The Bluff, the Corridor, and Two Sellers Who Must Say the Same Thing


Both of the facts that make this city distinctive are public, documented and unfinished. That is good news in a dissolution, because a documented fact is not something two people can argue about for six weeks.

Ole Hanson, a former mayor of Seattle, bought the land in 1925 and built a master planned Mediterranean coastal town, incorporated on 27 February 1928. He required every building plan to pass an architectural review board that enforced red tile roofs and white exteriors. That consistency did not hold, and the oldest neighbourhoods are eclectic today. What did survive is the coastal setting, and a coastal setting adds a regulator to the file.

Public Resources Code 30600 requires a coastal development permit for development in the coastal zone, and where a local coastal programme is certified the city issues it, except on tidelands, submerged lands and public trust lands. Public Resources Code 30603 then keeps that local decision appealable to the Coastal Commission where the development is between the sea and the first public road paralleling the sea, within 300 feet of the inland extent of any beach, or within 300 feet of the top of the seaward face of any coastal bluff.

The practical consequence for a bluff top parcel is that a city permit is not the last word. It remains exposed to a Commission appeal for ten working days from the notice of final action, and a buyer with plans of their own will price that. The city's programme is also segmented, with Marblehead Coastal remaining an area of deferred certification where authority is not fully delegated. None of this stops a sale. It sets a calendar, and a calendar is exactly what a dissolution needs settled early.

The rail corridor is this city's most material disclosure item and the one with the fullest public record. The Surf Line runs where a recurring landslide meets the right of way and where wave action at high tide reaches the tracks. The documented sequence: closure from 15 September to 3 October 2021 after beach erosion and storm damage; passenger traffic halted on 29 September 2022 for soil movement; a further landslide and renewed closure in April 2023; another halt in June 2023 from the Casa Romantica landslide on the bluff above, with service resuming on 19 July 2023; and a landslide from private property north of the San Clemente Pier on 25 January 2024 that damaged the Mariposa pedestrian bridge, with limited service on 6 March 2024 and full service on 25 March 2024.

The response is equally documented. Stabilisation to date includes riprap between the beach and the tracks, steel anchors into bedrock, and a 250 foot barrier wall twelve feet high on piles set thirty two feet deep, built under an emergency declaration. The current OCTA programme runs four emergency areas identified by milepost: areas one and two, riprap repair and sand nourishment, complete; area three, catchment wall construction with trail restoration, under construction; area four, engineered shore protection and sand nourishment, underway. The mix is roughly 95 percent sand and 5 percent rock, with about 540,000 cubic yards of sand between North Beach and Mariposa Point, at a total programme cost of 310.5 million dollars.

Two facts complete the picture and both belong in a disclosure. Passenger rail service through San Clemente was halted as of 25 April 2025 for emergency reinforcement work. And the long term answer is not settled: the Orange County Coastal Rail Resiliency Study covers more than forty miles of the LOSSAN corridor from San Clemente to Fullerton, with a vulnerability assessment completed in winter 2024 and a final report due to the OCTA Board in fall 2026, while a separate initiative studies relocating the line inland between San Juan Capistrano and San Onofre State Beach. The stated design goal is protecting the railroad for up to thirty years. Give a buyer the record and let them read it.

The process

How a San Clemente Sale Is Run Through a Dissolution


Two calendars run at once in this city: the court's, and a coastal and corridor timeline nobody in the case controls. The sequence below is what keeps them from colliding at the worst possible point.

01

Read the summons and date the restraint

Family Code 233 makes the orders effective against the petitioner on filing of the petition and issuance of the summons, and against the respondent on personal service or on waiver and acceptance of service. They remain in force until judgment, dismissal or a further order. Put the date in writing at the start, because it is the date every later question refers back to.

Get consent or an order that escrow can actually use

A family residence is not usual course of business, so Family Code 2040 leaves consent or an order. An order that works at escrow names the property and legal description, the broker, the list price or the mechanism for setting it, who may accept an offer, who signs which instrument, and how the proceeds are disbursed. A direction that the home shall be sold is not enough.

