Divorce Real Estate Agent in Huntington Beach, CA
Paula Aragone handles Huntington Beach dissolution listings where the two owners no longer agree, from the restraining orders on the summons through the well records, the coastal permit path and the dock rights that have to be identified before anyone proposes a number. The representation is of the sale, not of either party.
A Huntington Beach house cannot be listed on one signature while a dissolution is pending. Family Code 2040, printed on Judicial Council form FL-110, restrains both parties from transferring, encumbering, hypothecating, concealing or disposing of any property, and lifts only on written consent or a court order. What is under the parcel and what governs building on it come next, because a century of oil production and a coastal permit boundary both sit beneath this city's housing.

A Century of Drilling Sits Under the Housing, and It Is on Record
Every city on this coast has old houses. Huntington Beach is the one where the ground itself carries a regulatory file, and where a second permit authority decides what can be built on top of it.
The Huntington Beach Oil Field has produced since 1920, when the Huntington A-1 well came in on 24 May; by October 1921 the field had 59 producing wells. Cumulative production passed one billion barrels of oil and 845 billion cubic feet of gas by 2000, USGS estimated 117 to 866 million barrels remaining in 2013, and the field is operated today by California Resources Corporation. The boom physically relocated houses out of the drilling path six miles north to Midway City in 1921 and 1922, and the city was then built over the top of the field.
The city regulates the consequence directly. A Methane Mitigation District is administered by the Fire Department, and where abandoned oil wells sit within one hundred feet of the footprint of a structure, any new structure must be equipped with a methane barrier in accordance with City Specification 429, issued in October 2022 in place of the March 2016 version and codified through the building code amendments at Municipal Code section 17.04.170, Chapter 55. The parallel requirement is City Specification 431-92, Soil Clean Up Standards, under which soil sampling and laboratory analysis must show compliance before a grading or building permit issues, with a work plan approved by the Fire Department before sampling and a Remediation Action Plan if contamination is found.
Three facts follow for two owners dividing a house. Many wells were abandoned to standards long since superseded, so re abandonment to current CalGEM standards is routinely required before new construction or a major addition, at the owner's cost. An existing house built before the barrier requirement has no barrier and no vent system, and a buyer who learns about the well after opening escrow will ask why nobody said so. And the well location records for the oldest wells are the least accurate, which means a records search that finds nothing is not proof that there is nothing.
The second authority is coastal. The city has a certified Local Coastal Program, with the Coastal Element first certified in 1985 and last comprehensively updated in 2001. Municipal Code Chapter 245 requires a Coastal Development Permit for development in the coastal zone unless exempted or categorically excluded, and the practical trigger is the ten percent threshold: maintenance, alteration or an addition that does not increase floor area or height by ten percent or more is exempt in appealable areas, and anything above that is not. A prior owner who added more than that on an appealable parcel without a coastal permit has work that cannot be legalised with a building permit alone. Of the eight specific plan areas in the coastal zone, six are certified and two are not: Brightwater and Sunset Beach.
The Harbour adds a third layer. Dock permits are regulated by the California State Lands Commission and by the city, a buyer has to verify that the existing permit is current and transferable, and some properties carry dock rights with no dock built, which means new construction and a new permitting process rather than an existing asset. There is a Huntington Harbour Property Owners Association and, separately, tract level associations such as the association for Tract 5775, plus gated sub communities like Coral Cay with associations of their own. No single master association covers all five islands, so this has to be read off the preliminary title report and the recorded documents rather than off the neighbourhood name.
The honest difficulties are the ordinary ones made sharper by salt and by age. Sixty one percent of the housing stock was built before 1970, and 76 percent of owner occupied units before 1980, so galvanised supply lines, cast iron drains, Federal Pacific and Zinsco panels and aluminium branch wiring in anything permitted from 1965 are the norm rather than the exception, with fifty years of marine air working on all of it. A 2007 survey identified about 4,773 units rated fair to poor. Four elementary districts feed one high school district, so no school assignment can be read off an address. And in March 2025 the city was newly mapped into Moderate and High fire hazard severity zones for the first time. The one genuine relief is that Huntington Beach sits outside the John Wayne Airport influence area that reaches its neighbours.
How a Huntington Beach Home Is Sold During a Dissolution
Two questions decide the calendar in this city: what the ground under the house has on record, and which authority governs work on it. Answer both before valuation, because in a dissolution a fact discovered late is also an argument about who should have found it.
