The Work Was Done by People You Cannot Ask
Fullerton is the old city of north Orange County, and an inherited house here usually carries three generations of alterations, most of them undocumented and none of them made by the person now signing the disclosures.
The city was founded in 1887, named for George H. Fullerton of the Pacific Land and Improvement Company, and incorporated on 15 February 1904 across what is now 22.44 square miles. Its building eras are legible on the ground: agricultural from 1887 into the 1920s, especially Valencia oranges; an oil boom through the 1920s to 1940s that brought Spanish Colonial Revival with it; postwar suburban expansion as veterans settled; the permanent state university campus between 1957 and 1963; and a shift from industrial and agricultural to mixed use from the 1980s onward. Leo Fender built the first commercially successful solid body electric guitar here in 1949.
That history is why Fullerton is the only community in this part of the county with a genuine pre war housing layer, and why the inspection profile starts earlier than anywhere else nearby. Craftsman bungalows from the 1900s to the 1920s sit near downtown. Spanish Colonial Revival from the oil years survives across the hill neighbourhoods, with the Muckenthaler Cultural Center, an eighteen room house built in 1925 on 8.5 acres, donated to the city in 1965 and listed on the National Register of Historic Places in 1999, as the landmark example.
Then everything else, in layers: Minimal Traditional and early ranch from the late 1940s and 1950s, the large tracts of the 1950s and 1960s, hillside custom and semi custom through the 1960s and 1970s, infill and hillside product in the 1980s and 1990s, and Amerige Heights built from 2001 to 2004 on the former Hughes Aircraft site. A downtown adjacent bungalow, a Sunny Hills estate parcel and an Amerige Heights house have almost nothing in common in systems, district, association structure or buyer pool. Treating them as one market is how an estate listing gets mispositioned.
What an inspector finds, in Fullerton order. Knob and tube wiring in anything from before roughly 1950, which is the item that separates this city from its neighbours and is an insurability problem before it is a safety problem, because carriers decline or surcharge and a lender may require remediation. Aluminium branch circuit wiring in the 1965 to mid 1970s tracts, where installation peaked, pre 1972 homes carry materially higher risk, and failing connections seldom give detectable warning signs. The Consumer Product Safety Commission accepts three permanent repairs: complete replacement with copper, COPALUM crimp connectors or AlumiConn connectors.
Then the plumbing and the panels. Galvanised supply piping is endemic in the pre 1960 stock and is the usual cause of a complaint about water pressure that becomes a repipe credit. Cast iron drain lines from the same era should be camera inspected before listing on anything pre 1970. Federal Pacific Stab Lok and Zinsco panels turn up across the 1950s to 1970s stock as a routine inspection callout and a common carrier objection. Polybutylene supply appears in the late 1970s through 1990s infill, degrades from the inside through contact with chlorine and chloramine, and can only be permanently cured by full replacement.
Finally the age items that are legal rather than mechanical. Asbestos era materials appear across everything pre 1980 in ceiling texture, resilient flooring and mastic, duct wrap and roofing felt. Lead paint appears across everything pre 1978 and brings its own federal disclosure obligation on top of the state package. Raised foundations over crawl spaces bring subarea moisture, inadequate ventilation and joists cut or notched by later plumbing runs. And unpermitted work is very common in this stock, because garages became bedrooms and porches became rooms across three separate ownerships.
What to Do With an Inherited Fullerton Property
The order below is written from the heir's side rather than the court's. In an old house two steps carry the calendar: the systems inspection that tells you what you actually own, and the permit reconstruction that tells you what can be advertised.
Read the date of death against the three ceilings
For deaths on or after 1 April 2025 the personal property affidavit covers a gross estate to 208,850 dollars, the petition to determine succession to real property reaches 750,000 dollars but only where the home was the decedent's California primary residence, and the small value real property affidavit covers 69,625 dollars. Deaths from 1 April 2022 to 31 March 2025 use 184,500 dollars for the first two.
Find out whose signature a title officer will accept
In a probate the answer is Letters, and whether they carry full or limited authority under Probate Code 10402 and 10403 decides whether a sale needs court supervision. In a trust it is the successor trustee producing a Certification of Trust under Probate Code 18100.5. Ask the estate's attorney to confirm which, in writing, before ordering a single report.
Secure the house and tell the carrier what is in the walls
Change the locks, stop the mail, keep the utilities running and call the insurer in the first week. The policy is probably still in a dead person's name and the house is now unoccupied. In pre war Fullerton stock there is a second conversation: original wiring is an underwriting question, and a carrier that learns about it from a claim reacts differently than one told in advance.
