Trust Real Estate Agent in Newport Beach, CA

Paula Aragone represents successor trustees selling Newport Beach property held in a revocable trust, from the Certification of Trust the title company will ask for to the pier and dock permit the city has to transfer before escrow can close.

The short answer

A Newport Beach trust sale is a sale by the successor trustee of a revocable trust after the settlor has died. No court confirms it. Probate Code 17209 keeps trust administration free of judicial intervention, so there is no confirmation hearing, no ninety percent appraisal floor and no overbid. What replaces the court is documentation, and on the harbour there are two files rather than one, because the city must also transfer the pier and dock permit, with signatures due at close of escrow.

Two Assets on One Escrow, the Parcel and the Water

Newport Beach was built around a working harbour rather than a beach. For a trustee that is not scenery. It is a second permit file, a second inspection and a second set of signatures.

The city grew in waves and a trustee inherits whichever wave the family bought into. Peninsula and island cottages run from the 1900s to the 1930s. Harbour fill and island development ran from the 1920s through the 1950s. The Irvine Company tracts, Eastbluff, Harbor View and Irvine Terrace, arrived from the late 1950s into the 1970s. Big Canyon opened in the early 1970s, One Ford Road was built from 1999 to 2002, and Newport Coast came from the 1990s onward.

The 2012 Housing Element put single family detached at 45.1 percent, single family attached at 15.6 percent, duplex to fourplex at 11.6 percent, multifamily at 24.4 percent and mobile homes at 2.7 percent. Nearly a quarter of the city is multifamily and more than one parcel in ten carries two to four units. That is why a trustee in Newport Beach so often inherits a building with tenants in it rather than a house with a lawn, and why the rent roll reaches escrow before the listing does.

The city's own Housing Element flags illegal dwelling units, garage conversions and unit splits as concentrated in the older beach areas, and notes those units carry more health and safety violations than legal ones. A trustee who never lived in the house has no way of knowing what was permitted. The Residential Building Records report pairs the permit history with a zoning check and, if the owner authorises it, a code enforcement inspection covering smoke detectors, water heater strapping and pool enclosure.

The build era decides what the inspection turns up. The pre 1940 island and peninsula cottages bring knob and tube remnants, undersized services, cast iron and galvanised supply and waste, asbestos in pipe wrap and flooring, raised foundations over crawl spaces in a high water table, and salt air corrosion on everything metal. The 1950s to 1970s tracts bring Federal Pacific and Zinsco panels, aluminium branch wiring in the 1965 to 1978 band, single pane aluminium windows and slab on grade over marine terrace soils.

The late 1970s to early 1990s stock brings polybutylene. Newport Coast product from the 1990s and 2000s is generally past all of that and raises a different set instead: stucco and window flashing, EIFS detailing and early PEX fittings. It also raises assessments, because Newport Coast is where the Community Facilities District exposure sits in this city while older Newport Beach generally carries none. Answer the special tax question by parcel against the county record, never by neighbourhood reputation.

Then the ground. The General Plan EIR states there are no Alquist Priolo Earthquake Fault Zones inside city limits, with the Newport Inglewood zone terminating about two miles northwest of the boundary. Liquefaction susceptible ground includes the Balboa Peninsula, land in and around Newport Bay and Upper Newport Bay, and the Santa Ana River floodplain. Roughly 90 percent of the land from Los Trancos Canyon to the Crystal Cove State Park boundary is mapped as susceptible to landsliding. All of it is natural hazard disclosure, not conversation.

The process

How a Trust Property Sale Works in Newport Beach

A trust sale here is a private administration with a public counter attached to it. These are the steps in the order they actually happen, and on the water two of them run in parallel rather than in sequence.

01

Read the trust before anyone reads a listing agreement

Find out who succeeds, whether co trustees have to act together, and whether the instrument wants a written acceptance. On a waterfront parcel this matters twice, because the same signature that conveys the land has to appear on the city's pier and dock transfer application. A sale signed by one of two co trustees who were required to act jointly is a defect title finds late.

02

Serve the 16061.7 notice before the harbour work starts

Within sixty days of the trust becoming irrevocable the trustee serves every beneficiary and every heir of the deceased settlor, including an heir the trust disinherits. The notice carries the statutory warning in ten point boldface and starts the 120 day contest period. Until it is served that clock never starts, and an open contest window is what stalls an island escrow at title review.

