Divorce Real Estate Agent in Laguna Niguel, CA
Paula Aragone handles Laguna Niguel dissolution listings where the parties do not agree, from the restraining orders on the summons to the grading and slope questions the statutory hazard form was never designed to answer. The representation is of the sale, not of either spouse.
Two things have to be settled before a Laguna Niguel house can be marketed in a dissolution. Authority first: the Automatic Temporary Restraining Orders in Family Code 2040, printed on Judicial Council form FL-110, permit a sale only on the written consent of the other party or an order of the court. Disclosure second: this is a hillside city built on graded ground, and the six categories on the statutory hazard form do not include compaction. Both spouses have to agree what gets said.

The Statutory Hazard Form Has Six Boxes, and Fill Is Not One of Them
This city was planned across hills and built on graded ground. The disclosure the law requires and the disclosure a buyer's engineer looks for are not the same document, and two people in a dissolution should know that before they start arguing about it.
The land comes out of the Rancho Niguel grant. The Laguna Niguel Corporation acquired the property in 1959 and commissioned the Viennese architect Victor Gruen to produce the initial 7,100 acre town plan, with close to a third of the developed land held as parks and open space. AVCO Community Developers expanded the project from 1971. The city itself incorporated on 1 December 1989, the county's twenty ninth, without the coastal strip, and its local coastal programme was certified in 1990.
On 19 March 1998, after heavy El Nino rains, a hillside collapsed at Niguel Summit and destroyed approximately ten residences. The investigation found that the developer had improperly packed and graded the 275,000 tons of fill supporting the homes. That is a documented public event with a documented cause, and it is the reason a Laguna Niguel buyer's engineer looks at grading history rather than only at the hazard form.
What it is not is a statement about any particular property. The failure attaches to specific tracts, and the connection has to be researched at tract level before it is tied to a given address. A seller who volunteers a citywide alarm is disclosing something that is not true, and a seller who says nothing while a buyer's engineer finds a thin grading file has created exactly the argument they were trying to avoid.
The Natural Hazard Disclosure Statement under Civil Code 1103.2 has exactly six categories: a FEMA special flood hazard area, a dam failure inundation area, a fire hazard severity zone, a wildland fire area under Public Resources Code 4125, an earthquake fault zone under Public Resources Code 2622, and a seismic hazard zone under Public Resources Code 2696. Improperly compacted fill is not one of them, and no combination of the six reports it.
So the honest position in a hillside city is that the statutory form is the floor and not the ceiling. The material facts a seller actually knows are disclosed because they are material, not because a box exists for them. Where there is a grading permit, a compaction report, a soils investigation, a repair, a retaining wall, a drainage change or an association slope programme, the document is produced and the buyer draws their own conclusions from it.
In a dissolution that becomes a negotiation between the two sellers, and it is worth having early rather than during a buyer's contingency period. One spouse tends to read full disclosure as sabotage of the price, and the other tends to read restraint as concealment. Neither framing is correct. The standard is materiality, both parties sign the same set of documents, and the file is kept so that neither can later be accused by the other.
How a Laguna Niguel Home Reaches the Market During a Dissolution
Two questions run in parallel in this city, and both have to be answered before a price is agreed: who holds the authority to sell, and what the two of you are going to say about the ground the house sits on.
Establish authority before anything else moves
Family Code 2040 restrains both parties from transferring or encumbering any property without written consent or a court order, and Family Code 233 attaches those orders to the petitioner on filing and issuance of the summons, and to the respondent on service or on waiver and acceptance. Selling the family home is not usual course of business. Confirm in writing which of those has happened before a calendar exists.
Agree in writing what will be disclosed about the slope
This step is the one unique to this city. One spouse usually wants to say no more than the form requires and the other wants to say everything. The answer is neither preference. It is what the law obliges plus what a buyer will discover anyway, agreed once, in writing, and delivered identically by both parties to the same buyer.
