One City, Four Building Eras, Four Different Sales


Tustin runs from Craftsman bungalows to blocks finished in the last few years. The era decides the inspection, the assessments and the disclosure stack, and a trustee who prices across the city rather than inside the era is guessing in public.

The city's own Housing Element records that more than 56 percent of the housing stock was thirty years or older as of the 2011 American Community Survey, projected to reach about 62 percent by 2020, with roughly 17,324 units identified as requiring rehabilitation or continued maintenance as they crossed that line. Tustin is also more renter heavy than the county, at 47.4 percent renter occupied against 39.7 percent countywide. For a trustee that means two things: an older house than the marketing photographs suggest, and a buyer pool that includes investors reading the numbers differently from families.

Old Town is the pre 1940 band and the only real concentration of that stock in the city. Raised foundations, knob and tube remnants, galvanized supply lines, cast iron drains, original single glazed wood sash, lead paint on anything painted before 1978, and asbestos era materials throughout. Under floor access becomes a genuine inspection item here. Expect a historic resource or Mills Act question on some parcels, and expect the city to take an interest in exterior alterations that a trustee assumed were nobody's business.

The 1960s and 1970s band is the classic Tustin trust file. Tustin Meadows, built in 1968 by the Robert H. Grant Company on six floor plans, sits on slab, with galvanized supply at end of life, cast iron drains, original aluminium sliders, Federal Pacific or Zinsco panels plausible, and aluminium branch wiring live for anything permitted from 1965. Peppertree, 1973 to 1976, carries the same exposure with no association dues. Converted garages and unpermitted patio enclosures are the recurring permit problem in this stock.

Tustin Ranch, planned in 1982 and annexed in 1986, is the polybutylene band. Polybutylene supply piping was manufactured from 1978 to the middle of 1995, so the entire era is inside the window, and grey pipe behind drywall is the item that most often turns an agreed price into a repair negotiation. Panels are generally acceptable here. What produces claims instead is stucco and window flashing detailing of the period, plus original aluminium framed glazing that a buyer will price as a replacement.

Tustin Legacy, from the 2000s onward, rarely produces defect findings at all. Its friction is environmental and financial. The Navy began assessment of the base in 1980 and remediation continues under EPA, DTSC and Regional Water Quality Control Board oversight, with PFAS from firefighting foam the current focus and shallow groundwater plumes still present. Institutional controls are recorded. A Community Facilities District special tax sits on the same inventory. None of that shows up in a home inspection.

The practical consequence for a successor trustee is that the first specialist to call depends entirely on which era the house belongs to. In Old Town it is a foundation and a hazardous materials question. In Tustin Meadows and Peppertree it is a panel, a supply line and a permit history search. In Tustin Ranch it is a plumber with a camera. At Tustin Legacy it is a title officer and a records request, because everything that matters is on paper rather than in the walls.

How a Successor Trustee Sells a Tustin Property


The order is fixed partly by California law and partly by what a Tustin title report tends to carry. Two of these steps are routinely left until escrow, and those two are the ones that cost a month.

Read the instrument, then read every amendment

Establish who actually succeeds, whether two co trustees have to sign together, and whether the trust requires a written acceptance before anyone acts. Restatements override what the family remembers. A deed signed by one of two co trustees who were required to act jointly is a defect the title officer finds, and finding it after an offer is accepted costs the estate weeks it did not budget.

Probate Code 16061.7 requires service on every beneficiary and on every heir of the settlor, including the heir the trust cuts out. The notice carries a warning in at least ten point boldface, and serving it starts the 120 day contest period. Until it goes out that period has not begun, and an underwriter reading an unstarted clock will hold the file.

Record the succession against the Tustin parcel

An Affidavit of Death of Trustee, with a certified death certificate, goes on record with the Orange County Clerk Recorder, main office at 601 N. Ross Street in Santa Ana. Recording it before the listing means the chain of title already reads correctly when a buyer's title officer opens the file, rather than becoming a condition of closing.

Confirm the deed was actually changed

Plenty of Tustin homes were bought decades before the trust was written and the trust was never followed by a new deed. If title still stands in the settlor's own name the trustee cannot convey. Where written intent exists on a schedule or an assignment, a Probate Code 850 petition, the Heggstad petition from Estate of Heggstad (1993) 16 Cal.App.4th 943, is the route.

At Tustin Legacy this is the step that decides the timeline. The former MCAS Tustin remains under CERCLA oversight and institutional controls are enforced across the operable units to prevent exposure to contaminated groundwater. Expect a recorded covenant limiting shallow groundwater use or subsurface disturbance. Historic avigation easements can also survive on Legacy title and should be read, not assumed away.

