Trust Real Estate Agent in San Clemente, CA
Paula Aragone represents successor trustees selling San Clemente property held in a revocable trust, where a bluff top parcel stays appealable to the Coastal Commission after the city has issued the permit, and the rail line below the bluff is a disclosure rather than a view.
A San Clemente trust sale is handled by the successor trustee without a court, under Probate Code 17209. The local work is disclosure. PRC 30603 keeps a bluff top parcel appealable to the Coastal Commission even though the city issues the permit, Marblehead Coastal is still an Area of Deferred Certification, and passenger rail service through the city has been halted since 25 April 2025 for emergency work on the corridor.

A 1928 Resort Town on a Bluff With a Railroad at the Bottom of It
Ole Hanson built San Clemente to look like one thing. What governs a sale here now is not the architecture. It is which side of a coastal line the parcel falls on, and what is happening on the corridor below it.
Ole Hanson, a former mayor of Seattle, purchased the land in 1925 and developed it as a master planned Mediterranean style coastal resort town. The city was incorporated on 27 February 1928. Hanson required every building plan to go before an architectural review board, to enforce red tile roofs and white exteriors.
That consistency did not hold. The oldest neighbourhoods are now eclectic, which matters more to a trustee than it sounds. Where a district has no single build era and no single style, there is no district average to lean on. A valuation has to be assembled parcel by parcel, and the reasoning behind it has to be written down for beneficiaries who will read it from somewhere else.
The permit structure is the second layer. PRC 30600 requires a coastal development permit for development in the coastal zone. Once a Local Coastal Program is certified, the city issues that permit, except on tidelands, submerged lands and public trust lands. San Clemente's Local Coastal Program is segmented, and one segment, Marblehead Coastal, remains uncertified as an Area of Deferred Certification, where permit authority is not fully delegated. For a trustee that is a timeline item, not a technicality.
PRC 30603 is the part that surprises families. A local permit decision stays appealable to the Coastal Commission where development is between the sea and the first public road paralleling the sea, within 300 feet of the inland extent of any beach, or within 300 feet of the top of the seaward face of any coastal bluff. The appeal window is 10 working days from the Notice of Final Action. A bluff top San Clemente property remains exposed to Commission appeal even though the city issued the permit.
The corridor is the other half. The Surf Line runs along the bottom of the bluff and it has failed repeatedly. It closed from 15 September to 3 October 2021 after beach erosion and storm damage. Passenger traffic was halted on 29 September 2022 for soil movement. A further landslide closed it in April 2023, and the Casa Romantica landslide on the bluff above closed it again in June 2023, with service resuming on 19 July 2023. On 25 January 2024 a landslide from private property north of the San Clemente Pier damaged the Mariposa Pedestrian Bridge, with limited service returning on 6 March 2024 and full service on 25 March 2024. Passenger rail service through San Clemente has been halted since 25 April 2025 for emergency reinforcement work.
The work is substantial and it is public. Stabilisation to date includes riprap between the beach and the tracks, steel anchors driven into bedrock, and a 250 foot barrier wall 12 feet high on piles set 32 feet deep, built under an emergency declaration. OCTA is working four emergency areas identified by milepost, roughly 95 percent sand and 5 percent rock, with about 540,000 cubic yards of sand between North Beach and Mariposa Point, at a total programme cost of 310.5 million dollars. Longer term, the Orange County Coastal Rail Resiliency Study covers more than 40 miles of the LOSSAN corridor from San Clemente to Fullerton, with the vulnerability assessment completed in winter 2024 and the final report due to the OCTA Board in fall 2026, aiming to protect the railroad for up to 30 years. A separate initiative studies relocating the line inland between San Juan Capistrano and San Onofre State Beach. None of that is a reason to panic and all of it is a reason to disclose.
Taking a San Clemente Trust Property From Death to Closing
The trust part of this is the same anywhere in California. The San Clemente part is the coastal file and the corridor, and both take longer to assemble than a listing calendar allows if they are started after an offer arrives.
Establish the trustee's authority and the trust's date
Read the instrument and every amendment. Confirm who succeeds, whether co trustees have to sign together, and whether an acceptance or a predecessor's resignation is required first. A deed signed by one of two required co trustees is a defect a title officer finds later, which is far more expensive than reading the document now.