Pull the grading and geotechnical record for the parcel
Ask for the grading permits, the compaction reports, the geotechnical investigation and any soils report in the file for the parcel, together with anything the association holds on slope maintenance and drainage. A hillside file containing nothing is not a clean file, it is an incomplete one, and a buyer's engineer will read it exactly that way.
Complete the statutory hazard disclosure on its own terms
Civil Code 1103.2 lists six categories: a FEMA special flood hazard area, a dam failure inundation area, a fire hazard severity zone, a wildland fire area under Public Resources Code 4125, an earthquake fault zone under Public Resources Code 2622, and a seismic hazard zone under Public Resources Code 2696. Complete it accurately, and understand that it does not answer a compaction question.
Sort character and reimbursement claims with counsel
Family Code 760 makes property acquired during marriage community and 770 keeps what was owned before marriage separate, with the joint title presumption in 2581 rebuttable only by a clear statement in the deed or a written agreement. Moore and Marsden govern community earnings paying down a separate loan, and Family Code 2640 governs traced separate contributions. Counsel does that work.
Instruct a single appraiser who has seen the geotechnical file
Family Code 2552(a) values the estate as near as practicable to the time of trial, and 2552(b) permits an earlier date only on thirty days notice and for good cause. On a hillside parcel the appraiser needs the geotechnical file in hand, because an opinion given without it gets revised later, in front of both parties, at the worst possible moment.
Order the association documents in the first week
Resale documents, budget, reserve study and minutes take time, and where slopes and drainage are maintained in common the reserve study is not a formality. It is the document that tells a buyer who pays for the hillside. Where a special tax or a 1915 Act assessment appears, Civil Code 1102.6b requires the notice from the levying agency itself.
Expose it to the whole market on one decision channel
An open listing is what stops either party claiming later that the other arranged a quiet sale at a soft number. Settle before the sign goes up who holds the showing calendar, who approves a reduction, and how a deadlock is broken. Where one spouse still occupies the house, put access and condition into the order rather than into a text message.
Close on a formula that was written before escrow opened
Escrow acts only on the written instructions both principals signed, and neither may amend them alone. Conflicting instructions are not refereed by the escrow holder, they are interpleaded and the funds go to the court. The clean structure is a judgment stating the disbursement formula, escrow instructions repeating it word for word, and form 593 withholding handled in the same document.
Laguna Niguel Neighbourhoods and Landmarks That Show Up in These Files
Only the names confirmed by the research behind this page appear here. What each entry adds is the records and grading question it raises, not a description of houses nobody has verified.
Bear Brand Ranch
One of the named neighbourhoods confirmed for this city. In a dissolution the useful first request is the parcel's own grading and geotechnical file, because a valuation agreed before that arrives tends not to survive it.
San Marin
A named neighbourhood in the city. Where an association maintains slopes or drainage, its reserve study tells a buyer who pays for the hillside, which makes it a valuation document as much as a disclosure document.
El Niguel Heights
A named neighbourhood in the city. Confirm the association structure before either party commits to a number, since dues and assessments move alongside the mortgage in a lender's debt to income calculation.
Laguna Crest
A named neighbourhood in the city. On any hillside parcel the two spouses should agree in writing, early, what will be disclosed about grading, drainage and past repairs, and then deliver exactly that.
Monarch Point
A named neighbourhood in the city. A gated or guarded address adds a showing access question, and that belongs in the order or the written agreement rather than in messages between two households.
Niguel Summit
The location of the hillside failure of 19 March 1998, in which approximately ten residences were destroyed after heavy El Nino rains and the investigation found the 275,000 tons of supporting fill had been improperly packed and graded. The event is documented. Whether it reaches a specific address is a tract level question that has to be researched before anyone states it.
Kite Hill
A named neighbourhood in the city. Association records, including minutes covering slope and drainage work, are ordered at the start of a listing rather than after an offer is accepted.