Establish whether the parcel sits in the appeal jurisdiction

Check whether the parcel falls in the deferred certification segment

San Clemente's local coastal programme is segmented, and one segment, Marblehead Coastal, remains an area of deferred certification, so coastal permit authority there is not fully delegated to the city. That is a timeline item rather than an obstacle, but it is a timeline item that has to be identified before two people commit to a closing date.

Assemble the rail corridor disclosure once, for both parties

The corridor record is public, long and unfinished, and both spouses should be delivering the same account of it. Assemble it once from the published sources, agree it in writing, and give the buyer documents rather than characterisations. Inconsistent descriptions from two sellers do more damage to a transaction than the underlying facts ever do.

Determine character and reimbursement with counsel

Family Code 760 makes property acquired during marriage community and 770 keeps premarital property separate, with the joint title presumption in 2581 rebuttable only by a clear statement in the deed or a written agreement. Moore and Marsden govern community principal paid on a separate loan, and Family Code 2640 governs traced separate contributions. Counsel decides all of it.

Instruct one appraiser with the coastal file attached

Family Code 2552(a) values as near as practicable to the time of trial, with the 2552(b) exception available only on thirty days notice and for good cause. On a bluff top or corridor adjacent parcel the appraiser should hold the coastal and disclosure file before giving an opinion, or the number moves once the buyer's side assembles the same material.

Market it openly, on a single decision channel

The open market is what protects each party from the other's later accusation. Decide up front who holds the showing calendar, who approves a reduction and what breaks a deadlock. Where one spouse still occupies the property, access and condition belong in the order rather than in a conversation neither of them will later remember the same way.

Close on a formula both parties signed before escrow opened

Escrow acts only on instructions both principals signed, and neither may amend them alone. Conflicting instructions are interpleaded rather than refereed, and the money goes to the court. Put the disbursement formula in the judgment, repeat it word for word in the escrow instructions, and deal with the 3 1/3 percent form 593 withholding, and any principal residence exemption, in the same document.

Six San Clemente Assumptions That Cost a Closing Date

Each of these is a question with a published answer that nobody looked up. In a dissolution the party who did not look it up is rarely the party who gets blamed.

The permit was issued by the city and treated as final

A buyer who intends to build, add or remodel will ask about this, and a seller who answers that the city already approved the plans has given an incomplete answer. Establish where the parcel sits relative to the appeal band, put the answer in the file, and make sure both spouses give the same one.

It belongs on this list because a dissolution timeline is already governed by a court calendar. Adding an unidentified permitting layer to that is how a closing date agreed in a settlement becomes a date nobody can meet, and a missed date in a dissolution is very rarely treated by the other side as a scheduling problem.

The two spouses described the rail corridor differently

The corridor record is unusually complete: closures in 2021 and 2022, a landslide and closure in April 2023, the June 2023 Casa Romantica landslide with service resuming on 19 July 2023, the 25 January 2024 landslide that damaged the Mariposa pedestrian bridge with limited service on 6 March and full service on 25 March 2024, and the halt to passenger service as of 25 April 2025 for emergency reinforcement work.

Because the record is complete, two sellers should not be producing two versions of it. Give the buyer the published sequence, the current OCTA programme by area, and the fact that the resiliency study reports to the OCTA Board in fall 2026. A documented fact ends a conversation. A characterisation starts one.

Beach and trail access was described from memory

Construction along the corridor affects beach and trail access, and that is exactly the kind of item a seller describes from last summer rather than from this week. The work is staged by area and the staging moves.

Check the current position before it goes into any written statement, and check it again before closing if the escrow runs long. In a dissolution the spouse who did not draft the description is the one who will be accused of the inaccuracy, which is the reason both parties should review the same draft.

One record owner signed the listing

A listing signed by one of two record owners does not bind the property or create authority to convey. Family Code 1102 requires both spouses to join in any instrument by which community real property is sold, conveyed or encumbered, and Family Code 2040 restrains either party from transferring or encumbering while the case is open.

The two rules point the same way: both signatures, or an order. Where a signature is withheld, the sequence is an order authorising the sale first, then a Request for Order for an elisor under Orange County Superior Court Local Rule 721. The elisor signs what an existing order already authorises, and not one document more.