Serve the 16061.7 notification and start the clock
Probate Code 16061.7 requires service within sixty days of the trust becoming irrevocable, on every beneficiary and every heir of the deceased settlor, including one the trust disinherits. Service opens the 120 day contest period. Until then it has not started, and an open contest window is what stalls a trust listing at title review.
Record the affidavit against the San Clemente parcel
Record an Affidavit of Death of Trustee with the Orange County Clerk Recorder, with a certified death certificate, so the succession is already in the chain of title when the buyer's title officer opens the file. The south county branch at 24031 El Toro Road in Laguna Hills is the nearer counter for a San Clemente parcel.
Confirm the parcel was ever deeded into the trust
Where the grant deed still reads in the settlor's individual name, the trustee cannot convey it. If written intent exists on a schedule of assets or a general assignment, a Probate Code 850 petition confirms the property into the trust, following Estate of Heggstad (1993) 16 Cal.App.4th 943. Learning this in escrow costs months of the beneficiaries' time.
Find out whether the parcel sits in the appealable zone
PRC 30603 makes a local coastal permit decision appealable to the Coastal Commission where development is between the sea and the first public road paralleling the sea, within 300 feet of the inland extent of any beach, or within 300 feet of the top of the seaward face of any coastal bluff. Establish which of those, if any, describes the parcel before making promises about timelines.
Trace the coastal permit history for anything a parent built
PRC 30600 requires a coastal development permit for development in the coastal zone, issued by the city once a Local Coastal Program is certified, except on tidelands, submerged lands and public trust lands. A deck, a wall or an addition put in decades ago may or may not have one. Find out, and disclose what the search found, including nothing.
Build the rail corridor into the disclosure, with dates
The Surf Line through San Clemente has closed repeatedly since 2021, and passenger service has been halted since 25 April 2025 for emergency reinforcement. Set it out plainly, with the dates and the works, rather than leaving a buyer to find it themselves. A documented public record disclosed early is a fact. Discovered late, it reads as something that was hidden.
Value it by district and exposure, then write the reasoning down
Probate Code 16003 requires impartiality among beneficiaries and 16060 requires keeping them reasonably informed. In a city whose oldest districts are architecturally eclectic, a valuation is assembled parcel by parcel, and the reasoning has to be written so a beneficiary who lives elsewhere can follow how the number was reached.
Market it openly, close, then account and distribute
Probate Code 16002 requires administration solely in the interest of the beneficiaries, and a quiet sale to somebody the family knows is the transaction most often attacked afterwards. Market broadly, keep every offer in writing, close into the trust rather than to individuals, then account and distribute.
San Clemente From North Beach to Marblehead, and What Each One Adds to the File
The names below are the ones the record supports. Each of them changes something concrete: which permit route applies, which appeal exposure exists, which school serves the address, or which part of the corridor sits below.
Southwest San Clemente
One of the districts named in the city's own history, and one of the oldest. Age without a single build era means the inspection profile is a parcel level question, and the permit history matters more here than any generalisation about the neighbourhood.
North Beach
A named San Clemente district, and the northern end of the stretch where OCTA has placed roughly 540,000 cubic yards of sand between North Beach and Mariposa Point. Sand placement, trail restoration and construction access are current conditions, not history, and they belong in the disclosure.
The Lasuen boot district
The district around Lost Winds beach. Proximity to a beach is precisely what triggers PRC 30603 appealability, since a permit decision remains appealable where development sits within 300 feet of the inland extent of any beach. Establish the distance before promising a permit timeline.
Southwest Riviera
A named San Clemente neighbourhood. Where a trustee never lived in the property, the correct answer to an unknown is that it is unknown, stated in writing. In older coastal districts that answer comes up more often than families expect, and it is a better answer than a guess.
Marblehead Coastal
The uncertified segment of the city's Local Coastal Program, an Area of Deferred Certification where coastal permit authority is not fully delegated to the city. If a parcel or a piece of past work falls inside it, treat the permit question as a schedule item rather than an administrative one.