Fix the date the orders reached each of you
Family Code 233 makes the restraining orders effective against the petitioner on filing of the petition and issuance of the summons, and against the respondent on personal service or on a waiver and acceptance of service. They remain in force until final judgment, dismissal or a further order. Establish that first, because it decides what either party may lawfully do without the other.
Get the authority to list in writing
A family residence is not sold in the usual course of business, so the sale needs the written consent of the other party or a court order. An order escrow can act on names the property and its legal description, the broker, the list price and the power to reduce it, who may accept an offer, who signs each instrument, and how the proceeds are disbursed.
Run the parcel through CalGEM and the Fire Department file
The CalGEM Well Finder maps oil and gas wells statewide and is searchable by address, coordinates or API number, updating nightly, but the agency provides the data without warranty of accuracy or completeness. Pair it with a Fire Department records check, because the city holds the methane barrier, soil sampling and remediation file that CalGEM does not.
Establish which authority governs work on the parcel
Under Municipal Code Chapter 245 a Coastal Development Permit is required for development in the coastal zone unless exempted or categorically excluded, and the city issues most of them while the Coastal Commission keeps authority over tidelands, submerged lands and public trust lands. Development is appealable if it sits between the sea and the first public road or within three hundred feet inland.
Name the dock, the slip and the associations separately
In Huntington Harbour dock permits are regulated by the California State Lands Commission and the city, and a permit has to be confirmed current and transferable. Some parcels carry dock rights with no dock built. There is no single master association across the five islands, so association exposure is established from the preliminary title report parcel by parcel.
Settle character, then instruct one appraiser
Family Code 760 makes property acquired during marriage community, 770 makes what was owned before marriage separate, and 2581 presumes joint title taken during marriage is community. Once counsel has fixed that, one jointly instructed appraiser values the property under Family Code 2552, with the well, coastal and dock answers already in the file rather than arriving later.
Market it openly, on a single channel
Broad exposure protects both parties, because a quiet sale at a soft number is the transaction each side will later say the other arranged. Agree in writing who holds the showing calendar, who approves a price reduction and how a disagreement is resolved. Where one party still occupies the house, access terms belong in the order rather than in messages.
Put a written threshold on acceptance
Every counter, every repair request and every extension needs the same two signatures the listing needed. Agree a written threshold in advance: a price at or above which acceptance is automatic, a fixed response window, and a named tiebreaker. Without one, a three day response becomes a fortnight of correspondence and a buyer with other options leaves.
Pay out only on instructions you both signed
Escrow acts only on the written instructions both principals signed, and neither can change them alone. Conflicting instructions are not resolved by the escrow holder; it interpleads and the funds go to the court. Have the judgment state the disbursement formula, have the escrow instructions repeat it word for word, and handle form 593 withholding in the same document.
Huntington Beach Neighbourhoods, and What Each Puts on the Table
Whether the file carries a well record, a coastal permit question, a dock permit, a tract association or all four depends on where in the city the house sits. These are the areas that come up most often.
Downtown Huntington Beach
The pier district and Main Street, mixed vintage from historic cottages to modern three story infill on narrow twenty five foot lots. Converted garages and additions are concentrated here and they collide with parking requirements, which is a common permit denial path.
Huntington Harbour
680 acres in the northwest, begun in 1963 by dredging and filling the Sunset Bay estuary, with waterways fifteen to twenty feet deep under a five mile per hour no wake limit and most homes built between the 1960s and the late 1970s.
Admiralty Island
About 90 to 95 custom residences, nearly all waterfront and not gated, on Channel Lane and Easter Circle. Seawalls, bulkheads, dock piles and gangways are the expensive items and they need inspecting before either party agrees a number.
Davenport Island
Roughly 227 to 237 home sites, about half of them waterfront, on spacious lots along quiet canals and not gated. Whether the dock permit is current and transferable is a separate question from the condition of the house.
Gilbert Island
About 95 to 100 home sites, roughly two thirds waterfront, not gated, on Mariana Circle and Somerset Lane. On a compact island a quiet off market sale is highly visible, which is one more reason to run a contested listing in the open.
Humboldt Island
The largest of the islands at about 335 homes, two thirds waterfront, looking out to Christiana Bay, on Ardsley Circle and Mistral Drive. Association exposure still has to be read parcel by parcel from the title report.
