That grid is why the Village builds the way it does today, with homes to the property line, almost no side yard, and neighbours far closer than a buyer touring on a quiet Wednesday expects.
Lot sizes vary in practice, some near 2,700 square feet and some near 3,500, and a large share of Village parcels carry two units on one lot. Those pairs are frequently held without a formal association, without a management company and without a reserve account, with shared insurance and maintenance coordinated directly between the two owners. For a trustee that is a title and disclosure item on every duplex sale, and it is almost never documented anywhere the estate can find it.
The envelope rule compounds it. Floor area in Corona del Mar is limited to 1.5 times buildable lot area, against 2.0 in general R-1 areas of the city. How a Trust Property Sale Works in Corona del Mar
The legal sequence is set by California law. What changes here is the middle of it, because a Village parcel raises questions about the lot and the second unit that a hillside tract never raises at all.
Establish the trustee's authority, and whether it is shared
Read the trust and every amendment to see who succeeds, whether co trustees must act jointly, and whether a written acceptance is required. Where the family split a Village duplex between two children in the same instrument, establish early whether the trustee can convey the whole parcel or only the interest the trust actually holds. Title will find that distinction whether or not the family raises it.
Notify every beneficiary and every heir within sixty days
Within sixty days of the trust becoming irrevocable, serve every beneficiary and every heir of the deceased settlor, including an heir the trust disinherits. The notice carries the statutory warning in ten point boldface and starts the 120 day contest period. Confirm what the trust actually holds on that lot
If title stands in the settlor's individual name the trustee cannot convey. Where written intent exists, the route is a Probate Code 850 petition, the Heggstad petition named for Estate of Heggstad (1993) 16 Cal.App.4th 943. On a Village parcel carrying two units, check whether both units, or only one, ever reached the trust. That is the single most expensive thing to discover in escrow here.

Six Things That Stall a Corona del Mar Trust File

Most of them come from decisions made on this land in 1904 and never revisited, and one of them from a conversation between two neighbours that nobody wrote down.
Two units, one lot, and no association to ask
In the Village this is the recurring problem. Two units sit on a single parcel with no formal association, no management company and no reserve account, and the insurance and maintenance arrangement lives entirely in an understanding between the two owners.
When one of those owners dies, the understanding dies with them. A trustee who cannot say who insures the structure, who has been paying for the roof and who maintains the party wall is asking a buyer to accept an unpriced risk. Get it documented before listing, not during the buyer's inquiry period.
Only one half of the duplex ever reached the trust
It is a specific version of a general problem. The settlor signed the trust, listed the Corona del Mar property, and either never signed a deed or signed one covering an interest that no longer matches how title reads.
Where the written intent exists, a Probate Code 850 petition, the Heggstad petition, confirms the property into the trust. Where it does not, that portion goes through probate, which means two different procedures running against one parcel and one escrow.

The bluff report the estate does not have

There is a second layer. Those parcels sit inside the coastal appeal band running within 300 feet of a coastal bluff top or bluff face, which puts a city coastal development permit within the Coastal Commission's reach on a ten working day appeal window. That is a buyer's remodel timeline question, and it belongs in the conversation early.
A Village parcel cannot obtain a new lodging permit
No new short term lodging permit has been issued for R-1 single family property in the city since 1 June 2004, which covers most of the Village's single family parcels. An estate that assumed rental income was available is working from a premise the code removed twenty years ago.

Buck Gully and Morning Canyon picked up a zone in 2025
The City Council adopted the updated CAL FIRE maps on 8 July 2025, and for the first time the local responsibility area maps carry Moderate and High classifications as well as Very High. The canyon edges at Buck Gully and Morning Canyon are the Corona del Mar parcels most likely to have moved.
A High or Very High designation brings AB 38 defensible space documentation under Civil Code 1102.19 and a Natural Hazard Disclosure finding that was not there on the last sale. Newport Beach runs its own fire department, so that documentation comes through the city rather than the Orange County Fire Authority.
Sell the Corona del Mar Property, or Let a Child Move In
Two rules point in opposite directions, and on a Village parcel with two units the answer is not even the same for the whole property.
Why the basis reset argues for a sale
Basis resets to fair market value at the date of death under IRC section 1014, so the appreciation on a lot the family has held since the 1950s or 1960s disappears for income tax purposes. Gain is measured only from the date of death forward, which is why a sale soon after death often produces close to no gain and sometimes a small loss after costs.
Where the property was held as community property by a married couple, IRC 1014(b)(6) steps up both halves at the first death rather than only the decedent's half. In Cameo Shores or Irvine Terrace, where original purchasers from the late 1950s are exactly the families now settling trusts, that is the whole arithmetic.
Holding period is not a trap. Under IRC 1223(9), property taking its basis from section 1014 and sold within a year of death is treated as long term regardless of the actual holding period, so a fast sale is not punished with a short term rate.
The protection is a qualified date of death appraisal, and on a two unit Village parcel it has to value what is actually there, including the rented unit and the condition of the shared elements. Without a documented appraisal the value can be argued down later and gain appears where there was none.
Keeping it is what Proposition 19 rewards, on narrow terms
For transfers on or after 16 February 2021 the parent to child exclusion applies only to a family home that was the transferor's principal residence and becomes the transferee's principal residence. Proposition 19 eliminated the former exclusion for other real property, so a Village unit the parents rented out is not covered by the same reasoning as the unit they lived in.
That distinction matters here more than in most of Orange County, because so many Corona del Mar parcels carry two units. Do not assume a whole parcel qualifies because the parents lived on part of it. Ask the Orange County Assessor how they treat the specific parcel before anyone relies on a figure.
The deadlines are unforgiving. The child must claim the homeowners' exemption within one year of the transfer or the date of death, and file form BOE-19-P within three years or before any transfer to a third party, whichever comes first. The cap is the parent's factored base year value plus an adjusted amount, currently 1,044,586 dollars for transfers between 16 February 2025 and 15 February 2027. Above that sum the new taxable value is market value minus the adjusted amount.
The counterweight: a child who moves in only to hold the tax base and sells at month twenty gets neither the section 121 exclusion, which needs twenty four months of ownership and use out of the five years before sale, nor the clean sale the basis rule offered at the start. In a Village duplex the same child also inherits the undocumented arrangement with the neighbour. Decide before anyone moves, not after.
A Trustee Is Personally Exposed. The Listing Should Reduce That, Not Add To It.