03

Record the Affidavit of Death of Trustee

Recorded against the Newport Beach parcel with the Orange County Clerk Recorder, main office at 601 N. Ross Street in Santa Ana, with a certified death certificate, so the chain of title shows the succession before a buyer's title officer has to ask. Anyone working from older material should note the main office is on Ross Street, not the old civic centre address.

04

Confirm the parcel is in the trust, and confirm how it is held

If title still stands in the settlor's individual name the trustee cannot convey. Where written intent exists, on a schedule of assets or a general assignment, the route is a Probate Code 850 petition, the Heggstad petition named for Estate of Heggstad (1993) 16 Cal.App.4th 943. In Beacon Bay there is a second question, because the community has a ground lease history that belongs in title review, not in escrow.

05

Value it inside its own submarket, and document why

The trustee owes impartiality under Probate Code 16003 and a duty to keep beneficiaries reasonably informed under 16060. A Balboa Island lot of thirty by eighty five feet, a Linda Isle waterfront with its own dock and a Port Streets family home are three different products inside one city. A valuation built across them produces a number no beneficiary should be asked to accept.

06

Open the pier and dock permit transfer at listing

On any dock property the city inspects the pier for safety, issues a deficiency letter if it fails, reinspects after correction, and requires a transfer application signed by seller, buyer and any joint permittee, with signatures due at close of escrow. Turnaround runs five to fifteen working days and a fee applies. Started at listing this is routine. Started at acceptance it decides the closing date.

07

Check the short term lodging permit before it disappears

Municipal Code Chapter 5.95 caps permits at 1,550 citywide, and no new permit has been issued for R-1 single family property since 1 June 2004. A valid permit can transfer to a buyer only if a transfer application is filed within sixty days of title transfer to a bona fide purchaser for value. A trustee who does not know the permit exists can extinguish a real asset by doing nothing.

08

Order the Residential Building Records report, then market openly

The report has been voluntary since 28 November 2023, and it is still the instrument that settles a contested addition, because it pairs permit history with a zoning check and an optional code inspection. Then market broadly. A trustee who sells quietly to a relative is transacting against the duty of loyalty in Probate Code 16002, and exposure is the trustee's own defence.

09

Close, transfer the harbour permit, account and distribute

Escrow disburses to the trust, not to the beneficiaries individually, and the dock permit transfer signatures land at the same table. The trustee then accounts. Where a beneficiary wants the property distributed rather than sold, the Proposition 19 and basis questions in the next section decide whether that is a good idea, and they have to be answered before anyone moves in.

Where we work

Islands, Bluffs and Inland Tracts, and What Each Does to a Trust File

In this city the address decides whether there is a dock permit, an association that controls access, a ground lease, or none of the three. These are the ones that come up most often.

Balboa Peninsula

Ocean on one side, harbour on the other, the Wedge at the east end. The densest and most rental exposed part of the city, which means a trustee usually inherits tenancies alongside the title.

Peninsula Point

Built from the early 1920s with 1950s Balboa cottages filling in, Cape Cod and Eastern Seaboard styling. Quieter than the rest of the peninsula, and old enough to carry the full pre 1940 defect list.

Balboa Island, Little Balboa Island and Collins Isle

Dredged into existence between 1908 and 1909. The standard lot is thirty by eighty five feet at roughly 17,621 persons per square mile. Collins Isle holds about eight homes behind a one lane bridge.

Lido Isle

Master planned in the 1920s on a former mudflat, Mediterranean street names, community docks, private beaches and a clubhouse. The association owns real assets, so its documents matter to a buyer's lender as much as to a buyer.

Bay Island

The only island in the harbour with no car access, originating as a duck hunting club, with about twenty six bayfronts and common gardens. Access and ownership structure are the first things to establish, not the last.

Harbor Island

Roughly thirty to thirty four private residences on one gated road, every property waterfront with one or more docks. Every sale here carries the pier and dock permit transfer as a separate escrow track.

Linda Isle

Formerly Shark Island, brought into the city in 1954, horseshoe shaped and developed in the 1970s, with roughly 106 waterfront lots and a dock at each home. Guarded, and consistently a two file escrow.