Trinidad Island
About 218 residences, the most consistently high end of the five islands, with private boat slips standard, on Aquarius Drive and Ragtime Circle. Slips and dock rights belong in the judgment as named items, not folded into the parcel.
Coral Cay
A gated non island waterfront community of about 125 units inside Huntington Harbour, with Belvedere and Eastcastle models and its own association. Two sets of governing documents means two document orders when both parties must approve each request.
Seacliff and Holly Seacliff
About 1.2 square miles of planned neighbourhoods on the bluff, lower Seacliff from the 1970s and upper Seacliff from the 1980s onward, predominantly guarded gate enclaves anchored by The Huntington Club golf course.
The Estates, The Peninsula, The Boardwalk and St. Augustine
The other gated enclaves inside the Seacliff area, with The Peninsula at Huntington Seacliff dating from the late 1990s. Modern systems, so the friction here is documentary and coastal rather than mechanical.
Surfcrest
115 gated tri level condominiums built between 1995 and 1997, one block from the sand, each with a two car garage and a private patio. Attached product close to the shoreline puts both association records and the coastal question in the same file.
Edwards Hill
Inland luxury on the largest private lots in the city with quiet cul de sacs and equestrian adjacency, taking in The Bluffs, Triple Crown Estates, Heritage, Central Park Estates, Country View Estates and The Hamptons.
Brightwater
About 356 homes on the northeast corner of the Bolsa Chica Mesa bordering the ecological reserve, with Capri, Seaglass, Azurene, The Trails, The Sands, The Breakers and Sandover. Its specific plan is one of the two in the coastal zone that are not certified.
Bolsa Chica area
Beside the roughly 1,300 acre Bolsa Chica Ecological Reserve, with ranch style homes, condominiums and age restricted mobile home communities including Skandia Mobile Country Club. Age restricted communities add an eligibility question to any plan to keep the property.
Oak View
One square mile inland near Slater Avenue and Beach Boulevard, predominantly 1960s construction with single family alongside condominiums, roughly ninety percent renter occupied, served by Golden View Elementary, Mesa View Middle and Ocean View High.
Pacific Ranch, Ocean Colony and Beachwalk
Guard gated and attached communities, with Pacific Ranch holding 558 units on over forty acres and Beachwalk a 1973 planned unit development about half a mile from the pier. Reserve studies and envelope questions arrive with the resale documents.
Sunset Beach
Formerly unincorporated and annexed by the city, with a wide beach and a distinct coastal permitting status, because its specific plan and Local Coastal Program are not certified and a review board still advises the city on discretionary actions.
Southeast Huntington Beach
Primarily 1950s to 1970s single family with real yards plus newer condominiums, and the most active resale inventory in the city. It is also one of the four areas the city identified for concentrated code enforcement.
Six Findings That Reset a Huntington Beach Timeline
Huntington Beach, California
None of these are market problems. Each is a record held by the city, the state or the county that decides what can be sold, and what has to be said about it first.
An abandoned well sits inside the hundred foot line
The city requires a methane barrier under City Specification 429 for a new structure where abandoned oil wells lie within one hundred feet of the building footprint, administered by the Fire Department through the Methane Mitigation District.
A house that predates the requirement has no barrier and no vent system, which is not a defect but is certainly a question. It becomes a dissolution problem when it surfaces after acceptance, because the response, whether that is testing, disclosure or a price adjustment, needs agreement from two parties who are already using lawyers to talk to each other.
The addition needed a coastal permit as well as a building permit
Under Municipal Code Chapter 245, maintenance, alteration or an addition that does not increase floor area or height by ten percent or more is exempt in appealable areas. Above that threshold a Coastal Development Permit is required, and development is appealable to the Coastal Commission where it sits between the sea and the first public road or within three hundred feet inland.
So work that a prior owner completed with a building permit alone cannot always be legalised after the fact by a building permit alone. Pull three files before listing anything near the shoreline: the Building Division jacket and plans, the Fire Department parcel file, and the Planning Division coastal file that shows whether a permit issued or the work was claimed as exempt.
The dock rights were assumed to be a dock
Some Harbour properties carry dock rights with no dock built, which means a new structure and a new permitting process rather than an existing asset. Where a dock does exist, the permit is regulated by the California State Lands Commission and the city and has to be confirmed current and transferable, and channel depth varies by location.
In a dissolution these are divisible interests, so they need to be identified and assigned in the judgment alongside the parcel. A judgment that divides the real property and says nothing about a slip or a permit leaves an asset undivided, which is a post judgment motion waiting to be filed.
