Inherited Property Agent in Laguna Beach, CA
Paula Aragone works with heirs who have inherited a Laguna Beach property, in a city where the report the seller needs has to exist before any agreement of sale is signed, and where the ground under the house is a document rather than a view.
Two things run in parallel here. First, which procedure the estate is on, which the date of death decides: 208,850 dollars for the personal property affidavit, 750,000 dollars for a petition to determine succession to the decedent's California primary residence, and 69,625 dollars for the low value real property affidavit, for deaths on or after 1 April 2025. Second, the Real Property Report, which the city requires before you enter an agreement of sale at all.
| The threshold trigger | The date of death, not the date of filing |
|---|---|
| Personal property affidavit | 208,850 dollars, deaths on or after 1 April 2025 |
| Succession to real property | 750,000 dollars, primary residence only, AB 2016 |
| Low value real property | 69,625 dollars, Probate Code 13200 |
| Before any agreement of sale | The city's Real Property Report, through the online portal |
| Four addresses out of city hands | Irvine Cove, Blue Lagoon, Hobo Canyon, Three Arch Bay |
You Inherited a House and a Place in a Queue
In most cities an heir decides when to list. Here the city, the geology and the buyer's insurer each take a turn first, and none of them move faster because the family is ready.
The front end is the Real Property Report. The city requires one before entering into an agreement of sale or exchange of any real property, and applications and payment are accepted only through the online permit portal. An industry summary describes it as applying to all property types including commercial and vacant land, with no inspection component and roughly a seven day turnaround, though the fee and timing should be confirmed with the Planning Division on 949-497-0713. Newport Beach no longer has an equivalent requirement. Laguna Beach does, and it sets the front of the calendar.
The second item is geology. Municipal code requires an engineering geologic report by a registered engineering geologist for subdivisions, grading, road and street work creating building sites, habitable structures, and major additions exceeding fifty percent of existing floor area. Pools, spas, smaller additions and retention devices over five feet require geologic review after excavation and before structural installation. The reports must address landslide, slump, mudflow, creep, faulting and erosion, slope stability, ground and surface water, and performance under saturation plus the maximum probable earthquake, assuming a minimum fifty year project life.
The third is who issues the coastal permit. The city has had a certified Local Coastal Program since 13 January 1993, but four areas inside the city limits are not covered by it: Irvine Cove, Blue Lagoon, Hobo Canyon and Three Arch Bay. In those four, the California Coastal Commission issues coastal development permits, not the city. Elsewhere the appeal band reaches development between the sea and the first public road, within 300 feet of the inland extent of any beach or the mean high tide line, within 100 feet of a wetland, estuary or stream, and within 300 feet of a coastal bluff top or face, with a ten working day appeal window from the Notice of Final Action.
What the heir receives is the oldest housing stock of the coastal cities by a wide margin. From the sixth cycle Housing Element, the largest single cohort, 20.2 percent, was built in 1939 or earlier; 1950 to 1979 accounts for 49.1 percent; only 1.4 percent was built after 2010; and roughly 69.3 percent of the stock predates 1980. Single family detached is 65.9 percent at 8,591 units, single family attached 5.4 percent, two to four units 11.7 percent, five or more units 14.8 percent and mobile homes 2.2 percent.
That age produces a predictable inspection list: knob and tube, cloth wrapped wiring, undersized services, Federal Pacific and Zinsco panels, aluminium branch wiring in 1960s and 1970s builds, galvanised supply, cast iron drains, asbestos in popcorn ceilings, pipe wrap and flooring, lead paint in pre 1978 stock, single pane aluminium windows, and polybutylene in late 1970s to early 1990s work. Add the Laguna items: raised foundations on hillside cripple walls and caissons, retaining walls of uncertain permit status, and decks and stairs cantilevered off slopes.
Then there is what nobody permitted. Substandard lots, steep access and a demanding design review regime make this the city where a past addition is most likely to have been done quietly. An heir cannot answer that from memory, so the route is the city's public permit portal for permit, plan, inspection and project status, the scanned property file in OnBase and the other records in Laserfiche, searched by address with an asterisk for the street type or by assessor's parcel number in the XXX-XXX-XX format.
What to Do With an Inherited Laguna Beach Property
The heir's sequence in a city that sets part of the calendar for you. Two items here are not optional and not fast: the Real Property Report at the front end, and whatever geologic documentation the parcel turns out to need.
Match the date of death to the right procedure
The thresholds move with the date of death. Deaths on or after 1 April 2025 use 208,850 dollars for the personal property affidavit under Probate Code 13100, 750,000 dollars for a petition to determine succession to real property where the home was the decedent's California primary residence, and 69,625 dollars under Probate Code 13200. Deaths from 1 April 2022 to 31 March 2025 use 184,500 dollars for the first two.
Obtain signing authority before you order anything
The city portal, the appraiser and the insurer all need one person with authority. In a probate that is Letters, full or limited under Probate Code 10402 and 10403. In a trust it is the successor trustee holding a Certification of Trust under Probate Code 18100.5. Establish which in writing first, because ordering reports in a dead person's name wastes weeks you will want later.
Make the house safe, insured and closed up
Change the locks, keep the utilities on and call the carrier. The policy is likely still in the name of someone who has died, and an unoccupied house is not what it was underwritten for. In a city where nearly seventy percent of the stock predates 1980 and a fifth of it predates 1940, an empty house with old supply lines is a claim waiting to happen.
Commission the date of death appraisal
Basis resets to fair market value at the date of death under IRC 1014, and the appraisal is what proves that number to anyone who asks later. Laguna parcels are individual rather than comparable, so the appraiser needs the cove, canyon or ridge, the access, the parking and the slope, not a city wide average. Order it while the property is still as it was.