Rolling Hills
A named neighbourhood in the city. Where a parcel sits above or below a graded slope, maintenance responsibility is answered from the governing documents, not from what either spouse remembers being told.
The Victor Gruen town plan
The initial 7,100 acre plan, with close to a third of the developed land held as parks and open space. It is why the city reads as green, and why open space adjacency is a valuation factor two spouses can disagree about honestly.
The 1959 acquisition and the AVCO expansion from 1971
The Laguna Niguel Corporation acquired the property in 1959 and AVCO Community Developers expanded the project from 1971. Improvements follow the era they were built in, and a records request should be aimed accordingly.
Incorporation, 1 December 1989
Orange County's twenty ninth city, incorporated without the coastal strip. That boundary decision is the reason a coastal question here is answered from the map rather than from the city name.
The local coastal programme certified in 1990
Listed on the Coastal Commission's certification chart. Whether a given parcel sits inside the coastal zone at all is a mapping question, and where it does, coastal permitting runs on a timeline of its own.
City Hall, 30111 Crown Valley Parkway
The city's address, and the practical counter for permit and code questions when the spouse who did not handle the original work is the one who now has to produce the record.
Capistrano Unified School District
Serves the city in full, with Niguel Hills Middle School as the district middle school here. Confirm attendance areas by address, and note that school placement is a factor under Family Code 3802 on any request to defer a sale.
Six Ways a Laguna Niguel Sale Comes Apart Late
Laguna Niguel, California
Every one of these is a document or a decision that was left until a buyer forced it. In a hillside city, late is the expensive part.
The hazard form was treated as the whole disclosure
Civil Code 1103.2 lists six hazard categories and none of them is a fill, compaction or grading category. A completed Natural Hazard Disclosure Statement is therefore a true document that does not answer the question a Laguna Niguel buyer's engineer is actually asking.
What fills the gap is the ordinary duty to disclose material facts the seller knows. In practice that means grading permits, soils and compaction reports, any repair, any retaining wall and any drainage change go to the buyer as documents. Two spouses who agree that rule at the start stop arguing about it later.
The grading file was never requested
A hillside parcel with an empty grading file is not a parcel with no history. It is a parcel whose history has not been requested. The records exist across city and county files and, where slopes are maintained in common, in the association's minutes and its reserve study.
In a dissolution the request has to be made by whoever will actually chase it, and both parties need to receive the response at the same moment. A document that reaches one spouse first becomes evidence of something in the other spouse's mind, whatever it happens to say.
The two spouses disclosed different things
Both spouses sign the transfer disclosure statement. When one has lived in the house for the last two years and the other has not, they know different things, and forms completed separately produce two different accounts of the same property.
Fix it procedurally. One draft, both parties reviewing the same version, differences resolved in writing and disclosed rather than reconciled away. A buyer who receives two inconsistent seller accounts of a hillside property does not negotiate, they cancel and move on.
One signature on the listing agreement
Every record owner signs, or the listing does not bind the property. Family Code 1102 requires both spouses to join in any instrument by which community real property is sold, conveyed or encumbered, and Family Code 2040 independently restrains either party from transferring or encumbering while the case is open.
The two rules overlap and give the same answer: both signatures, or an order. The defect is invisible on the day the listing is signed and expensive at the title review, which is why it is worth thirty minutes at the very start.
An association question was answered from memory
Dues, assessments, slope and drainage maintenance responsibility and any pending special assessment come out of the governing documents and the reserve study, not out of what either spouse remembers paying or being told.
This matters twice. A buyer's lender counts the dues against debt to income alongside the mortgage, and a pending assessment changes the equity the two of you are dividing. Order the documents in week one and give both parties the same copies.
The valuation was agreed before the reports arrived
An appraiser handed a hillside parcel and no geotechnical file will still produce a number, and that number will move once the reports arrive. In an ordinary sale that is an inconvenience. In a dissolution it is a broken agreement.