San Clemente High School
The Capistrano Unified high school in the city. Capistrano Unified serves San Clemente, with the district office at 33122 Valle Rd in San Juan Capistrano on 949-234-9200. Attendance areas are set by address and districts revise them, so confirm before it appears in marketing.
Bernice Ayer Middle School
One of the two Capistrano Unified middle schools in San Clemente. Two middle schools in one city means the attendance line runs through it, which makes school assignment an address question rather than a city question.
Shorecliffs Middle School
The second Capistrano Unified middle school in the city. Confirm the assignment with the district and keep the written confirmation with the disclosure package, because a buyer will verify it independently and quickly.
The two rail stations
Amtrak Pacific Surfliner and Metrolink serve two stations in San Clemente. In normal conditions that is a genuine amenity for a commuting buyer. With passenger service halted since 25 April 2025 for emergency work, it is a fact that has to be stated as it currently stands rather than as it has historically been marketed.
The Surf Line right of way
The corridor at the base of the bluff, where a recurring landslide intersects the right of way and wave action at high tide reaches the tracks. Closures are documented from 2021 onward, which makes this an unusually well evidenced disclosure and an unusually poor one to leave out.
The four OCTA emergency areas
Identified by milepost. Areas 1 and 2 covered riprap repair and sand nourishment and are complete. Area 3 is catchment wall construction with trail restoration, under construction. Area 4 is engineered shore protection and sand nourishment, underway. Total programme cost is 310.5 million dollars.
Casa Romantica
The bluff above the tracks where a landslide in June 2023 halted rail service until 19 July 2023. It is the clearest local illustration that bluff stability and the corridor are one subject rather than two, and that the disclosure has to treat them together.
The San Clemente Pier and the Mariposa Pedestrian Bridge
On 25 January 2024 a landslide from private property north of the pier damaged the Mariposa Pedestrian Bridge, with limited rail service returning 6 March 2024 and full service 25 March 2024. Private property was the source, which is why bluff conditions on a specific parcel are worth documenting.
The 1928 architectural legacy
Hanson's review board enforced red tile roofs and white exteriors, and that consistency did not survive. The eclectic result means an appraiser and a buyer's inspector both work parcel by parcel, and a trustee who quotes a district average has quoted something that does not exist.
Six San Clemente Items That Belong in the File Before the Sign Goes Up
San Clemente, California
The trust mechanics here are the same as anywhere in California. What is different is a coastal permit structure with a segment missing and a rail corridor with a public failure record, and both take time to document.
The city issued the permit and everyone assumed that ended it
PRC 30603 keeps a local coastal permit decision appealable to the Coastal Commission where development is between the sea and the first public road paralleling the sea, within 300 feet of the inland extent of any beach, or within 300 feet of the top of the seaward face of any coastal bluff. The appeal window is 10 working days from the Notice of Final Action.
For a bluff top parcel that means city approval is a stage rather than a conclusion. A trustee who has promised beneficiaries a date based on the city's calendar alone has promised something the statute does not support.
The parcel falls inside the deferred segment
San Clemente's Local Coastal Program is segmented, and Marblehead Coastal remains an Area of Deferred Certification. Permit authority there is not fully delegated to the city, which is a real timeline item rather than a paperwork nuance.
Establish early whether the parcel, or any work done on it, falls inside that segment. It changes who decides, and therefore how long anything outstanding takes to resolve.
The rail corridor was left out because it is not on the form
The natural hazard statement under Civil Code 1103.2 covers six categories: FEMA special flood hazard area, dam failure inundation area, fire hazard severity zone, wildland fire area under PRC 4125, earthquake fault zone under PRC 2622, and seismic hazard zone under PRC 2696. A rail corridor with a landslide history is not one of the six.
That does not make it immaterial. Closures are documented from September 2021 through the halt to passenger service on 25 April 2025, and the work under way is public and large. Disclosed early with dates, it is a fact a buyer can price. Discovered late, it reads as concealment, and the trustee is the one who signed.
A parent's deck or wall was built without a coastal permit
PRC 30600 requires a coastal development permit for development in the coastal zone, issued by the city once its Local Coastal Program is certified, except on tidelands, submerged lands and public trust lands. Work added to a coastal parcel over forty years may or may not have one behind it.