The number was agreed before the coastal file existed

An appraisal produced without the coastal position, the permit history and the corridor record is a number that will be revisited. In an ordinary sale that costs a week. In a dissolution it costs the agreement the number was holding together.

Family Code 2552(a) values as near as practicable to the time of trial in any case, so an early figure was never final. Instruct one appraiser jointly, hand over the complete file, and treat the result as a shared starting point rather than as either party's position.

The decision

Sell Into the Market, or Refinance and Stay


The coastal file and the corridor record follow whichever route you take. What changes is which of you is left holding them, and for how long.

Sell the house

A sale converts a contested asset into a number, and Family Code 2550 divides a number equally without either party remaining dependent on the other. It also delivers the coastal position and the corridor record to a buyer once, with both spouses signing the same documents, so the disclosure obligation ends at closing instead of continuing in one name into an unsettled decade.

IRC section 121 excludes 250,000 dollars per individual taxpayer and 500,000 dollars on a joint return where either spouse meets the ownership test, both meet the use test, and neither is disqualified by the two year look back. Both tests are satisfied by twenty four months out of the five years ending on the date of sale, which is why selling while still married and filing jointly for the year of sale is what preserves the full 500,000 dollars.

The closing has to be designed in advance. Both parties sign the escrow instructions and both must sign any amendment. Conflicting instructions are not resolved by the escrow holder, a neutral stakeholder whose remedy is interpleader and whose interpleader deposits the money with the court. California withholding is 3 1/3 percent of the sales price on form 593 unless an exemption applies, including certification that the property qualified as a principal residence under section 121.

The honest downside: a coastal listing in a dissolution runs at the speed of its slowest approval, every document needs two signatures, and a buyer will ask about the corridor and about the appeal jurisdiction, both of which take longer to answer than either spouse expects. It is public, and it moves both households on a schedule a buyer sets. Where children are settled at San Clemente High, Family Code 3802 entitles a court to weigh that.

One spouse buys the other out

Begin with fair market value at the applicable date, subtract encumbrances to reach gross equity, then take Family Code 2640 reimbursement for traced separate contributions off the top together with any separate interest under Moore and Marsden, adjusted for Epstein credits and Watts charges. The remainder is community equity and each spouse takes half. Whether hypothetical costs of sale are deducted where no sale is happening is contested, so negotiate it rather than assume it.

The lender is the gate. Under the Fannie Mae Selling Guide a refinance that pays off the existing first mortgage and buys out a co owner is treated as a limited cash out refinance, with the better pricing, only where the property was jointly owned by all parties for at least twelve months before the disbursement date. All parties must sign a written agreement stating the terms of the transfer and the disposition of proceeds, the retaining spouse may receive none of the proceeds, incidental cash back is capped at the greater of one percent of the new loan amount or 2,000 dollars, and the retaining spouse must qualify alone on income, credit and debt to income.

Title and loan are separate acts and confusing them is the most damaging error available in a divorce transaction. A recorded interspousal transfer deed changes ownership and leaves the promissory note untouched, because the lender is not a party to the divorce. Only a refinance, or an assumption with an express written release of liability from the servicer, removes a borrower. The Garn St Germain Act generally prevents acceleration on a divorce related transfer, which is why the deed records cleanly while the liability stays exactly where it was.

The honest downside runs in two directions here. Tax: a transfer incident to divorce is not a taxable event under IRC section 1041 and the receiving spouse takes carryover basis, so the entire built in gain lands on the buying spouse, who may have only 250,000 dollars of exclusion at the eventual sale. Then time: the spouse who keeps the house keeps the coastal appeal question and the corridor disclosure, and the resiliency study does not report to the OCTA Board until fall 2026.

Can one of us list the house without the other?

No. Family Code 2040 restrains both parties from transferring, encumbering, hypothecating, concealing or in any way disposing of any property, real or personal, whether community, quasi community or separate, without the written consent of the other party or an order of the court. A family residence is not a transaction in the usual course of business. Family Code 1102 independently requires both spouses to join in any instrument by which community real property is sold, conveyed or encumbered. Both signatures, or an order.

When do the restraining orders start binding each spouse?