Build the value inside the build era, not inside the city limits

Probate Code 16003 requires impartiality among beneficiaries and 16060 requires keeping them reasonably informed, which in practice means a number they can check line by line. A 1968 Tustin Meadows home, a Peppertree home with no association dues, a Tustin Ranch home on the golf course and a Columbus Square home carrying a special tax are four separate markets.

Assemble the environmental and fire record before a buyer asks for it

For Columbus Square, Columbus Grove, Greenwood and Tustin Field, the 7 November 2023 hangar fire is a disclosure item. Debris found, cleaning or testing performed, any result, and any insurance claim made are all material facts. A trustee who inherited the house and never tested says exactly that. The uncertainty itself is the disclosure and it reads better stated than implied.

Order the special tax notice and the association documents together

Tustin Legacy is financed through a Community Facilities District covering the MCAS Tustin redevelopment areas. Civil Code 1102.6b requires a good faith effort to obtain the notice from the levying agency and deliver it, and the line item on the tax bill is not that notice. Confirm the district by APN with the Orange County Treasurer Tax Collector before anything is marketed.

Sell it in the open, then account

Probate Code 16002 requires administration solely in the interest of the beneficiaries, and 16004 and 16005 forbid self dealing and personal profit. Open market exposure is how a trustee proves both. Escrow disburses to the trust rather than to individuals, the trustee accounts, and any distribution in kind is decided against the tax questions below before anyone moves in.

Built 1968 by the Robert H. Grant Company, roughly 900 to 935 homes on six floor plans with fifteen elevations, wrapped around the eight acre oval Centennial Park. Governed by the Tustin Meadows Community Association, so a resale packet is part of the timeline.

Peppertree

Built 1973 to 1976, detached single family, roughly 1,320 to 2,607 square feet, three to five bedrooms. No association dues, which removes the resale packet and removes the architectural approval question from anything a parent changed.

Laurelwood

A 1970s attached townhome community with its own homeowners association, one of the earliest planned attached communities in the city. Attached product raises reserve study and building envelope questions that a detached listing never has to answer.

Tustin Ranch

Planned by the Irvine Company in 1982, approved by the county and annexed in 1986, creating the 92782 ZIP code. Roughly 7,000 units planned, nearly all wrapped around the 165 acre golf course. Squarely inside the polybutylene window.

Tustin Legacy

The master plan for the 1,600 acre former MCAS Tustin. Modern construction and the heaviest disclosure stack in the city: recorded land use controls, continuing Navy remediation, and a Community Facilities District special tax.

Tustin Field I and II

Completed 2006, 565 combined units, the first residential delivery at Tustin Legacy. Old enough that trust files are now realistic here, new enough that the friction is environmental rather than mechanical.

Columbus Square

Completed 2013 alongside Columbus Grove, 1,540 combined units plus 240 senior apartments. Directly across from the hangar site and the neighbourhood hardest hit by the 2023 fire, which puts the fire record into every listing here.

Columbus Grove

Contemporary Legacy product oriented toward Irvine employment. Part of the tract lies inside Irvine, so a single named community splits across two cities for permits and across two districts for schools.

Greenwood

Tustin Legacy, completed 2017, 375 units. Inside the special tax district, inside the remediation area, and close enough to the hangar site that a buyer will ask about the 2023 debris.

Amalfi

Tustin Legacy, on Legacy Road and Tustin Ranch Road. Newer product where the preliminary title report, not the inspection report, is the document that decides how long the sale takes.

Southwest Tustin

Identified in the Housing Element as concentrating a large share of the city's lower income housing, with targeted graffiti removal, code enforcement and physical improvement programmes. The oldest, densest and most code enforcement intensive part of the city.

North Tustin, Lemon Heights and Cowan Heights

Unincorporated Orange County, not the City of Tustin. Large lots, custom hillside homes, county permitting, the county fire hazard map adopted by Ordinance No. 25-015 on 26 August 2025, and often septic rather than sewer.

Local buyers navigate this part of the city by school: the areas served by Peters Canyon, Ladera and Tustin Ranch elementaries, then Pioneer Middle and Beckman High. A valuation has to respect that geography or a beneficiary will challenge it.

Six Things That Stall a Tustin Trust Sale

None of these are about demand. Every one is a record that already existed and was not pulled in time.

The contest window was never opened

The trustee has sixty days from the settlor's death to serve the Probate Code 16061.7 notification on every beneficiary and every heir. Service is what starts the 120 day period in which the trust can be attacked. Skip the service and that period never begins.

Title underwriters treat a contest window that has not started as an open risk, and they are right to. Serving first and listing second is the cheapest month a trustee will ever buy.