The successor trustee did not build it and usually cannot date it. Search for the permit, disclose what the search returned, and where nothing can be produced say exactly that. An honest unknown is a disclosure. A reassurance is a representation the estate has to stand behind.
The disclosure stack was assembled from an old report
CAL FIRE released updated Local Responsibility Area maps in four phases between 10 February and 24 March 2025, and those maps carry Moderate and High zones as well as Very High for the first time. A parcel that carried no zone under the older mapping can carry one now.
Check the current classification for the specific parcel rather than relying on a prior report or a city wide summary. Where the parcel is in a High or Very High zone, Civil Code 1102.19 requires documentation of defensible space compliance at transfer, or a signed agreement giving the buyer one year after closing to obtain it.
The trust documents waited on the property work
It is the most common sequencing error in trust sales anywhere, and a coastal file makes it worse because the property work takes so long that the document work feels like it can wait. It cannot. Probate Code 16061.7 runs from the death, not from the listing.
Serve the notification inside sixty days, record the Affidavit of Death of Trustee, and confirm the deed actually put the property into the trust. Those three things run in parallel with everything else and they are what a title underwriter reads first.
Sell the San Clemente Property, or Let a Child Take It On
A coastal parcel carries obligations that outlast the settlor: permits, bluff conditions, and a corridor whose permanent alignment is still being studied. The tax rules pull in opposite directions, and the maintenance question sits on top of both.
Selling is what the basis rule rewards
IRC section 1014(a) resets basis to the property's fair market value at the date of death, or at the alternate valuation date if the executor elects it on Form 706. Everything the property gained during the settlor's lifetime drops out for income tax purposes, and gain is measured only from the date of death forward. A sale soon after death often produces close to no gain at all.
Where the home was community property of a married couple, IRC 1014(b)(6) steps up the surviving spouse's own half as well, at the first death. That is a California result and it is not available in most states.
IRC 1223(9) settles the holding period. Property taking its basis under section 1014 and sold within one year of the death is treated as held more than one year, so long term rates apply regardless of the actual calendar.
All of it depends on a qualified date of death appraisal. Without one the value can be argued down later and gain appears where the beneficiaries were told there was none. On a coastal parcel with an unusual permit and disclosure profile, that appraisal is worth commissioning properly. General information, not tax advice.
Keeping it is what Proposition 19 rewards, on strict conditions
Since 16 February 2021 the parent to child exclusion under Revenue and Taxation Code 63.2 applies only to a family home that was the transferor's principal residence and becomes the transferee's principal residence, or to a family farm. A second home or a rental is fully reassessed, and the former Proposition 58 and 193 exclusion for other real property no longer exists.
The deadlines decide it. The transferee has to claim the homeowners' exemption, or the disabled veterans' exemption, within one year of the transfer or the date of death, and the exclusion terminates if they stop qualifying. Form BOE-19-P is due within three years of the death or transfer, or before a transfer to a third party, whichever comes first.
The exclusion is capped at the factored base year value plus 1,044,586 dollars for transfers from 16 February 2025 through 15 February 2027. At or below that sum nothing is reassessed. Above it, the new taxable value is market value minus 1,044,586 dollars rather than the parent's old figure.
The conflict is with IRC section 121, which needs ownership for at least 24 months and use as a residence for at least 24 months out of the five years before sale. A child who moves in only to hold the tax base and sells at month twenty gets neither section 121 nor the clean early sale the basis rule offered. On a coastal property there is also a maintenance question that lasts longer than either deadline, and it belongs in the same conversation.
The Trustee Is Judged on What Was Disclosed, and When
Paula Aragone has worked Orange County transactions for 23 years, across 900+ transactions and $900M+ sold, and she came to real estate after four years of law school. She holds the CPRES and SRES designations. Estate and family law attorneys route trust files here for that reason, rather than to an agent meeting these statutes for the first time.