Beacon Bay

Lower bay, community dock and slips, tennis and basketball. Historically a ground lease community, which is a title question a buyer's counsel will raise and a trustee should have answered before listing.

Promontory Bay

About sixty two custom waterfront homes, each with a private dock. The dock condition report, not the house inspection, is usually the item that sets the closing date.

Bayshores

Gated enclave of about 249 homes on the turning basin with private beaches and a children's park. Access control means showing access has to be arranged through the association, which lengthens the marketing calendar.

Dover Shores

A 1950s development on the west side of the Back Bay with waterfront homes and private community beaches. Also directly under the departure path, which is a disclosure conversation rather than a detail.

Newport Heights and Cliff Haven

Bluff top above Pacific Coast Highway, larger lots, older stock, walkable to Newport Harbor High. Elevated landslide risk from steep terrain and weathered bedrock belongs in the hazard disclosure.

Eastbluff

An Irvine Company era tract known for greenbelts, next to the Back Bay bluffs. Long held original ownership makes it a classic trust file, with a long inspection list to match.

Big Canyon

Opened in the early 1970s, a gated golf course community on a 414 acre village site with sub associations around the country club. Two sets of governing documents, and both are ordered early or not at all.

One Ford Road

Built in three phases from 1999 to 2002 on the former Ford Aeronutronic site, 371 homes across Balboa, Carmel, Stonybrook, Summerhouse and Providence, plus eight custom homes on Troon Drive, behind a single guard gate.

Harbor View Homes, the Port Streets

The family tract inland of MacArthur that feeds Andersen Elementary, and the most consistently school driven submarket in the city. Verify the attendance boundary by address before it reaches marketing.

West Newport, Newport Shores and Balboa Coves

The northern end. Newport Shores has its own community association and Balboa Coves is gated off Pacific Coast Highway with private docks, so two neighbouring listings can have entirely different paperwork.

Newport Coast

Annexed around 2001 and 2002. Crystal Cove, the Pelican communities, Pacific Ridge, Newport Ridge and Altezza sit under layered master and sub associations. This is where the Community Facilities District exposure and the expanded fire zone both sit.

What actually delays it

Six Things That Stop a Newport Beach Trust Sale

Newport Beach, California

None of these are about the market. Each one is a permit, a signature or a report that somebody assumed would take care of itself.

The 120 day contest window was never started

The trustee has sixty days from the settlor's death to serve every beneficiary and every heir under Probate Code 16061.7. Service starts a 120 day window in which the trust can be contested. Not serving it leaves that window open with no end date at all.

Title underwriters treat an unstarted or unexpired contest period as risk, and on an island parcel where the buyer is already waiting on a dock inspection there is no spare calendar to absorb it. Serve first, list second.

The pier and dock permit was assumed to travel with the deed

It does not. The city runs a separate transfer process: an inspection of the pier for safety, a deficiency letter if it fails, a reinspection after correction, then an application signed by seller, buyer and any joint permittee, with those signatures due at close of escrow.

Application turnaround is five to fifteen working days and a transfer fee applies. A trustee who starts this after the offer is accepted has put a city queue inside the escrow period. A trustee who starts it at listing has removed it entirely.

The lodging permit lapsed in the change of ownership

Chapter 5.95 caps short term lodging at 1,550 permits citywide with a waiting list, and no new permit has issued for R-1 single family property since 1 June 2004. Where the settlor held one, it is a genuinely scarce asset attached to the property.

It survives only if a transfer application is filed within sixty days of title transfer to a bona fide purchaser for value. Miss the window and the permit is gone, with nothing on the property looking broken and no way to replace it.

The deed into the trust was never recorded against the parcel

It happens constantly. The settlor signed the trust, listed the Newport Beach property on a schedule of assets, and never signed a deed. Title still stands in the individual name and the trustee has no power to convey anything.

Where written intent exists, a Probate Code 850 petition, the Heggstad petition, confirms the property into the trust. Where it does not, the property goes to probate and the timeline, the disclosure duties and the court's involvement all change.

Nobody ordered the Residential Building Records report

The report became voluntary on 28 November 2023, which is exactly why it now gets skipped. It carries the permit history and zoning information, and if the owner authorises it, a code enforcement inspection covering permit compliance and life safety items.