Fix the value to the date of death before any work begins
Basis resets to fair market value at the date of death under IRC 1014, and a retrospective appraisal is what proves that number afterwards. Building and Safety sits on the second floor of City Hall at 303 W. Commonwealth Avenue. Work address by address and write down what does not appear, because that gap is the disclosure.
Take it to market with the reports already on the table
An old house sells better with its findings disclosed than with them discovered. Put the inspection, the sewer camera, the natural hazard report and the permit summary in front of buyers at the start. It changes the pool from people hoping for a bargain to people pricing a known quantity, and it protects whoever signed for the estate.
Close into the estate, then divide what is left
Escrow disburses to the estate or the trust, never to heirs individually. Orange County documentary transfer tax runs 1.10 dollars per 1,000 dollars of net consideration, and no Orange County city currently imposes an additional city transfer tax. The remainder is divided under the will, the trust or intestate succession, and a documented file makes that a short conversation.
One City, Six School Districts and a Century of Building
In Fullerton the decade the house was built predicts the inspection report, and the side of town predicts the district. An heir needs both answers before anything is advertised.
Raymond Hills
Older estate hillside east of Harbor with winding streets and custom houses on irregular lots. The most architecturally varied part of the city, which means an appraisal has to be built property by property.
Sunny Hills
Large lot and rolling, the postwar prestige address, with Sunny Hills High School on 42 acres at 1801 Lancer Way in the western part of the city. Estate parcels here often carry decades of unrecorded improvement.
Golden Hills
A 1940s and 1950s grid tighter than Sunny Hills, with mature street trees and strong neighbourhood identity. Squarely in the window where original wiring and galvanised supply both need to be looked at.
Las Palmas
Older and close to downtown, period revival and early ranch on small to moderate lots. This is the layer where knob and tube is most likely and where the attic should be opened before a listing goes live.
The Muckenthaler area
The hill around the Muckenthaler Cultural Center, an eighteen room Spanish Colonial Revival house built in 1925 on 8.5 acres, on the National Register since 1999. Character stock, and character stock carries character repairs.
Downtown Fullerton
The historic commercial core, walkable and mixed use. For adjacent residential the honest items are noise, parking and late hours, and an heir who never lived here will not know how loud a Friday is.
South of Commonwealth
The entertainment district known locally as SOCO. Sound and late hours are a real conversation for the housing beside it, and it is far better named in the disclosure file than discovered by a buyer.
Amerige Heights
Built from 2001 to 2004 on the former Hughes Aircraft site, the newest large tract in the city, association governed with its own commercial centre. This is where special tax and association structures are most likely to be live.
Coyote Hills
Ridge and slope product on the north west edge, beside the West Coyote Hills land use dispute. Describe the adjacent open land as unresolved rather than permanent, because a buyer will find the history.
Presidential Tract
A postwar tract with presidentially named streets and consistent single storey ranch stock, one of the most legible tract identities in the city. Uniform construction makes the era items predictable rather than surprising.
Fullerton Creek
Following the creek corridor, where drainage, culvert and flood questions are the recurring diligence items. Order the natural hazard report early and read the flood category rather than assuming it.
The Bastanchury area
The former Bastanchury Ranch lands with Bastanchury Road as the spine, mixing eras from postwar through the 1980s. Two inherited houses on the same road can sit in different decades and different districts.
Hermosa Drive and Laguna Road
Established older residential named for their elementary schools, with real district loyalty attached. Verify the attendance area by address, because the name of a street is not an enrolment guarantee.
Rolling Hills
Postwar with gentle topography, named for its elementary school. Standard mid century systems, which in practice means panels, supply lines and any addition made before the 1980s are the three questions.

None of these is about the market. Each is a consequence of owning a building that was altered for eighty years by people who are no longer available to explain it.
There is knob and tube in the attic and the insurer will find it
Any Fullerton house from before roughly 1950 needs the attic and the subarea opened and looked at before it is listed. Original wiring is an insurability problem before it is a safety problem: carriers decline or surcharge it, and a buyer's lender may make remediation a condition of funding. An estate that discovers this during escrow has lost weeks it did not budget.
