting an option to purchase it, and borrowing money secured by an encumbrance on it. Probate Code 10501(b) keeps those four under court supervision. Read the letters before you interview an agent, not after.

Who has to receive a Notice of Proposed Action, and when?

Under Probate Code 10581 it goes to each known devisee whose interest would be affected, each known heir whose interest would be affected, anyone who has filed a request for special notice, and the Attorney General where the state's interest is affected. Probate Code 10586 requires it to be mailed or personally delivered not less than fifteen days before the date specified in the notice. Probate Code 10582 removes the requirement for anyone who consents in writing and 10583 allows a written waiver.

Is the house in the Old Towne historic district, and what does that change?

Old Towne was listed on the National Register on 11 July 1997 and is a local historic district under Orange Municipal Code Chapter 17.17, with Historic Preservation Design Standards applied since 1995. The sale itself is not reviewed. Exterior work is: the Design Review Committee decides applications that meet the historic threshold, and the Planning Commission decides replacement structures proposed with a demolition. A buyer who plans changes needs to know that before writing an offer.

Are the Eichler tracts in Orange historic districts too?

Yes. Ordinance No. 14-18, adopted in December 2018, created a historic district overlay and design standards for Fairhaven, Fairhills and Fairmeadow, 340 Eichler houses built in the early 1960s. Exterior alterations there are reviewed against the Eichler standards, and a change made without review is a disclosure item for the estate.

What happens to a Mills Act contract when the house is sold?

It goes with the house. The contract is recorded, runs at least ten years, renews each year and binds every successor in interest under Government Code 50281 and 50282, with inspections every five years and a cancellation fee of 12.5 percent of fair market value under 50286. Orange is not accepting new Mills Act applications while the program is under review, so an existing contract matters more to a buyer than it would elsewhere.

Does the estate need an AB 38 defensible space inspection to sell?

Usually not, and the exception matters. Civil Code 1102.19 requires defensible space documentation on sales in high and very high fire hazard zones, but Civil Code 1102.2 exempts probate court ordered sales and transfers by a fiduciary administering an estate or trust. The exemption does not cover an individual trustee of a revocable trust who owned or lived in the home within the prior year. An exempt sale still owes the very high zone disclosure under Government Code 51183.5, in a separate writing.

Which fire hazard map applies to an Orange address?

Inside the city, the State Fire Marshal's local responsibility area map adopted by Ordinance No. 07-25 in May 2025. In unincorporated Orange Park Acres and the other county islands, the County's map adopted by Ordinance No. 25-015 on 26 August 2025. Both replaced older maps, so confirm the parcel in the state viewer rather than relying on an old natural hazard report.

Is Orange Park Acres part of the City of Orange?

Partly. It was founded in 1928 on 640 acres and later subdivisions were annexed, leaving a mix of county and city land. The unincorporated part has County permits, the County fire map, the Orange County Fire Authority and, in places, septic rather than sewer. The same question applies to El Modena, North El Modena, Olive Heights and Lincoln Glassell.

Does Orange have a point of sale inspection requirement?

No presale report or point of sale inspection requirement was found for Orange, and it does not appear on a title industry list of cities that require one. Confirm the current position with the Building Division at 300 East Chapman Avenue before relying on it, because a compilation is not the code and requirements change.

The Lamoreaux Justice Center is in Orange. Is that where probate is heard?

No. The Lamoreaux Justice Center at 341 The City Drive South hears juvenile, family law and domestic violence matters. Orange County Superior Court hears probate at the Costa Mesa Justice Complex, 3390 Harbor Blvd., Costa Mesa. The probate assistance line is 657-622-8452 and case information is at probatepublic.occourts.org.

Where does the estate deal with the Assessor?

In Orange. The Orange County Assessor's main office is at 500 South Main Street, second floor, telephone 714-834-2727. A death is a change in ownership, and the Change in Ownership Statement for a decedent is due within 150 days of the date of death or, where the estate is probated, when the inventory and appraisal is filed, under Revenue and Taxation Code 480.

Which school district serves an Orange address?

Orange Unified serves Orange and Villa Park, unincorporated Silverado, and parts of Anaheim, Garden Grove, Santa Ana and Yorba Linda. Boundaries do not follow city lines exactly, so confirm by address with the district before it goes into marketing.

Does an Orange house carry Mello Roos?

Some do. Serrano Heights carries Community Facilities District No. 91-2 and Del Rio carries CFD No. 06-1, Orange Unified has CFDs 2005-1 and 2005-2, and Santiago Hills carries a landscape maintenance assessment. Old Towne and most of the older city carry none. Confirm by APN on the Orange County Treasurer Tax Collector's parcel map rather than by neighbourhood name.

How is the minimum overbid worked out?

Probate Code 10311(a) requires a higher offer to be at least ten percent more on the first ten thousand dollars of the original bid and five percent more on the amount of the original bid in excess of ten thousand dollars. So on a 1,000,000 dollar accepted bid the minimum first overbid is 1,000,000 plus 1,000 plus 49,500, which is 1,050,500 dollars. The increment is measured against the accepted bid. The ninety percent test is measured against the referee's appraisal. They are two different baselines.

Does the sale have to be advertised in a newspaper?

Under court confirmation, usually yes. Probate Code 10300(a) requires publication in the manner set by Government Code 6063a, which is at least ten days with three publications and at least five days intervening between the first and last publication dates, and 10300(b) requires publication to be complete before the day specified for the sale. Probate Code 10304 sets what the notice must say. The exceptions are 10301, 10302 and 10303, and under full authority Probate Code 10503 exempts the sale entirely.

What does the estate pay the representative and the attorney?

Probate Code 10800 sets the representative's compensation and 10810 sets the attorney's on identical tiers, and both are payable: 4 percent of the first 100,000 dollars, 3 percent of the next 100,000 dollars, 2 percent of the next 800,000 dollars, 1 percent of the next 9,000,000 dollars and 0.5 percent of the next 15,000,000 dollars. The base is gross inventory value plus gains and receipts, without reference to encumbrances, so a house appraised at 2,000,000 dollars carrying a 1,500,000 dollar mortgage counts at 2,000,000 dollars. That estate produces 33,000 dollars each and 66,000 dollars combined, plus any extraordinary fees.

How long will the estate be open?

No official source publishes a typical duration and it should never be stated as fact. The statutory anchors are these: the inventory and appraisal within four months after letters issue under Probate Code 8800, creditor claims due under Probate Code 9100 the later of four months after letters or sixty days after notice to that creditor, and a petition for final distribution or a status report not later than one year after letters under Probate Code 12200, or eighteen months where a federal estate tax return is required.