Title still reads in mother's own name

It is one of the most common findings on a Tustin file, because so much of the housing was bought long before the trust was drafted. The settlor signed the trust, listed the house on a schedule, and never signed a deed.

Where the written intent exists, a Probate Code 850 petition confirms the property into the trust. Where it does not, the house goes to probate instead and the whole timeline changes. Either way, the discovery belongs before the listing, not inside escrow.

Institutional controls run with the Tustin Legacy land

The former MCAS Tustin is a CERCLA site. The fifth five year review opened in November 2025 covering Operable Units 1A, 1B, 3 and 4B, with VOCs in groundwater and soil including trichloroethene and 1,1 dichloroethene, and landfill contents at OU-3. Institutional controls are enforced across all operable units to prevent exposure to contaminated groundwater.

Those controls are land use restrictions recorded against the parcel. A Legacy seller should expect a covenant limiting shallow groundwater extraction or certain subsurface disturbance, and it is a material fact under Civil Code 1102. It belongs on the disclosure forms, not buried in the title exceptions for a buyer to find on day fourteen.

The hangar fire is a disclosure, not a memory

The fire began 7 November 2023, destroyed the North blimp hangar and smouldered for twenty four days. Released contaminants included asbestos, lead and arsenic, with debris measured at up to 37 percent asbestos, and material travelled more than three miles across roughly 10,000 homes in Tustin, Irvine and Santa Ana. Columbus Square was hardest hit.

Public agencies did not test inside residences. Of nineteen homes privately tested, nine showed asbestos. The Navy completed its required cleanup by September 2025 and asbestos air monitoring around the North Hangar was discontinued on 24 June 2025. A trustee sells what is known and what is not: debris reported or not, cleaning done or not, testing done or not, claim made or not.

The listing says Tustin and the permit counter says County

North Tustin, including Lemon Heights and Cowan Heights, is unincorporated Orange County. Permits come from the county, not from the Tustin Building Division at (714) 573-3130, and many parcels are on septic rather than sewer.

It also changes the fire obligations. Tustin was not among the five Orange County cities newly added under the March 2025 CAL FIRE maps, but unincorporated North Tustin falls under the county map adopted by Ordinance No. 25-015 on 26 August 2025, which includes Very High zones. A North Tustin seller can owe AB 38 defensible space documentation that a City of Tustin seller does not.

The special tax was read off the tax bill

Tustin Legacy is financed through a Community Facilities District covering the MCAS Tustin redevelopment areas including Columbus Grove, Columbus Square and Tustin Field, and Tustin Unified separately maintains district information for school facilities financing.

Civil Code 1102.6b requires the seller to make a good faith effort to obtain the notice from each levying agency and deliver it. The tax bill line is not that notice. Confirm the district and the amount by APN with the Orange County Treasurer Tax Collector, and remember that Old Town, Tustin Meadows, Peppertree and most of Tustin Ranch predate the practice entirely.

The fork

Sell the Tustin House, or Move a Child Into It


Two tax rules point in opposite directions. The gap between the parent's assessed value and today's value decides which is worth more, and so does how long the child would genuinely stay.

The basis rule rewards selling, and it rewards selling early

Under IRC section 1014 the basis of property acquired from a decedent becomes its fair market value at the date of death. A house bought in Tustin Meadows in 1968 and held ever since carries almost sixty years of appreciation, and for income tax purposes that entire history disappears at death. Gain is measured only from the date of death forward.

Where the house was held as community property by a married couple, IRC 1014(b)(6) resets both halves at the first death, not only the deceased spouse's half. That is a California result that does not exist in most states and it is worth confirming how title was actually held before anyone assumes.

Holding period is not a trap either. IRC 1223(9) treats property that takes its basis under section 1014 as held more than one year when it is sold within a year of death, so long term rates apply even on a quick sale.

All of it rests on a qualified date of death appraisal. Without one the value can be argued down years later and gain appears where the family was told there was none. On a Legacy parcel that appraisal also has to account for the special tax and the recorded controls, because both affect what a buyer would actually pay.

Proposition 19 rewards keeping it, on conditions most families miss

For transfers on or after 16 February 2021, the parent to child exclusion reaches only a family home that was the parent's principal residence and becomes the child's principal residence, or a family farm. A rental or a second home is fully reassessed. If the child does not move in, there is no exclusion at all, and the old Proposition 58 treatment of other real property is gone.

The deadlines are short and they are separate. The child must claim the homeowners' exemption within one year of the transfer or the date of death, and the exclusion claim itself, form BOE-19-P, is due within three years of death or transfer, or before any transfer to a third party, whichever comes first.