Family Code 2552(a) values as near as practicable to the time of trial in any event, so an early figure was never final. Instruct one appraiser jointly, give them the complete file, and treat the result as a shared starting point rather than as either party's position.
Sell It, or Refinance It Into One Name
Both routes are ordinary. What is not ordinary is the cost each one carries in a hillside city where the ground itself is part of the file.
Sell the house
A sale converts the asset into a number, and Family Code 2550 divides a number equally without either party remaining tied to the other. It also closes the disclosure question in one direction: the grading history, the reports and the repairs go to a buyer once, both spouses sign the same documents, and the responsibility ends at closing rather than continuing in one name.
IRC section 121 excludes 250,000 dollars per individual taxpayer and 500,000 dollars on a joint return where either spouse meets the ownership test, both meet the use test, and neither is disqualified by the two year look back. Both tests are satisfied by twenty four months out of the five years ending on the date of sale. Selling while the marriage is intact and filing jointly for the year of sale is what preserves the full 500,000 dollars.
Design the escrow before it opens. Both parties sign the instructions and both must sign any amendment. If they conflict, the escrow holder does not adjudicate, it interpleads and the funds go to the court. California withholding is 3 1/3 percent of the sales price on form 593 unless an exemption applies, including certification that the property qualified as a principal residence under section 121.
The honest downside: a hillside listing in a dissolution moves at the speed of its slowest document, every decision needs two signatures, and a buyer's engineer will ask for things one spouse would rather not produce. It is public, and it moves both households on a schedule someone else sets. Where children are settled, Family Code 3802 entitles a court to weigh that.
One spouse buys the other out
Start at fair market value on the applicable date, subtract encumbrances for gross equity, then take Family Code 2640 reimbursement for traced separate contributions off the top along with any separate interest under Moore and Marsden, adjusted for Epstein credits and Watts charges. The remainder is community equity and each spouse's share is half. Whether hypothetical costs of sale are deducted where no sale is happening is contested, and should be negotiated rather than assumed.
The lender sets the real constraint. The Fannie Mae Selling Guide treats a refinance that pays off the existing first mortgage and buys out a co owner as a limited cash out refinance, with the better pricing, only where all parties jointly owned the property for at least twelve months before the disbursement date. All parties sign a written agreement stating the terms of the transfer and the disposition of proceeds, the retaining spouse receives none of the proceeds, incidental cash back is capped at the greater of one percent of the new loan amount or 2,000 dollars, and the retaining spouse must qualify alone on income, credit and debt to income.
Title and loan are separate acts. Recording an interspousal transfer deed changes ownership and does nothing at all to the promissory note, which is a contract with a lender who is not a party to the divorce. Only a refinance, or an assumption with an express written release of liability from the servicer, removes a borrower. The Garn St Germain Act generally prevents acceleration on a divorce related transfer, which is precisely why the deed records without incident while the liability remains.
The honest downside is two sided here. Tax first: a transfer incident to divorce is not a taxable event under IRC section 1041 and the receiving spouse takes carryover basis, so the whole built in gain lands on the buying spouse, who may have only 250,000 dollars of exclusion at the eventual sale. Then the ground: the spouse who keeps a hillside house keeps the slope, the drainage and the association's future assessments, and those belong in the number rather than in an argument two years later.
Neutral Between Two People Who Disagree About What to Say
Paula Aragone has worked Orange County transactions for 23 years, across 900+ transactions and $900M+ sold, and she came to it after four years of law school. She holds the CPRES and SRES designations. That background is the reason family law attorneys refer dissolution listings here rather than to a general listing agent.
The representation is of the sale, not of either spouse. Both parties receive the same documents at the same time, in writing, including every offer, every price recommendation and every report that arrives. Neither party is advised on what to accept in the division, because that is their own counsel's work and doing it from this chair would remove the only quality that makes a two seller listing function.
In a hillside city the neutrality has a second job. Disclosure is where dissolution sellers most often accuse each other, and an agent who adopts one spouse's view of how much to say has joined the argument rather than managed it. The standard applied here is materiality, both parties sign the same documents, and the record shows that neither of them was told anything the other was not.