Corrections noted must be made within thirty days of the inspection, although a buyer may assume responsibility with disclosure, and the report stays valid for a year absent a change of ownership or new unpermitted work. For an estate with a converted garage nobody can explain, it is the cheapest answer available.

The 2025 fire map redrew Newport Coast and the canyon edges

The City Council adopted the updated CAL FIRE maps on 8 July 2025. The counts moved to 4,247 parcels Very High against 2,825 in 2011, plus 1,160 High and 831 Moderate, because the local responsibility area maps now carry Moderate and High as well as Very High.

About 1,400 more parcels sit in Very High than did before, so a property that carried no zone on its last sale can carry one now. That brings AB 38 defensible space documentation under Civil Code 1102.19, and because Newport Beach runs its own fire department rather than sitting under the Orange County Fire Authority, the inspection goes through the city.

The decision

Sell the Newport Beach Property, or Keep It in the Family

Two rules pull against each other. On the harbour a third factor joins them, because the permits attached to the property behave differently depending on which way the family goes.

Selling is what the basis rule rewards

Basis resets to fair market value at the date of death under IRC section 1014, so a lifetime of appreciation on a peninsula cottage or a bayfront lot disappears for income tax purposes. Gain is measured only from the date of death forward, which is why a sale soon after death often produces close to no gain and sometimes a small loss once costs are counted.

Where the property was held as community property by a married couple, IRC 1014(b)(6) steps up both halves at the first death, not only the decedent's half. In a city where a couple may have owned the same island lot since the 1960s, that is the difference between a manageable number and an unmanageable one.

Holding period is not a trap either. Under IRC 1223(9), property taking its basis from section 1014 and sold within a year of death is treated as long term regardless of how briefly the trust actually held it.

The protection for all of this is a qualified date of death appraisal, and on a waterfront parcel it has to value what is actually there, including the dock, rather than a comparable half a mile inland. Without a documented appraisal the value can be argued down later and gain appears where there was none.

Keeping it is what Proposition 19 rewards, but only sometimes

For transfers on or after 16 February 2021, the parent to child exclusion applies only to a family home that was the parent's principal residence and becomes the child's principal residence. A Balboa Peninsula duplex the parents rented out, or a second home used in summer, is now fully reassessed. If the child does not move in, there is no exclusion at all.

The child must claim the homeowners' exemption within one year of the transfer or the date of death, and the exclusion claim itself, form BOE-19-P, is due within three years or before a transfer to a third party, whichever comes first. Those two deadlines are what actually gets missed, not the eligibility test.

The cap is the parent's factored base year value plus an adjusted amount, currently 1,044,586 dollars for transfers between 16 February 2025 and 15 February 2027. Where market value exceeds that sum, the new taxable value is market value minus the adjusted amount rather than the parent's old figure, and in this city the spread is frequently large enough that a reassessment happens anyway.

The counterweight: a child who moves in only to hold the tax base and sells at month twenty gets neither the section 121 exclusion, which needs twenty four months of ownership and use, nor the clean sale the basis rule offered at the start. If the property carries a lodging permit, sitting on the decision can also run out the sixty day transfer window. Decide before anyone moves, not after.

Why this office

A Trustee Is Personally Exposed. The Listing Should Reduce That, Not Add To It.

Paula Aragone has worked Orange County transactions for 23 years, across 900+ transactions and $900M+ sold, and she came to it after four years of law school. She holds the CPRES and SRES designations. That background is the reason estate and family law attorneys send trust files here rather than to a general listing agent.

The duties a successor trustee carries are specific. Probate Code 16002 requires administration solely in the interest of the beneficiaries. Probate Code 16003 requires impartiality among them. Probate Code 16004 and 16005 prohibit self dealing and personal profit. Probate Code 16060 requires keeping beneficiaries reasonably informed. Litigation between beneficiaries and trustees almost never starts over the sale price. It starts over a sale that looked arranged: a quiet off market transaction, a purchase by a relative, or a valuation nobody can reconstruct two years later.

In Newport Beach the record has to cover more than the house. If the dock permit was surrendered rather than transferred, if a lodging permit was allowed to lapse, or if a Newport Coast special tax was disclosed from a tax bill line rather than from the levying agency's notice, a beneficiary reading the accounting will ask why. Broad marketing, a documented valuation built inside the correct submarket, and a written record of every offer are what answer those questions before they are asked.