Family Code 233 gives two different moments. They bind the petitioner on filing of the petition and issuance of the summons. They bind the respondent on personal service of the petition and summons, or on the respondent's waiver and acceptance of service. They remain in force until final judgment is entered, the petition is dismissed, or the court orders otherwise. The orders themselves are printed on the face of Judicial Council form FL-110 under the standard family law restraining orders heading.

The house was mine before the marriage. Does that survive?

Partly. Family Code 770 keeps property owned before marriage separate, but where community earnings reduced the loan principal the community takes a pro tanto ownership interest under In re Marriage of Moore (1980) 28 Cal.3d 366, measured by the ratio the community's principal payments bear to the original purchase price. In re Marriage of Marsden (1982) 130 Cal.App.3d 426 gives premarital appreciation entirely to the owner spouse and shares appreciation during the marriage. In re Marriage of Mohler (2020) 47 Cal.App.5th 788 fixes the community percentage at separation.

Can I get back the separate funds I put in?

Yes if you can trace them, and only in nominal dollars. Family Code 2640 reimburses separate property contributions to the acquisition of community property, meaning down payments, payments for improvements and payments that reduce loan principal, unless the right was waived in writing. Interest, maintenance, insurance and taxation are expressly excluded. The statute states there is no interest and no adjustment for change in monetary values, and the reimbursement cannot exceed the net value of the property at the time of division.

What date is used to value the property?

Family Code 2552(a) requires valuation as near as practicable to the time of trial, which is neither the date of separation nor the date of filing. Family Code 2552(b) permits an alternate date after separation and before trial, but only on thirty days notice by the moving party and only for good cause shown, in order to accomplish an equitable division. On a coastal parcel the practical consequence is that any figure agreed before the coastal and corridor file is assembled will be revisited.

What if one of us refuses to sign the deed or the instructions?

The court can appoint an elisor to sign in that party's place, and the signature is legally theirs. Code of Civil Procedure section 128(a)(4) supplies the power to compel obedience to judgments and orders. Orange County Superior Court Local Rule 721 sets the procedure: a Request for Order, a declaration listing the exact documents and describing good faith meet and confer efforts, and a proposed order designating the Clerk of the Court or Clerk Designee rather than a named employee, with copies attached. The authorising order has to exist first.

Can a court order a sale here?

It can. No statute is titled order of sale, but Family Code 2550, 2601 and 2553 combine to give the authority: divide the community estate equally, award an asset on conditions that produce a substantially equal division, and make any orders necessary to carry that out. Sale is ordered where the estate cannot otherwise be divided equally, where neither party can qualify to buy the other out, or where a party is dissipating the asset. After judgment, partition under Code of Civil Procedure title 10.5 is the alternative route.

Can the sale be deferred while our child is at San Clemente High?

That is a deferred sale of home order, a Duke order, under Family Code 3800 through 3810, named for In re Marriage of Duke (1980) 101 Cal.App.3d 152. The court must first decide under 3801 whether it is economically feasible to maintain the note payments, taxes, insurance and the condition of the home during the deferral. It then weighs the 3802(b) factors, among them the time the child has lived in the home, grade and school placement, and each parent's ability to obtain suitable housing. Under 3808 remarriage of the resident parent raises a rebuttable presumption against further deferral.

How does escrow pay two sellers who do not agree?

Strictly according to the instructions both of them signed. Escrow is a limited agency and the escrow holder acts only on the specific written instructions of the principals, which neither principal may change alone once joint instructions exist. Faced with conflicting instructions the escrow holder is a neutral stakeholder rather than a referee, and its remedy is an interpleader that deposits the funds with the court. The way to avoid that is a judgment stating the disbursement formula and escrow instructions repeating it word for word.

Will there be capital gains tax, and who gets the exclusion?

IRC section 121 excludes 250,000 dollars per individual taxpayer and 500,000 dollars on a joint return where either spouse meets the ownership test, both meet the use test, and neither is disqualified by the two year look back. Both tests need twenty four months out of the five years ending on the date of sale. Ownership tacks on a transfer incident to divorce, and use by a former spouse counts as your own where a written divorce or separation instrument grants that use.
