A Permit That Dies at Transfer, and an Address With Two Boards
Dana Point is the only one of these cities where the rental permit does not survive the sale, and one of the few where a single home answers to a master association and a sub association at the same time. Both facts are value questions, and both have to be settled before the parties agree a number.
Municipal Code Chapter 5.38 has governed short term rentals since 2 April 2013 and was last amended by Ordinance 25-09 on 17 June 2025. Outside the coastal zone the cap is 115 permits, of which no more than 60 may be non primary, with one permit per property owner, a two consecutive night minimum and a thirty consecutive day maximum. Coastal zone properties are governed separately under CDP22-0010.
The clause that decides dissolution files is the transfer clause: the permit shall expire upon the date the title to such parcel transfers, with narrow exceptions for family transfers and for transfers producing no new property tax assessment. Some of what runs with these communities is not the parcel at all. The Monarch Bay beach club is a private members only club operated in partnership with the resort and tied to the community, so membership status and transfer rules are a specific due diligence item and, in a dissolution, an interest that has to be identified and assigned rather than assumed to follow the deed. Two honest difficulties belong on the table early. The housing is overwhelmingly a 1970s and 1980s product, about 61 percent of it built between 1970 and 1989, which is the worst window for the classic inspection findings, so a seller should assume polybutylene supply piping until proven otherwise along with panel, aluminium wiring and cast iron drain questions. And the harbour, the city's main civic amenity, is a construction site: it is a county project rather than a city one, the wharf retailers are closing through the autumn of 2026 ahead of the next construction phase, and a buyer touring a harbour adjacent home is buying next to that work.
Selling a Dana Point Property During a Dissolution
The Dana Point sequence puts two questions at the front that other cities put at the back: what happens to the rental permit on transfer, and how many associations govern the address. Both change the number, so both belong in the first week rather than in escrow.
Confirm the restraining orders and who they bind
Family Code 2040 restrains both parties from transferring, encumbering, hypothecating, concealing or disposing of any property, real or personal, community, quasi community or separate. Family Code 233 binds the petitioner on filing and issuance of the summons and the respondent on service or acceptance of service. Establish in writing which of those has already happened.
Settle the rental permit question before valuation

Instruct one appraiser, with the permit answer in hand
Family Code 2552 values the community estate as near as practicable to the time of trial, with an earlier date only on thirty days notice and good cause. Give the appraiser the association structure, the permit position, any club membership and the harbour construction status, because an appraisal built without them is an appraisal one side will later attack.
Market openly, through one channel
Broad exposure is what protects both parties from the later claim that the other arranged a quiet sale at a soft number. Fix in advance who receives the showing calendar, who approves a price change, how long each side has to answer an offer, and what happens on a deadlock. Where the property is a rental, tenant notice belongs in the same document.
Close on a disbursement formula written in advance
Escrow acts only on the joint written instructions and neither party can change them alone. Conflicting instructions produce an interpleader and a wait for the court rather than a decision. Have the judgment state the payoffs, costs, reserves and split, mirror it word for word in the instructions, and handle the state withholding on form 593 in the same place.
Dana Point Communities, and What Each Puts Into the File
Which community the property sits in decides how many associations govern it, whether a club membership or a private road interest travels with it, and how exposed it is to bluff and harbour questions.
Monarch Beach
The northern, resort adjacent third of the city, holding most of the gated communities, the golf links and the resort. This is where association documents, club memberships and gate access logistics dominate the front end of a listing.
Monarch Bay
Roughly 214 homes behind a single 24 hour guard gate with mixed era architecture from the 1960s onward, so original midcentury homes stand beside full rebuilds. The private members only beach club operated with the resort is a due diligence item of its own.
Monarch Bay Terrace
The bluff and hillside tract above Monarch Bay, largely 1960s and 1970s single level originals with extensive rebuilding and ocean views but no beach club. Era stock means the inspection report arrives before the negotiation does.