Nothing here is legal advice, and a listing agent is not a substitute for your own family law attorney. Character of property, Moore and Marsden analysis, Family Code 2640 tracing, Epstein and Watts accounting and the terms of any order authorising a sale are lawyer work. What this office contributes is the part outside the courtroom: the grading and association records pulled at listing rather than in escrow, a documented valuation, broad exposure, and a file neither side can later call arranged.
Laguna Niguel Divorce Sales, Answered Plainly
Questions the two parties usually ask separately, answered for California law and for a hillside city in particular.
Do we have to disclose that our house sits on graded fill?
If it is a material fact you know, yes, and the statutory form will not carry it for you. The Natural Hazard Disclosure Statement under Civil Code 1103.2 has six categories and none of them is a fill, compaction or grading category. What governs instead is the ordinary duty to disclose material facts within the seller's knowledge. In practice that means producing the documents: grading permits, soils and compaction reports, any repair, any retaining wall and any drainage change. Documents end the conversation. Characterisations start one.
Does the hazard disclosure form cover the 1998 Niguel Summit failure?
No. On 19 March 1998, after heavy El Nino rains, a hillside collapsed at Niguel Summit and destroyed approximately ten residences, and the investigation found the developer had improperly packed and graded the 275,000 tons of fill supporting them. None of the six statutory hazard categories reports that. It is also not a citywide fact: the failure attaches to specific tracts, and whether it reaches a particular address is a tract level question that has to be researched before anybody states it in either direction.
One of us wants to disclose more than the other. Who decides?
Neither of you decides by preference. The standard is materiality, and it is the same standard for both sellers because both of you sign the transfer disclosure statement. The workable method is one draft reviewed by both parties, differences resolved in writing rather than quietly reconciled, and the same documents delivered to the buyer from both of you. A buyer who receives two inconsistent seller accounts of a hillside property usually cancels rather than negotiates, which serves neither spouse.
Can one spouse list the house while the case is open?
No. Family Code 2040 restrains both parties from transferring, encumbering, hypothecating, concealing or in any way disposing of any property, whether community, quasi community or separate, without the written consent of the other party or an order of the court, and a family residence is not a transaction in the usual course of business. Family Code 1102 separately requires both spouses to join in any instrument by which community real property is sold, conveyed or encumbered. Both routes lead to the same place: two signatures, or an order.
When did the restraining orders begin to bind each of us?
Family Code 233 sets the two dates. The orders take effect against the petitioner on filing of the petition and issuance of the summons. They take effect against the respondent on personal service of the petition and summons, or on the respondent's waiver and acceptance of service. They remain in force until final judgment is entered, the petition is dismissed, or the court orders otherwise. The text is printed on the face of Judicial Council form FL-110 under the standard family law restraining orders heading.
What geotechnical records should we be asking for?
Ask for the grading permits and approvals for the parcel, any geotechnical investigation or soils report, the compaction reports for the pad, any record of repair to a slope, a wall or a drainage system, and anything the association holds on slope maintenance, including minutes and the reserve study. Request it in the first week and have the responses delivered to both spouses at the same time, so that no document reaches one party before the other.
I owned the house before we married. Does the community have a share?
Very likely, if community earnings paid the mortgage during the marriage. Family Code 770 keeps premarital property separate, but In re Marriage of Moore (1980) 28 Cal.3d 366 gives the community a proportional ownership interest where community funds reduced principal, and In re Marriage of Marsden (1982) 130 Cal.App.3d 426 awards appreciation before the marriage entirely to the owner spouse while sharing appreciation during the marriage. In re Marriage of Mohler (2020) 47 Cal.App.5th 788 fixes the community percentage as of separation.
I put separate money into the down payment. Is that reimbursed?