Nobody checked whether the specific plan is certified
Of the eight specific plan areas in the coastal zone, six are certified and two are not: Brightwater and Sunset Beach. Certification status is what determines who issues a permit, and the Sunset Beach Local Coastal Program Review Board still advises the city on discretionary actions implementing that plan.
A seller in either area should confirm the current permitting path with the Planning Division rather than assuming the city handles everything. Getting that answer in writing early and sending it to both attorneys removes a whole category of argument about who was supposed to check.
Soil had to be tested before any permit would issue
City Specification 431-92 requires soil sampling and laboratory analysis showing compliance before a grading or building permit issues. A qualified environmental consultant prepares a Soil Sampling Work Plan for Fire Department approval before sampling begins, a Remediation Action Plan follows if contamination is found, and all imported soil must meet the same standards with approved sourcing documentation.
That is a real expenditure on an uncertain schedule, and Family Code 2040 requires each party to notify the other of proposed extraordinary expenditures at least five business days before incurring them and to account to the court. Agree who authorises and who funds this work before it becomes urgent.
The school assignment was read off the address
Four elementary districts feed one high school district here, which is unusual and confuses buyers. Huntington Beach Union High School District takes students from Fountain Valley, Huntington Beach City, Ocean View and Westminster elementary districts, and the high schools buyers name are Huntington Beach, Edison, Marina, Ocean View and Fountain Valley.
A single address can therefore pair an elementary school in one district with a high school in another. Run the address through the district locator, put the answer in writing, and let both households and both attorneys work from the same document rather than from two confident guesses.
Sell It, or Take On the Ground Underneath Alone
Two outcomes, and in this city the second one carries an extra parcel of responsibility: the well file, the coastal history and the dock permit all stay with whoever stays.
Sell the house
A sale converts a contested asset into a number, and a number can be divided under Family Code 2550 without either party depending on the other afterwards. On a Harbour parcel it also moves the dock permit through the city and State Lands Commission process to a third party, which retires an interest that would otherwise sit half divided in the judgment and reappear years later.
The tax position is usually better while the marriage is intact. Under IRC section 121 the exclusion is 250,000 dollars per individual taxpayer and 500,000 dollars on a joint return where either spouse meets the ownership test, both meet the use test, and neither is disqualified by the two year look back. Both tests run on twenty four months out of the five years ending on the date of sale, so selling while still married and filing jointly in the year of sale can preserve the whole 500,000 dollars.
The mechanics need designing before escrow opens. Both parties sign the escrow instructions and both must sign any amendment. If they later give conflicting instructions the escrow holder does not choose between them, it interpleads and the funds sit with the court. State withholding runs at a standard 3 1/3 percent of the sales price on form 593 unless an exemption applies, including certification that the property qualified as a principal residence under section 121.
The honest downside: a sale is public, it runs at the speed of two signatures, and on an older coastal house the inspection report is long at exactly the moment two people are least able to agree who pays for what. Where children are settled in one of the four elementary districts, moving twice is a real cost, and Family Code 3802 lets a court weigh school placement and the emotional detriment of a move on a request to defer the sale.
One spouse buys the other out
The arithmetic starts with fair market value at the applicable date, less encumbrances, which gives gross equity. Any Family Code 2640 reimbursement for traced separate property contributions comes off the top, along with any separate interest under Moore and Marsden, adjusted for Epstein credits and Watts charges. The remainder is community equity and each spouse's interest is half. Whether hypothetical costs of sale are deducted when no sale is happening is contested, so treat it as negotiable.
The lender is where this either works or ends. Under the Fannie Mae Selling Guide a refinance that pays off the existing first mortgage and buys out a co owner is treated as a limited cash out refinance, with better pricing, only where the property was jointly owned by all parties for at least twelve months before disbursement. All parties must sign a written agreement stating the terms of the transfer and the disposition of proceeds, the retaining spouse may not receive any of those proceeds, incidental cash back is capped at the greater of one percent of the new loan amount or 2,000 dollars, and the retaining spouse must qualify alone on income, credit and debt to income.
Removing a spouse from title and removing them from the loan are two separate acts, and conflating them is the most damaging error in a divorce transaction. A deed changes ownership. The note is a contract with a lender who is not a party to the divorce, so a judgment, a settlement agreement and a recorded interspousal transfer deed do not discharge liability. The two exits are a refinance or an assumption with an express written release of liability from the servicer, and the Garn St Germain Act generally prevents acceleration on a divorce related transfer, which is why the deed records cleanly while the liability quietly stays.