The duties are specific. Probate Code 16002 requires administration solely in the interest of the beneficiaries. Probate Code 16003 requires impartiality among them. Probate Code 16004 and 16005 prohibit self dealing and personal profit. Probate Code 16060 requires keeping beneficiaries reasonably informed. In San Clemente the duty that gets exercised hardest is 16060, because the questions a beneficiary asks about a coastal parcel are questions that need records rather than reassurance.
Disputes between beneficiaries and trustees rarely open on price. They open on a sale that looked arranged, or a disclosure the trustee could not support. On this coast the disclosure record is unusually complete, which cuts both ways: everything is documented, so a buyer who finds it later will ask why the seller did not produce it. Broad marketing, a valuation built parcel by parcel, every offer preserved in writing, and a coastal and corridor disclosure assembled from public records are what protect the person who signed the deed.
Where a beneficiary objects, the petition runs under Probate Code 17200, and the remedies in 16420(a) include compelling redress, enjoining a breach, removing the trustee, setting aside acts and reducing or denying compensation. Probate Code 18100 nonetheless fully protects a buyer who dealt with the trustee in good faith, for valuable consideration and without actual knowledge that the trustee exceeded its powers, so a closed sale is seldom undone. The exposure that survives is personal, and the record is what answers it.
San Clemente Trust Sales, the Bluff and the Rail Line, Answered
What successor trustees and beneficiaries ask here, answered from California law and from the public record of the coast and the corridor.
Does a San Clemente trust sale go through probate court?
No. Probate Code 17209 provides that trust administration is intended to proceed expeditiously and free of judicial intervention, subject to the court's jurisdiction. There is no confirmation hearing, no ninety percent of appraisal floor and no courtroom overbid. The successor trustee sells directly under Probate Code 16226 and the powers written into the trust itself.
Do we need a coastal development permit just to sell?
No. PRC 30600 attaches the coastal development permit requirement to development in the coastal zone, and a sale is not development. What a trustee has to worry about is past development: a deck, a wall, an addition or a hardscape change made over the years that may have needed a permit and may not have had one. Search for the permit history, disclose what the search found, and where nothing can be produced, say so in writing.
The city approved my neighbour's permit. Why is my parcel appealable to the Coastal Commission?
PRC 30603 keeps a local coastal permit decision appealable where the development is between the sea and the first public road paralleling the sea, within 300 feet of the inland extent of any beach, or within 300 feet of the top of the seaward face of any coastal bluff. The appeal window is 10 working days from the Notice of Final Action. Two neighbouring parcels can fall on opposite sides of one of those lines, and the city's approval is not the last word on the one that does.
What is Marblehead Coastal and why does it matter to a trust sale?
San Clemente's Local Coastal Program is segmented, and Marblehead Coastal is an uncertified segment, an Area of Deferred Certification. Coastal permit authority there is not fully delegated to the city. If the parcel, or any outstanding work on it, falls within that segment, the question of who decides is different and the timeline is longer. Establish it early rather than after a buyer's inspection raises it.
Do we have to disclose the railroad?
Treat it as material and disclose it plainly. The corridor at the base of the bluff has closed repeatedly: 15 September to 3 October 2021 after beach erosion and storm damage, 29 September 2022 for soil movement, April 2023 for a further landslide, June 2023 for the Casa Romantica landslide with service resuming 19 July 2023, and 25 January 2024 when a landslide from private property north of the pier damaged the Mariposa Pedestrian Bridge. Passenger service has been halted since 25 April 2025. It is documented, it is public, and a buyer will find it.
Is the train coming back?
That is not settled, and a trustee should not answer it as though it were. Passenger service through San Clemente has been halted since 25 April 2025 for emergency reinforcement work. Separately, the Orange County Coastal Rail Resiliency Study covers more than 40 miles of the LOSSAN corridor from San Clemente to Fullerton, with the vulnerability assessment completed in winter 2024 and the final report due to the OCTA Board in fall 2026, aiming to protect the railroad for up to 30 years. A separate initiative is studying relocating the line inland between San Juan Capistrano and San Onofre State Beach.
What has actually been built to protect the tracks?