A beneficiary who objects to a sale petitions under Probate Code 17200, and the remedies in 16420 include enjoining the trustee and removing them. But Probate Code 18100 protects a buyer who deals with the trustee in good faith, for value and without actual knowledge of any impropriety, so a closed sale is rarely undone. To stop one, a beneficiary has to obtain an injunction before closing and record a lis pendens. The practical exposure is money against the trustee personally, plus removal and denial of compensation. That is the risk the record is built to answer.

Questions

Trust Property Sales in Newport Beach, Answered

The questions successor trustees and beneficiaries actually ask, answered for California law and for a city built around a harbour.

Does a Newport Beach trust sale have to go through probate court?

No. Probate Code 17209 states that trust administration is intended to proceed expeditiously and free of judicial intervention. There is no confirmation hearing, no requirement that the price reach ninety percent of an appraisal, and no courtroom overbid. The successor trustee sells directly under the power in Probate Code 16226 and in the trust instrument itself. What takes the court's place is documentation, and in this city part of that documentation sits with the city's harbour department rather than with title.

What happens to the pier and dock permit when the trust sells?

It transfers, but only through the city and only if somebody starts it. The city inspects the pier for safety, issues a deficiency letter if it fails, reinspects after correction, and requires a transfer application signed by the seller, the buyer and any joint permittee, with signatures due at close of escrow. Turnaround runs five to fifteen working days and a transfer fee applies. Note also that the Coastal Commission keeps original jurisdiction over tidelands and submerged lands, which in Newport Beach is precisely where the docks are.

Does the short term lodging permit pass to the buyer?

Only if the transfer application is filed within sixty days of title transfer to a bona fide purchaser for value. Municipal Code Chapter 5.95 caps permits at 1,550 citywide with a waiting list, and no new permit has been issued for R-1 single family property since 1 June 2004, renewals of previously permitted units excepted. That makes a legacy permit a genuinely scarce asset. A trustee who does not know it exists can lose it by inaction, and nothing about the property will look broken afterwards.

Should the trust order a Residential Building Records report?

In most estates, yes. The report was mandatory before sale and became voluntary on 28 November 2023. It carries permit history and zoning information, and if the owner authorises it, a code enforcement inspection covering zoning and permit compliance plus life safety items such as smoke detectors, water heater seismic strapping and pool enclosure. Corrections noted must be made within thirty days of the inspection, though a buyer may assume responsibility with disclosure. For a trustee who never lived in the house it is the cheapest way to answer a question about an old addition.

What does the title company need from me as successor trustee?

In practice a Certification of Trust under Probate Code 18100.5, a certified death certificate, and an Affidavit of Death of Trustee recorded against the Newport Beach parcel with the Orange County Clerk Recorder at 601 N. Ross Street in Santa Ana. Where the trust named co trustees and one has died, they will also want the document confirming who now holds authority to sign. Requirements vary by underwriter, so ask the specific title company early rather than assuming.

Do I have to hand over the entire trust document?

Usually no. Probate Code 18100.5 lets a trustee present a Certification of Trust in place of the instrument, stating the trust's existence and date, the trustee's identity and powers, revocability, signature authority and the legal description, without the dispositive provisions. The statute goes further: a person who demands the full instrument in addition, in bad faith, may be liable for damages including attorney's fees. In practice underwriters often still ask, and that is a conversation rather than an obligation.

The Balboa Island house is still in my father's name, not the trust. What now?

The trustee cannot convey it. Where the settlor's written intent to hold it in trust is documented, on a schedule of assets, an assignment or a general transfer, the route is a petition under Probate Code 850, commonly called a Heggstad petition after Estate of Heggstad (1993) 16 Cal.App.4th 943, where a written declaration naming the settlor as trustee was held sufficient without a separate deed. Where no such writing exists, the property goes through probate instead, and the timeline changes entirely.

Do we have to disclose flooding on Balboa Island?

Yes, and the history is structural rather than incidental. The original fourteen inch wooden bulkhead flooded on high tides, the seawall was rebuilt in concrete at the Grand Canal in 1929, and the Bay Front bulkhead was completed in 1938. Flood zone and king tide questions should be expected on the islands and the low peninsula, and the Natural Hazard Disclosure Statement under Civil Code 1103.2 carries the flood finding. The city also completed a Public Trust Lands Sea Level Rise Vulnerability Assessment under AB 691 and submitted it to the State Lands Commission by the 1 July 2019 deadline.