The related item is the aluminium branch wiring in the 1965 to mid 1970s tracts, where installation peaked, homes built before 1972 carry materially higher risk, and failing connections seldom give detectable warning signs. Three additions across eighty years and one permit between them
Garages became bedrooms, porches became rooms, and a back structure grew across three separate ownerships. The square footage the family has always quoted may not be the square footage the record supports, and an appraiser working for a buyer's lender will use the record rather than the tape measure.
This is not fatal and it is usually not even expensive to disclose. What is expensive is advertising the larger figure, going under contract on it, and correcting it after an appraisal. Establish the permitted footprint first, describe the rest accurately as unpermitted, and let buyers price it with their eyes open.
The permit record is split across two systems and a records request
Fullerton has the best records access of the north county cities, and it is still three separate places. Scanned building files sit in the Building and Safety records portal, permit applications and their status sit in the self service system, and anything neither holds is obtained through a public records request to the City Clerk.
Building and Safety is on the second floor of City Hall at 303 W. Commonwealth Avenue, with a general line and a separate inspection line. Work by address, keep a list of what you searched, and record what did not appear. In an inherited sale the absence of a permit is itself a finding, and a written search is what turns it from a guess into a disclosure.
Pre 1978 paint brings a federal obligation with it
Anything built before 1978 is assumed to carry lead based paint, and the federal disclosure sits on top of the whole California package rather than replacing part of it. On a bungalow with original windows, original trim and eight decades of repainting, this is not a technicality. It is a question every buyer with young children will raise directly.
The age items travel together. Asbestos era materials appear in anything pre 1980, in ceiling texture, resilient flooring and mastic, duct wrap and roofing felt. Water conserving fixtures under Civil Code 1101.4 were to have been replaced in single family homes by 1 January 2017 and the condition is disclosed at transfer, and in this stock the pre 2017 fixture population is the largest in the north county.
The west side has an airport and an unresolved oil field
Fullerton Municipal Airport occupies 86 acres in the south western corner of the city on Commonwealth Avenue, has been owned and operated by the city since January 1941, and its control tower averages 262 operations daily. The airport and its industrial park are surrounded by residential. After two crashes in 1992 the then mayor of neighbouring Buena Park called for its closure. It is a legitimate diligence item for nearby property and it is better named than discovered.
On the north west edge, West Coyote Hills is a 510 acre ridge over a major oil field dating back to 1890 and the largest remaining tract of undeveloped land in north Orange County. A Chevron subsidiary proposed developing 179 acres while donating 352 acres as the Robert E. Ward Nature Preserve, voters approved Measure W in 2012 to prevent development, litigation over its interpretation has continued, and the city purchased an eastern portion in 2021 using state funds. Describe it as unresolved, and run CalGEM Well Finder by address.
The disclosure form asks what you know, and you know nothing
This is the structural problem in every inherited sale and it is sharpest in an old house. The seller has no personal knowledge of the roof, the wiring, the drain line or the addition. Whether the estate is exempt from delivering a Transfer Disclosure Statement depends on the procedure and is a question for the estate's attorney. An exemption from a form is never permission to withhold something the family actually knows.
The way through is to source every answer. Natural hazard report under Civil Code 1103.2 covering flood, dam inundation, fire hazard severity zone, wildland fire area, earthquake fault zone and seismic hazard zone. Permit search results with the gaps written down. A sewer camera report. A smoke alarm compliance statement under Health and Safety Code 13113.8 and carbon monoxide devices under 17926, which in this stock are frequently missing rather than merely old.
Sell the Old House, or Take It On
The federal basis rule and Proposition 19 pull in opposite directions, and in a pre war house a third figure joins them: what it costs to bring hundred year old systems up to a standard a lender and an insurer will both accept.
Sell it
Basis resets to fair market value at the date of death under IRC 1014(a), or to the alternate valuation date where an executor elects it on Form 706. On a house bought when the orange groves were still being subdivided, that removes a lifetime of appreciation for income tax purposes. Gain is measured from the date of death forward only, which is why a sale soon after death commonly produces close to no gain and sometimes a small loss once selling costs are counted.
Where the house was community property of a married couple, IRC 1014(b)(6) gives the surviving spouse's own half a new basis as well, so both halves step up at the first death. That is a California result and it is usually the biggest single number in the analysis on a house held since the 1950s. Under IRC 1223(9), property taking its basis from section 1014 and sold within a year of death is treated as long term regardless of how briefly the estate held it, so there is nothing to gain by waiting out a calendar.