The honest downside is larger here than the tax rule alone suggests. Under IRC section 1041 the transfer is not a taxable event and the receiving spouse takes carryover basis, so the entire built in gain lands on the buying spouse, who may have only 250,000 dollars of exclusion at the eventual sale. On top of that, the spouse who stays inherits the whole ground level file: any re abandonment required before a future addition, the soil standards that apply before a permit issues, the coastal history of past work, and the dock permit renewal and transfer, all of it without the other person's records or recollection.
Representing the Sale, and Neither of the Two Sellers
Paula Aragone has worked Orange County transactions for 23 years, across 900+ transactions and $900M+ sold, and she came to it after four years of law school. She holds the CPRES and SRES designations. That background is why family law attorneys send dissolution listings here rather than to a general listing agent.
The role is deliberately limited. The representation is of the sale, not of either spouse. Both parties receive the same information at the same time and in writing, including every offer, every price recommendation and every record pulled from the Building Division, the Fire Department, the Planning Division or CalGEM. Neither party is advised on what to accept in the division, because that belongs to their own counsel and doing it from this chair would destroy the only thing that lets a two seller listing function.
That neutrality is also what keeps the sale alive. Dissolution listings seldom collapse over price. They collapse once one party concludes the agent is working for the other, and from that point every access request, every price adjustment and every repair credit reads as a manoeuvre. One channel, one calendar, both parties and both attorneys copied on everything, agreed in writing before the first showing, prevents most of it.
Nothing here is legal advice, and a listing agent is not a substitute for your own family law attorney. Character of property, Moore and Marsden analysis, Family Code 2640 tracing, Epstein and Watts accounting and the wording of any order authorising a sale are all lawyer work. What this office contributes sits outside the courtroom: a documented valuation, the well, coastal, dock and association records assembled at listing rather than in escrow, broad exposure, and a written record clean enough that neither side can later say the sale was arranged.
Divorce Sales in Huntington Beach, Answered Question by Question
Answers for California dissolution law and for a city with a producing oil field beneath it and a coastal permit boundary across it.
My spouse wants to sell and I do not. Can they list it anyway?
No. Family Code 2040 restrains both parties from transferring, encumbering, hypothecating, concealing or in any way disposing of any property, community, quasi community or separate, without the written consent of the other party or an order of the court. Selling a family residence is not a transaction in the usual course of business. Every record owner also has to sign the listing agreement, and Family Code 1102 requires both spouses to join in any instrument conveying community real property.
From what moment are we each bound by those orders?
Family Code 233 sets it out. The orders are effective against the petitioner on filing of the petition and issuance of the summons, and against the respondent on personal service of the petition and summons or on the respondent's waiver and acceptance of service. They stay in force until final judgment is entered, the petition is dismissed, or the court orders otherwise. They appear on the face of Judicial Council form FL-110 under the standard family law restraining orders heading.
How do we find out whether there is an oil well under our property?
Start with the CalGEM Well Finder, which maps California oil and gas wells and is searchable by address, coordinates, API number or field name and updates nightly from the state well database. Then check the Fire Department file for the parcel, because the city holds the methane barrier, soil sampling and remediation records that the state does not. CalGEM provides its data without warranty of accuracy or completeness, so a search that returns nothing is a starting point rather than a clearance.
There is an abandoned well near the house. What does the city require?
Where abandoned oil wells are within one hundred feet of the footprint of a structure, any new structure must be equipped with a methane barrier in accordance with City Specification 429, issued in October 2022 and administered by the Fire Department through the Methane Mitigation District. An older house built before that requirement will not have a barrier or a vent system. That is a disclosure conversation and a buyer question, and it is far better handled before listing than after acceptance.
Who pays to re abandon an old well?
The owner, and in a dissolution that means both of you until the judgment says otherwise. Many wells were abandoned to standards long since superseded, so re abandonment to current CalGEM standards is routinely required before new construction or a major addition. Because it is an extraordinary expenditure, Family Code 2040 requires each party to notify the other at least five business days before incurring it and to account to the court, so agree who authorises and who funds the work in writing first.
Does AB 1725 require us to disclose nearby wells?