The duties a successor trustee carries are specific. Probate Code 16002 requires administration solely in the interest of the beneficiaries. Probate Code 16003 requires impartiality among them. Probate Code 16004 and 16005 prohibit self dealing and personal profit. Probate Code 16060 requires keeping beneficiaries reasonably informed. Litigation between beneficiaries and trustees almost never starts over the sale price. It starts over a sale that looked arranged: a quiet off market transaction, a purchase by a relative, or a valuation nobody can reconstruct.
Corona del Mar produces a particular version of that argument. Where one beneficiary has been living in the second unit, or where the family assumed the duplex would simply pass to whoever wanted it, the trustee is being asked to favour one beneficiary over another before the property is ever valued. Impartiality under 16003 is not a preference in that situation, it is a duty, and the way it is met is a documented valuation and an open market rather than a family arrangement.
A beneficiary who objects petitions under Probate Code 17200, and the remedies in 16420 include enjoining the trustee and removing them. But Probate Code 18100 protects a buyer who deals with the trustee in good faith, for value and without actual knowledge of any impropriety, so a closed sale is rarely undone. To stop one, a beneficiary must obtain an injunction before closing and record a lis pendens. The practical exposure is money against the trustee personally, plus removal and denial of compensation. That is the risk the record is built to answer.

Only half the duplex is in the trust. What do we do?
The trustee can convey only what the trust holds. Where the settlor's written intent to hold the whole parcel in trust is documented, on a schedule of assets, an assignment or a general transfer, the route is a petition under Probate Code 850, commonly called a Heggstad petition after Estate of Heggstad (1993) 16 Cal.App.4th 943, where a written declaration naming the settlor as trustee was held sufficient without a separate deed. Where no such writing exists, that interest goes through probate and two procedures now run against one parcel.
How long do I have to notify the beneficiaries?
Sixty days from the date the trust became irrevocable, which for most families is the settlor's death. Probate Code 16061.7 requires service on every beneficiary and on every heir of the deceased settlor, including an heir the trust leaves nothing to. The notice must carry a warning in at least ten point boldface that no action to contest may be brought more than 120 days from service, or sixty days from delivery of the trust terms within that period, whichever is later. Not necessarily. Newport Beach issues most coastal development permits under its 2017 Local Coastal Program, but development within 300 feet of a coastal bluff top or bluff face, between the sea and the first public road paralleling the sea, or within 300 feet of the inland extent of any beach falls in the appealable band, with a ten working day appeal window to the Commission from the Notice of Final Action. The Commission also keeps original jurisdiction over tidelands and submerged lands. For a buyer planning work, that is a timeline fact worth raising early.
Can the buyer short term rent a Village house?
Almost certainly not on a new permit. No new short term lodging permit has been issued for R-1 single family property in the city since 1 June 2004, renewals of previously permitted units excepted, and Municipal Code Chapter 5.95 caps permits at 1,550 citywide with a waiting list. Where a legacy permit exists it can transfer, but only if a transfer application is filed within sixty days of title transfer to a bona fide purchaser for value. Confirm which situation applies before the property is marketed on rental potential.
Does Mello Roos apply in Corona del Mar?
Generally not, in contrast to Newport Coast next door, but that is a lead rather than an answer. Check the parcel against the county's Community Facilities District map and the tax bill by assessor's parcel number. Where a district does apply, Civil Code 1102.6b requires the seller to make a good faith effort to obtain a disclosure notice from each levying agency and deliver it to the buyer. The line item on the tax bill is not that notice, and relying on it is a disclosure defect rather than a shortcut.
Which schools serve a Corona del Mar trust property?
Newport Mesa Unified. The names buyers ask about are Harbor View Elementary, Lincoln Elementary, Corona del Mar Middle and High School, which runs grades seven to twelve on one campus, and Andersen Elementary on the Port Streets side. Attendance boundaries do not follow neighbourhood names and they move, so verify by address with the district's school locator before any of it appears in marketing. A buyer who wrote an offer on an assumption and found otherwise will cancel, and the estate absorbs the lost weeks.
Can a beneficiary stop me from selling?
Rarely, and almost never after closing. A beneficiary petitions under Probate Code 17200 and the remedies in 16420 include compelling redress, enjoining a breach, removing the trustee and reducing or denying compensation. But Probate Code 18100 fully protects a third person who dealt with the trustee in good faith, for valuable consideration and without actual knowledge that the trustee exceeded its powers. One of my siblings lives in the second unit and wants to buy the property. Can I sell it to them?
You can, and it is the most common request in a Corona del Mar duplex file, but it is also the transaction most likely to be attacked later. Probate Code 16002 requires administration solely in the interest of the beneficiaries and 16003 requires impartiality among them. Expose the property to the market, document the value including the occupied unit, keep every offer in writing, and disclose the buying beneficiary's interest to the others in writing. A sale that was fair but undocumented is very hard to defend two years later.
Will the estate pay capital gains on a Village sale?
Usually very little. Under IRC section 1014 the basis resets to fair market value at the date of death, so gain is measured only from that date forward.