Two mechanics decide how much of the advantage survives. The appraisal, because without a qualified date of death valuation the figure can be argued down later and gain appears where the family believed there was none. And who recognises the gain, because estates and trusts reach the top long term rate at 16,250 dollars of taxable income against 613,700 dollars for a married couple filing jointly. Whether the estate sells or distributes first is a question for the accountant before escrow, not after.
The honest downside. Selling as is means accepting a price set by buyers who have read the inspection, and in a house with original wiring and galvanised supply that discount is real rather than theoretical. It also ends the family's connection to a house that in this city is frequently the one everybody grew up in. And a full renovation is rarely the answer either, because the estate would be spending cash it may not have on work a buyer will price at cost, not at retail.
Keep it, or one heir buys the others out
For transfers on or after 16 February 2021 the Proposition 19 parent to child exclusion applies only to a family home that was the parent's principal residence and becomes the child's principal residence, or to a family farm. The old exclusion for other real property is gone, so a rental or a second home is fully reassessed. If no child moves in, there is nothing to claim.
Two deadlines control it. The homeowners' exemption or disabled veterans' exemption must be claimed within one year of the transfer or the date of death, and form BOE-19-P must be filed within three years of death or transfer, or before a transfer to a third party, whichever is earlier. The exclusion terminates if the transferee stops qualifying, so it is a continuing condition rather than a single filing.
The cap is the parent's factored base year value plus 1,044,586 dollars for transfers from 16 February 2025 through 15 February 2027, adjusted every two years by the California House Price Index. Where market value exceeds that sum, the new taxable value is market value minus the adjusted amount. A buyout among heirs is a purchase: the heir keeping the house needs financing, and a lender will require its own appraisal rather than accept a date of death figure that is by then months old. In an old house that appraisal may also come back with repair conditions attached.
The honest downside. Proposition 19 rewards the child who occupies and holds. IRC 1014 rewards the heir who sells promptly at a documented value. A child who moves in only to protect the tax base and sells at month twenty gets neither, because section 121 requires 24 months of ownership and 24 months of use. On top of that, an heir who keeps a pre war house inherits its whole maintenance queue at once: the rewire, the repipe, the sewer line, the foundation work and a carrier who may want some of it done before renewing.
You Are Being Asked to Vouch for Work You Never Saw

An inherited sale breaks in places an ordinary listing does not. The seller never lived in the house, so every answer has to be reconstructed from a record. The estate is often short of cash, which makes the repair decision a real decision. And the person signing is accountable to siblings and beneficiaries, so the file has to show why a number was accepted rather than simply that it was.
In Fullerton the reconstruction is most of the work. The permitted footprint has to come out of the records portal, the permit system and, where those fail, a public records request, and what did not appear has to be written down rather than glossed over. The attic and the subarea have to be opened before a buyer's inspector opens them. The sewer line on anything pre 1970 has to be cameraed. And the district has to be verified by address, because six school systems touch this city and the eastern edge is served by a district in another town entirely.
What that produces is a listing where the awkward facts are on the table at the start. The inspection, the sewer report, the permit summary with its gaps, the natural hazard report and the fire zone class where the parcel is on the hill. That is a smaller buyer pool and a better one, because everyone in it is pricing a known building. It is also the record that answers an heir who reads the accounting a year later and wants to know why.

What costs an estate money is advertising the larger square footage, going under contract on it, and having a buyer's appraiser use the record instead. Legalising the work is sometimes possible and is a question for the Building Division, but it takes time an estate may not want to spend and it is rarely the right call mid listing.
Do we have to do anything about lead paint?
You have to disclose. Anything built before 1978 is treated as carrying lead based paint, and that federal obligation sits on top of the California disclosure package rather than replacing any of it. You are not required to remediate to sell. In practice the buyers most likely to raise it are families with young children, so the useful step is to have the answer ready with the rest of the file, alongside the asbestos era materials that appear in anything pre 1980: ceiling texture, resilient flooring and mastic, duct wrap and roofing felt.
We were told the house feeds Troy High. How do we check?
By address, with the district, before it appears in any marketing. Six school systems serve parts of Fullerton: La Habra City, Buena Park, Fullerton School District, Brea Olinda Unified, Placentia Yorba Linda Unified and Fullerton Joint Union High School District. Troy High School is at 2200 East Dorothy Lane and is known for Troy Tech, its science and technology magnet, alongside Cambridge and International Baccalaureate programmes. Sunny Hills High is at 1801 Lancer Way and Fullerton Union High, created by special election in 1893, is at 201 East Chapman Avenue.