The exclusion is capped. The protected amount is the parent's factored base year value plus 1,044,586 dollars for transfers between 16 February 2025 and 15 February 2027. Above that sum the new taxable value is market value minus the adjusted amount. On a Tustin Legacy home the child then carries that assessment plus the Community Facilities District special tax, which is the part families forget when they compare the annual cost of keeping to the cost of buying.

The conflict worth naming out loud: IRC section 121 needs twenty four months of ownership and twenty four months of use within the five years before sale. A child who moves in only to hold the parent's tax base and sells at month twenty gets neither the section 121 exclusion nor the clean early sale the basis rule offered. Decide before anyone moves, not after.

In Tustin that record has particular content. A valuation built inside the correct build era and the correct school geography, a documented environmental and fire disclosure for a Legacy parcel, the special tax notice obtained from the levying agency rather than copied off a tax bill, and a written trail of every offer received. Each of those is a question a beneficiary can ask two years later, and each of them has a document behind it.

If a beneficiary objects, the petition is filed under Probate Code 17200 and the remedies in 16420 include enjoining the trustee, removing them, setting acts aside and denying compensation. But Probate Code 18100 fully protects a buyer who dealt with the trustee in good faith, for value and without actual knowledge of any impropriety, so a closed sale is rarely undone. The practical exposure lands on the trustee personally, in money and in removal. The record is what answers it.

What successor trustees and beneficiaries ask in this city, answered against California law and against what a Tustin title report actually carries.

Is a court hearing required to sell a Tustin house out of a trust?

No. Probate Code 17209 provides that trust administration is intended to proceed expeditiously and free of judicial intervention. There is no confirmation hearing, no requirement that a price reach ninety percent of an appraisal, and nobody can overbid in a courtroom. The successor trustee sells under the power granted by Probate Code 16226 and by the trust instrument itself. Underwriters still often ask, which makes it a negotiation rather than an obligation.

When does the sixty day notice have to go out?

Within sixty days of the trust becoming irrevocable, which for most Tustin families is the date of the settlor's death, or within sixty days of the trustee learning of someone entitled to notice. Probate Code 16061.7 requires service on every beneficiary and on every heir of the deceased settlor, including an heir the trust deliberately leaves out. Serving it is administrative. Not serving it is what leaves the file exposed.

Why does the title company care about a contest period?

Because the clock only runs once the notice is served. The 16061.7 notification must carry a warning in at least ten point boldface that no action to contest the trust may be brought more than 120 days from service, or sixty days from delivery of a copy of the trust terms within that period, whichever is later. Yes, and specifically rather than generally. Is the PFAS investigation at Tustin Legacy something a seller has to talk about?

It is a known fact about the site and a trustee is better off stating it than being asked. PFAS from aqueous film forming foam used in burn pit exercises, hangar suppression and crash training has been detected in shallow groundwater above EPA drinking water standards. The city's position is that there is no drinking water pathway, because the shallow groundwater is not used for drinking water and the Irvine Ranch Water District supplies PFAS free drinking water. The house is in North Tustin. Is that the same as Tustin?

No, and the difference is practical. North Tustin, including Lemon Heights and Cowan Heights, is unincorporated Orange County. Permits and records come from the county rather than the Tustin Building Division, many parcels are on septic rather than sewer, and the fire hazard rules differ: the county adopted its map by Ordinance No. 25-015 on 26 August 2025, which includes Very High zones, while the City of Tustin was not among the five Orange County cities newly added under the March 2025 CAL FIRE maps. A listing that calls it simply Tustin is misleading the buyer about who issues permits.

Does Old Town's historic character affect a trust sale?

Beckman High, plus Legacy Magnet Academy at Tustin Legacy. Irvine Unified serves some parts of Tustin, which is the mirror image of the boundary problem across the freeway. Boundaries also move. Confirm by address with the district before any of it appears in marketing, because a buyer who wrote an offer on the wrong assumption cancels and the trustee absorbs the time.

Is Tustin inside an airport influence area?

Yes. Tustin sits inside the John Wayne Airport Airport Environs Land Use Plan planning area. Where a tract map or deed carries the notice language because the property was mapped within the noise impact zones, that notice is delivered with the other disclosures. Separately, the former MCAS Tustin airfield is closed and generates no current AELUP obligation, but historic avigation easements can still appear on title in the Legacy area. Read them rather than assuming they were extinguished when the base closed.

Can one beneficiary block the sale of the Tustin house?

Rarely, and almost never once escrow has closed. A beneficiary petitions under Probate Code 17200, and the remedies in 16420 include compelling redress, enjoining a breach, removing the trustee and denying compensation.