Not as law. As of the last recorded action in May 2026 the bill had not been enacted. It would require sellers and landlords in two specified census tracts to give written notice of active, idle, orphaned or abandoned wells on the property or within three hundred feet, with the associated hazards, and would require methane monitoring in certain multifamily buildings. Do not describe it as current law. Do treat a known well within three hundred feet as a material fact under Civil Code 1102, because it is one either way.
Our house was added to years ago. Was a coastal permit needed?
Possibly. Under Municipal Code Chapter 245 a Coastal Development Permit is required for development in the coastal zone unless exempted or categorically excluded, and in appealable areas the exemption covers maintenance, alteration or an addition that does not increase floor area or height by ten percent or more. Above that threshold a coastal permit was required, and work of that kind cannot be legalised by a building permit alone. Development is appealable where it sits between the sea and the first public road or within three hundred feet inland.
We are in Sunset Beach. Who issues permits there?
Confirm it with the Planning Division rather than assuming. Huntington Beach has a certified Local Coastal Program, with the Coastal Element first certified in 1985 and last comprehensively updated in 2001, but two of the eight specific plan areas in the coastal zone are not certified: Brightwater and Sunset Beach. A Sunset Beach Local Coastal Program Review Board still advises the city on discretionary actions implementing that specific plan and Local Coastal Program, and certification status is what decides who issues a permit.
Is the dock permit ours to sell?
Only with paperwork, and sometimes there is nothing to transfer. Dock permits in Huntington Harbour are regulated by the California State Lands Commission and by the city, and the permit has to be confirmed current and transferable before anyone relies on it. Some properties carry dock rights with no dock built, which means new construction and a new permitting process. Have the dock inspected, assemble the permit and transfer requirements before listing, and name the interest in the judgment separately from the parcel.
Which association are we in?
That has to be answered from the documents, not from the neighbourhood name. There is a Huntington Harbour Property Owners Association and, separately, tract level associations such as the one for Tract 5775, plus gated sub communities like Coral Cay with their own associations. No single master association covers all five islands. Establish the position parcel by parcel from the preliminary title report and the recorded governing documents, then order every applicable resale packet at listing rather than after acceptance.
What did the March 2025 fire map change for us?
It may have placed your parcel in a zone for the first time. Huntington Beach was one of five Orange County cities newly included in the CAL FIRE maps published on 24 March 2025, and the city states it has Moderate and High zones and no Very High zones. A High zone parcel triggers AB 38: defensible space compliance documentation under Civil Code 1102.19 and, since 1 July 2025, disclosure of available low cost retrofits, which of them the seller completed, and known vulnerabilities. The city publishes an interactive map for parcel lookup.
How do we tell a buyer which schools serve the house?
By running the address through the district locator, every time. Huntington Beach Union High School District serves the high school grades and takes students from four separate elementary districts: Fountain Valley, Huntington Beach City, Ocean View and Westminster. One address can therefore pair an elementary school in one district with a high school in another. In a dissolution, get the answer in writing once and give it to both parties, so a buyer is not told two different things by two households.
The house was mine before we married. What does the community own?
A proportional share, if community earnings paid down the loan. Family Code 770 makes property owned before marriage separate, but under In re Marriage of Moore (1980) 28 Cal.3d 366 and In re Marriage of Marsden (1982) 130 Cal.App.3d 426 the community acquires an interest in the ratio its principal payments bear to the purchase price, with appreciation before the marriage staying entirely with the owner spouse. In re Marriage of Mohler (2020) 47 Cal.App.5th 788 fixes that percentage as of separation.
Could a judge force a sale, or postpone one?
Both, on different authorities. Family Code 2550, 2601 and 2553 together let a court order a sale where the estate cannot otherwise be divided equally, where neither party can qualify to buy the other out, or where a party is dissipating the asset. In the other direction, Family Code 3800 through 3810 allow a deferred sale of home order, a Duke order, if the court first finds under 3801 that maintaining the payments, taxes, insurance and condition of the home is economically feasible, and then weighs the factors in 3802(b).
Neither of us trusts the other with the proceeds. How does escrow handle that?
Escrow acts only on the written instructions both principals signed, and once joint instructions are signed neither can change them alone. If the parties give conflicting instructions the escrow holder is a neutral stakeholder rather than a referee, and its remedy is an interpleader that deposits the funds with the court and leaves the two of you to litigate. The way to avoid that is a judgment stating the disbursement formula and escrow instructions that repeat it word for word.