The house is on the east side of the city. Does that change the high school?
It can, and this is the most common Fullerton school error. The far eastern section of Fullerton, east of the 57 freeway, is served by El Dorado High School, which is a Placentia Yorba Linda Unified school located in Placentia at 1651 Valencia Avenue rather than a Fullerton Joint Union school. An heir who has never lived at the address has no reason to know this, and a buyer who wrote an offer expecting otherwise will cancel during their own inquiry period. Verify it in writing before it reaches a listing.
There is a small airport a few streets away. Does that belong in the file?

A buyer asked about the open hills on the west side. What is the honest answer?

The house is on the north ridge. Did anything change for fire in 2025?
It may have. The Fullerton City Council adopted the updated 2025 fire hazard severity zone classifications on 6 May 2025, incorporating them into Fullerton Municipal Code 13.19, with properties falling into Moderate, High or Very High. Because Moderate and High are now mapped locally for the first time, a hillside parcel in Coyote Hills, Raymond Hills, Sunny Hills or along the northern ridge can carry a class it did not carry in 2024. The city runs its own fire department and publishes an address searchable map. Do not assume flat Fullerton is unaffected without checking.
Should we renovate the house before selling, or sell it as is?
Start from the fact that the buyer inspects either way, so repairs do not remove a finding, they change who paid for it. In an estate with limited cash and a house nobody has updated in decades, selling as is with a complete report package already on the table is frequently the cleaner route. Where a small number of items are genuinely gating financing or insurance, those are worth doing. Treat the rest as a decision with numbers attached rather than a default, and price it as a decision the heirs made deliberately.
How do we work out whether this needs a full probate?
From the date of death, not the date you file. For deaths on or after 1 April 2025, an affidavit for personal property under Probate Code 13100 covers a gross estate to 208,850 dollars, a petition to determine succession to real property under Probate Code 13151 reaches 750,000 dollars but only for the decedent's California primary residence, and the small value real property affidavit under Probate Code 13200 covers 69,625 dollars. For deaths from 1 April 2022 to 31 March 2025 the first two figures are 184,500 dollars. Above the ceiling it is a full probate.
Why is the real property number so much bigger than the others?
Because it is not an inflation adjustment. The 750,000 dollar figure for a petition to determine succession to real property comes from AB 2016, Stats. 2024, ch. 331, and it applies only to the decedent's California primary residence. A rental, a second home or a property the decedent did not live in does not qualify at that number and falls back to the ordinary rules. The current figures hold through 31 March 2028, with the next adjustment due 1 April 2028. Confirm the date of death first, because it is what selects the table.
The house was in a trust. Does that change any of the property work?
Not the property side. You still need a date of death appraisal, you still have to decide between as is and preparing, and the permit reconstruction and the age related disclosures are identical. What changes is who signs and how. A trust is administered without a court under Probate Code 17209, by a successor trustee producing a Certification of Trust under Probate Code 18100.5, with a Probate Code 16061.7 notification due within sixty days of the trust becoming irrevocable. Will the estate owe capital gains tax if we sell?
Usually very little where the sale happens soon after death. Basis resets to date of death value under IRC 1014, so gain is measured only from that date forward, and IRC 1223(9) treats the sale as long term even inside the first year. Where the house was community property of a married couple, IRC 1014(b)(6) steps up both halves at the first death. California has no preferential capital gains rate, so the state taxes the gain as ordinary income. Is there any way to keep our parent's property tax base?
Only under Proposition 19 and only in a narrow case. For transfers on or after 16 February 2021 the exclusion applies to a family home that was the parent's principal residence and becomes the child's principal residence. The child claims the homeowners' exemption within one year of the transfer or date of death and files form BOE-19-P within three years or before any transfer to a third party. The cap is the parent's factored base year value plus 1,044,586 dollars for transfers from 16 February 2025 through 15 February 2027. Confirm the current figures with the Orange County Assessor.
Three of us inherited it and two want to sell. What actually happens?
First, nothing has to be decided immediately, and a decision made in the first month is usually the wrong one. Second, the heir who wants to keep it can buy the others out, which is a purchase needing financing and a documented value everyone can defend later, not an informal family arrangement. Third, where co owners genuinely cannot agree, one of them can ask a court to force a division or a sale. That route is slow, is paid for out of the same estate everybody is arguing over, and nobody controls the result.