Six Things That Derail a Dana Point Dissolution Sale

There were two associations, not one

The bluff parcel had no geotechnical work behind it
Coastal erosion at Capistrano Beach is a present condition rather than a forecast: the shoreline has required emergency sand replenishment and nature based intervention, seawall permitting has been contested before the Coastal Commission, and a storm driven bluff failure in February 2024 left an ocean view home at the cliff edge.
A buyer on any bluff parcel will ask for a geotechnical report, the erosion rate used and the setback analysis. Post 1976 structures have no entitlement to shoreline armouring after the Casa Mira decision, and the Martin standard of a 1.5 factor of safety over a 75 year project life governs new bluff top setbacks.
Nobody checked which authority governs the work
The city has issued coastal development permits under a Local Coastal Program certified in 1989, with appealable development limited to the types defined in its own code and a ten working day appeal window from the Notice of Final Action. Permits are required for work on beaches, in wetlands, within fifty feet of coastal bluffs, or between the sea and the first public road.
That fifty foot bluff trigger is stricter in wording than the 300 foot appeal bands used up the coast and is the one most often overlooked on a Capistrano Beach or Headlands remodel. The Coastal Commission also retains authority over uncertified areas and over all tidelands, submerged lands and public trust lands.
The 1970s and 1980s stock produced a long repair list
About 61 percent of the city's housing was built between 1970 and 1989, which is the worst window for the classic findings. Assume polybutylene supply piping until proven otherwise across the entire 1978 to 1995 range, plus panel replacements, aluminium branch wiring at the early end, cast iron drains, galvanised supply and asbestos era materials in anything before 1980.
A long repair list is an ordinary negotiation between one seller and one buyer. Between two separated households with separate finances it becomes a second case, so agree a repair decision rule at listing: who authorises what, up to what figure, and who breaks a tie.
Sell the House, or One Spouse Buys the Other Out
In Dana Point the two options are not just different amounts of money. They are potentially different answers to whether a rental permit survives at all, which is why the permit question comes before the arithmetic.
Sell the house
A sale converts a contested asset into a number divisible under Family Code 2550, and it ends the shared exposure to association assessments, insurance and repairs on a building neither party wants to fund alone. It also ends the permit question definitively, because a sale to a third party transfers title and the permit expires on that date under Chapter 5.38.
That has to be priced honestly rather than hoped past. A buyer underwriting a Dana Point property cannot assume they inherit the rental permit, and both spouses are better served by a valuation that reflects the ordinance than by one that quietly assumes an exception. Give the appraiser the permit position, the association structure and any membership at the start.
The tax position usually favours selling while the marriage is intact. IRC section 121 excludes 250,000 dollars per individual and 500,000 dollars on a joint return where either spouse meets the ownership test, both meet the use test and neither is disqualified by the two year look back, both tests measured over twenty four months out of the five years ending on the sale date. Where the property was rented, gain equal to depreciation adjustments for periods after 6 May 1997 is not excludable under 121(d)(6) and gain allocated to nonqualified use is not excludable under 121(b)(5).
The honest downside: a sale moves both households on a buyer's schedule, and in this city it can also mean selling next to the harbour revitalisation. The wharf retailers close through the autumn of 2026 ahead of the next construction phase, the work is a county project rather than a city one, and a harbour adjacent listing has to present that as both a disclosure and a forward looking amenity, which takes longer than a simple sale.
One spouse buys the other out
Start with fair market value at the applicable date, subtract encumbrances for gross equity, then remove any Family Code 2640 reimbursement for traced separate contributions and any separate interest established under Moore and Marsden, adjusted for Epstein credits and Watts charges. The remainder is community equity, halved. Whether hypothetical costs of sale are deducted where no sale is happening is contested and should be treated as negotiable rather than assumed.
The permit exception is worth resolving before this is agreed. Chapter 5.38 carves out family transfers and transfers producing no new property tax assessment, and whether an interspousal transfer under a judgment sits inside either carve out is a question for the city in writing, not an inference from the words. If the permit survives a buyout but not a sale, the two options are not economically comparable and the settlement should say why.
Then the lender decides what is possible. A buyout refinance qualifies as a limited cash out refinance under the Fannie Mae Selling Guide, and earns that better pricing, only where all parties held the property jointly for at least twelve months before the disbursement date. All parties must sign a written agreement stating the terms of the transfer and the disposition of proceeds, the retaining spouse may not receive any of the proceeds, incidental cash back is capped at the greater of one percent of the new loan amount or 2,000 dollars, and the retaining spouse must qualify alone on income, credit and debt to income. Where an address carries master and sub association dues, both figures land in that ratio.
The honest downside is the same two part trap as everywhere, sharpened here. Removing a spouse from title is not removing them from the loan: a deed changes ownership while the note is a contract with a lender who is not a party to the divorce, so only a refinance or an assumption with an express written release of liability discharges it, and the Garn St Germain Act generally prevents acceleration on a divorce related transfer, which is why the deed records cleanly while the liability stays. On top of that, a transfer incident to divorce is not taxable under IRC section 1041 and carries basis forward, so the retaining spouse absorbs the whole built in gain against a possible 250,000 dollar exclusion later.
Neutral by Design, Because the Two Sellers Are Not Agreed

When do the restraining orders start applying?
Family Code 233 answers it. The orders are effective against the petitioner on filing of the petition and issuance of the summons, and against the respondent on personal service of the petition and summons or on their waiver and acceptance of service. They stay in place until the judgment is entered, the petition is dismissed, or the court says otherwise. The house was mine before we married. Is it still all mine?
Usually not entirely. Family Code 770 protects what you owned before the marriage, but every dollar of loan principal retired with community earnings during it gives the community a proportional ownership interest, under In re Marriage of Moore (1980) 28 Cal.3d 366 and In re Marriage of Marsden (1982) 130 Cal.App.3d 426. Appreciation before the marriage stays with the owner spouse, and appreciation during the marriage is shared in the ratio the community's principal payments bear to the original purchase price. In re Marriage of Mohler (2020) 47 Cal.App.5th 788 fixes that percentage at separation.
I paid the down payment from money I inherited. Do I get it back?
If it can be traced, yes, but only the nominal dollars. Family Code 2640 reimburses separate property contributions to the acquisition of community property, including down payments, improvements and payments reducing loan principal, to the extent the party traces them to a separate source and has not waived reimbursement in writing. Interest, maintenance, insurance and taxation payments do not qualify. The statute says the reimbursement is without interest or adjustment for change in monetary values, and it cannot exceed the net value of the property at division.
How does the harbour construction affect our sale?
It is both a disclosure and part of the story, and it should be presented as both. The harbour is a county project rather than a city one, so the approving bodies and the records sit with the county and the Coastal Commission. The marina work is well advanced with new slips delivered, while the wharf retailers close through the autumn of 2026 ahead of the next construction phase.