Yes, if it can be traced, and only in the original dollars. Family Code 2640 reimburses separate property contributions to the acquisition of community property, which includes down payments, payments for improvements and payments reducing loan principal, unless the right was waived in writing. Interest, maintenance, insurance and taxes are expressly excluded. The reimbursement carries no interest and no adjustment for change in monetary values, and it cannot exceed the net value of the property at the time of division.
Which date does the court use to value the house?
Family Code 2552(a) values the community estate as near as practicable to the time of trial. That is the default, not the date of separation and not the date of filing. Family Code 2552(b) allows an alternate date, after separation and before trial, only on thirty days notice by the moving party and for good cause shown, to accomplish an equitable division. On a hillside parcel the practical point is that an early opinion of value given without the geotechnical file will not hold.
What happens if one of us simply will not sign?
The court can appoint an elisor. Code of Civil Procedure section 128(a)(4) gives a court power to compel obedience to its judgments and orders, and Orange County Superior Court Local Rule 721 sets the procedure: a Request for Order, a supporting declaration listing the exact documents and describing good faith meet and confer efforts, and a proposed order designating the Clerk of the Court or Clerk Designee rather than a named employee, with copies of every document attached. The elisor signs what an existing order authorises, so the authorising order comes first.
Can the court order a sale over our objection?
It can, using Family Code 2550, 2601 and 2553 together: the duty to divide the community estate equally, the power to award an asset on conditions that produce a substantially equal division, and the power to make any orders necessary to carry that out. Sale is ordered where the estate cannot be divided equally any other way, where neither party can qualify to buy the other out, or where one party is dissipating the asset. After judgment, partition under Code of Civil Procedure title 10.5 is the alternative vehicle.
Can the sale wait until our child finishes at Niguel Hills?
That is a deferred sale of home order, a Duke order, under Family Code 3800 through 3810, named for In re Marriage of Duke (1980) 101 Cal.App.3d 152. The court first decides under 3801 whether it is economically feasible to keep up the note payments, taxes, insurance and the condition of the home during the deferral. It then applies the 3802(b) factors, among them the time the child has lived in the home, grade and school placement, and each parent's ability to obtain suitable housing. Under 3808 remarriage of the resident parent raises a rebuttable presumption against further deferral.
How is the money released when we cannot agree at the close?
It follows the written instructions and nothing else. Escrow is a limited agency, the escrow holder acts only on the specific written instructions of the principals, and once joint instructions are signed neither principal can change them alone. Faced with conflicting instructions the escrow holder is a neutral stakeholder, not a referee, and its remedy is to file an interpleader that deposits the funds with the court. Avoid that by writing the disbursement formula into the judgment and mirroring it word for word in the instructions.
What is our capital gains position if we sell now?
IRC section 121 excludes 250,000 dollars per individual and 500,000 dollars on a joint return where either spouse meets the ownership test, both meet the use test, and neither is disqualified by the two year look back. Both tests are met by twenty four months out of the five years ending on the date of sale. Two rules exist for divorcing couples: ownership tacks on a transfer incident to divorce, and use by a former spouse counts as your own where a written divorce or separation instrument grants that use. This is general information, not tax advice.
The house goes to my spouse in the judgment. Does my name come off the loan?
No. Title and debt are different things. A recorded interspousal transfer deed moves ownership, while the promissory note remains a contract with a lender who was never a party to your case. The obligation stays on your credit report and in your debt to income ratio until the loan is refinanced in the retaining spouse's name alone, or assumed with an express written release of liability from the servicer. The Consumer Financial Protection Bureau reported in December 2024 that servicers frequently decline assumptions and push borrowers to refinance.
There is a special assessment on the tax bill. What has to be delivered?
The notice from the agency that levies it. Civil Code 1102.6b requires the seller to make a good faith effort to obtain a disclosure notice from each local agency levying a Mello Roos special tax or a 1915 Act assessment and to deliver it to the buyer. The line item on the county tax bill is not that notice. Confirm the position by assessor's parcel number, then request the notice in writing.