Stabilisation to date includes riprap between the beach and the tracks, steel anchors driven into bedrock, and a 250 foot barrier wall 12 feet high on piles set 32 feet deep, constructed under an emergency declaration. OCTA is working four emergency areas identified by milepost, with roughly 95 percent sand and 5 percent rock, about 540,000 cubic yards of sand between North Beach and Mariposa Point, at a total programme cost of 310.5 million dollars. Areas 1 and 2 are complete, Area 3 is under construction and Area 4 is underway.
What does the title company need from the trust?
In practice a Certification of Trust under Probate Code 18100.5, a certified death certificate, and an Affidavit of Death of Trustee recorded against the San Clemente parcel with the Orange County Clerk Recorder. Underwriters frequently also ask for the trust instrument itself and for evidence that the Probate Code 16061.7 notification was served. That is underwriting practice rather than statute and it varies, so ask the specific title company at the start.
When do the beneficiaries have to be notified?
Within sixty days of the trust becoming irrevocable, which for most families is the settlor's death, or within sixty days of the trustee learning of a person entitled to notice. Probate Code 16061.7 requires service on every beneficiary and every heir of the deceased settlor, including one the trust disinherits. Serve it before the property is listed and keep proof of service, because it is one of the first things a title underwriter looks for.
What does the 120 day warning mean?
The notification has to carry, in at least ten point boldface, a warning that no action to contest the trust may be brought more than 120 days from service of the notice, or sixty days from delivery of a copy of the trust terms within that period, whichever is later. The clock runs from service and from nothing else, so a notice that was never sent leaves the contest window permanently open.
Title is still in my father's name. What do we do?
The trustee cannot convey it in that condition. Where the settlor's written intent is documented on a schedule of assets, an assignment or a general transfer, the route is a petition under Probate Code 850, known as a Heggstad petition after Estate of Heggstad (1993) 16 Cal.App.4th 943, where a written declaration naming the settlor as trustee was held sufficient without a separate deed. Where no such writing exists, the property goes through probate and the timeline changes entirely.
Which schools serve a San Clemente address?
Capistrano Unified serves San Clemente. San Clemente High School is the district high school in the city, and Bernice Ayer and Shorecliffs are the district middle schools here. Because there are two middle schools, an attendance line runs through the city, so the answer is an address question rather than a city question. Confirm with the district office at 33122 Valle Rd in San Juan Capistrano on 949-234-9200 before schools appear in marketing.
How do we find out whether a special tax applies to the parcel?
Confirm it parcel by parcel, by assessor's parcel number, with the Orange County Treasurer Tax Collector, rather than from what anyone believes about the area. Where a Community Facilities District applies, Civil Code 1102.6b requires the seller to make a good faith effort to obtain a disclosure notice from each levying agency and deliver it to the buyer, with Government Code 53311 as the enabling act. The line item on the tax bill is not that notice.
Will the family owe capital gains tax on the sale?
Usually very little where the sale follows the death closely. IRC section 1014 resets basis to fair market value at the date of death, so gain runs only from that date forward, and IRC 1223(9) treats a sale within one year as long term. Where the home was community property, IRC 1014(b)(6) steps up both halves. Gain recognised inside an unadministered estate or an irrevocable trust is taxed hard, because the 2026 estate and trust breakpoints are 3,300 dollars and 16,250 dollars. General information, not tax advice.
How does Proposition 19 work if a child moves in?
The exclusion applies only where the home was the parent's principal residence and becomes the child's principal residence. The child must claim the homeowners' exemption within one year of the transfer or the date of death and file form BOE-19-P within three years, or before any transfer to a third party. The excluded amount is the factored base year value plus 1,044,586 dollars for transfers from 16 February 2025 through 15 February 2027. Above that, the new taxable value is market value minus that figure. Confirm the current numbers with the Orange County Assessor.
Can a beneficiary halt the escrow?
Before closing it is possible, afterwards it is close to impossible. A beneficiary petitions under Probate Code 17200, and the remedies in 16420(a) include enjoining a breach, removing the trustee, setting aside acts and reducing or denying compensation. Probate Code 18100 fully protects a buyer who dealt with the trustee in good faith, for valuable consideration and without actual knowledge that the trustee exceeded its powers. To reach that buyer the beneficiary has to obtain an injunction before closing and record a lis pendens. Otherwise the remedy is money against the trustee personally.