The property is oceanfront and was built in the 1980s. Can a seawall be permitted?

Not as of right. Coastal Act Section 30235 requires shoreline protective devices to be permitted where needed to protect existing structures, and in Casa Mira Homeowners Association v. California Coastal Commission the First Appellate District ruled on 30 December 2024 that existing means existing before the Coastal Act took effect on 1 January 1977. The California Supreme Court denied review on 12 March 2025, so the restrictive reading is settled law. For a post 1976 structure that is a disclosure and valuation fact, not a theory.

Can a beneficiary stop me from selling the Newport Beach property?

Rarely, and almost never after closing. A beneficiary petitions under Probate Code 17200, and the remedies in 16420 include compelling redress, enjoining a breach and removing the trustee. But Probate Code 18100 fully protects a third person who dealt with the trustee in good faith, for valuable consideration and without actual knowledge that the trustee exceeded its powers. To reach such a buyer a beneficiary has to obtain an injunction before closing and record a lis pendens. Otherwise the remedy is money against the trustee personally.

Can I sell the house to one of the beneficiaries?

You can, and families often want to, but it is the transaction most likely to be attacked later. Probate Code 16002 requires administration solely in the interest of the beneficiaries and 16003 requires impartiality among them. Expose the property to the market, document the value, keep every offer in writing, and disclose the buying beneficiary's interest to the others. On a waterfront parcel also document how the dock was valued, because that is the number a sibling will question first. A sale that was fair but undocumented is very hard to defend two years later.

Do we owe capital gains tax if we sell soon after the death?

Usually very little. Under IRC section 1014 the basis resets to fair market value at the date of death, so gain is measured only from that date forward. Selling soon after death typically produces close to no gain, and IRC 1223(9) treats the sale as long term even where it happens within a year. Where the property was community property of a married couple, IRC 1014(b)(6) steps up both halves at the first death. Obtain a qualified date of death appraisal, because that is what protects the basis. This is general information, not tax advice.

How does Proposition 19 work if a child wants to keep the house?

For transfers on or after 16 February 2021 the exclusion applies only to a family home that was the parent's principal residence and becomes the child's principal residence. The child must claim the homeowners' exemption within one year of the transfer or date of death, and file form BOE-19-P within three years or before any transfer to a third party. The excluded amount is the parent's factored base year value plus 1,044,586 dollars for transfers from 16 February 2025 through 15 February 2027. Above that, the new taxable value is market value minus that figure. Confirm the numbers with the Orange County Assessor.

Is the Newport Beach property in a fire hazard severity zone?

It may be now even if it was not before. The City Council adopted the updated CAL FIRE maps on 8 July 2025, moving the counts to 4,247 parcels Very High against 2,825 in 2011, plus 1,160 High and 831 Moderate. A High or Very High designation brings AB 38 defensible space documentation under Civil Code 1102.19 and the Natural Hazard Disclosure finding, and new construction or major renovation in those zones must meet ember resistant venting, ignition resistant materials and multipane window standards. Newport Beach runs its own fire department, so that inspection goes through the city rather than through the Orange County Fire Authority.

Does Mello Roos apply to a Newport Beach trust property?

Newport Coast is where the Community Facilities District exposure sits in this city, and older Newport Beach generally carries none. Do not answer it from the neighbourhood name. Check the parcel against the county's Community Facilities District map and the tax bill by assessor's parcel number, and where a district applies, Civil Code 1102.6b requires the seller to make a good faith effort to obtain the disclosure notice from each levying agency and deliver it to the buyer. The line item on the tax bill is not that notice.

Do we have to say anything about the airport?

Yes, and it is better said early. Departures from John Wayne Airport follow Newport Bay to the ocean about ninety five percent of the time, and aircraft bound east of Las Vegas turn left over the ocean and then back inland between Crystal Cove and Dana Point. Ten noise monitoring stations enforce limits and the commercial curfew runs from 11:00 pm to 7:00 am, but general aviation may operate twenty four hours within those limits. A buyer who toured on a Sunday afternoon has not heard a Tuesday morning departure, and finding out after the offer is how a trust escrow loses three weeks.