Deal with the contents, the studio and any occupant
Photograph every room before anything moves, because personal property leaves first and disputes start there. Establish whether anyone occupies the property: two to four unit buildings make up 11.7 percent of the housing here and five or more units another 14.8 percent. Collect the agreement, the rent roll and the deposits, and take advice on notice before making plans.
Order the Real Property Report and decide on repairs
The city requires a Real Property Report before entering into an agreement of sale or exchange, and applications and payment go through the online permit portal only. Order it at the start. In the same week, cost the repairs you are considering against selling as is with a full inspection package, and pick deliberately rather than by default.
Reconstruct what the family cannot remember
Pull the permit portal history and the scanned property file, searching by address with an asterisk for the street type or by assessor's parcel number. Laguna's substandard lots and design review regime make this the city where a past addition, deck, stair or retaining wall is most likely to have been built quietly. Find the gaps before a buyer's inspector does.
List, and expect the coastal and geology questions
Buyers here ask about slope stability, prior grading permits, evidence of remediation and insurance availability, usually in the first week. Have the answers assembled. Market the property openly and keep every offer in writing, because an heir who accepts a quiet early offer will be asked by a sibling to explain it years afterwards.
Close at the Laguna Hills counter, then distribute
Recording for South County runs through the Orange County Clerk Recorder branch at 24031 El Toro Road in Laguna Hills, the nearer of the two counters. Escrow disburses to the estate or the trust rather than to heirs individually. Documentary transfer tax is 1.10 dollars for each 1,000 dollars of net consideration, and distribution follows the will, the trust or intestate succession.
Coves, Canyons and Ridges, and What Each Hands an Heir
Two Laguna properties a mile apart can carry different permitting authorities, different slope questions and different insurance answers. The neighbourhood is where that starts.
North Laguna, the Tree Streets
The alphabetical botanical grid from Aster to Myrtle, with a planned layout, mature canopy and older cottage stock mixed with rebuilds. Long held family cottages here carry the full pre 1940 inspection list.
North Laguna coves and bluffs
Cliff Drive, Shaw's Cove, Crescent Bay and Wave Street to McKnight Drive. Bluff front and tidepool adjacent, with high visitor pressure and coastal review reaching most of what a buyer might want to change.
The Village, downtown
The historic civic and commercial core with storybook cottages, the Festival grounds and Main Beach. Highest tourism exposure in the city, and parking that an heir should describe honestly rather than optimistically.
Woods Cove
Rocky bluff coastline south of downtown with older architecture, narrow streets and prized cove access. Substandard lots and steep access make the permit history the first document to pull on an estate property.
Victoria Beach and Lagunita
Pirate Tower, gated sand at Lagunita and eclectic cottage stock above. Heavy visitor traffic and parking pressure from social media driven day trips, which belongs in an honest conversation with a buyer.
Bluebird Canyon, upper and lower
Deep set lots on a winding canyon, and the city's landslide neighbourhood. An estate here should assume a buyer will ask for slope stability work, prior grading permits and evidence of remediation.
Arch Beach Heights and Summit Ridge
A ridgeline grid more than a thousand feet above the ocean, with tight substandard streets and evacuation via Nyes Place. Access and fire questions arrive together on any inherited property up here.
Mystic Hills and Temple Hills
Steep terrain and bold contemporary architecture, with the Temple Hills Community Association active. Mystic Hills was the neighbourhood most affected by the 1993 firestorm, which buyers still ask about.
Top of the World and Park Avenue Estates
Hilltop around Alta Laguna Park at the wilderness edge, with the TOWNA association and Firewise USA recognition. Defensible space documentation is a live item rather than a formality here.
Laguna Canyon and the Terraces
Artist studios and residential terraces along the canyon corridor, with flood and wildlife corridor issues and the city's main inland access. An inherited studio property needs its permitted use established early.
South Laguna Village
Numbered and botanical residential fingers with village scale retail. Older small lot stock, which means the permit file and the Real Property Report do more work than the marketing photographs.
Three Arch Bay
The southernmost gated community, with a private beach and park and its own community services district. Also an Area of Deferred Certification, so the Coastal Commission issues coastal permits here, not the city.
Emerald Bay
A gated community of approximately 538 residences in unincorporated Orange County, the only unincorporated populated place on the county coastline, with a single entrance, a tunnel, a private beach and its own fire station.
Irvine Cove
A gated enclave at the northern city limit bordering Crystal Cove State Park, and an Area of Deferred Certification. A buyer planning a remodel here applies to the Coastal Commission, on the Commission's calendar.
Smithcliffs
A small gated oceanfront bluff enclave south of Emerald Bay. Bluff position means geologic documentation and, after the Casa Mira decision, a hard look at whether any armouring could ever be permitted.
Blue Lagoon and Hobo Canyon
Both Areas of Deferred Certification, so coastal development permits come from the Coastal Commission rather than from Laguna Beach. That is a material timeline fact for any buyer intending to renovate.
The Montage district
Portafina and the resort adjacent estates in South Laguna, plus Camel Point and the South Laguna bluffs. Bluff top parcels here carry the geology file and the coastal appeal band together.
Six Reasons a Laguna Beach Inheritance Moves Slowly
Laguna Beach, California
None of these are about demand. Each one is a report, a permitting authority or an underwriter that has to be satisfied before the family can act on a decision it has already made.
The Real Property Report has to exist before you sign anything
The city requires a Real Property Report before entering into an agreement of sale or exchange of any real property, and applications and payment are accepted only through its online permit portal. This is not a document to produce during escrow. It is a condition of getting to escrow.
An industry summary puts the turnaround at roughly seven days with no inspection component, but the fee and the timing should be confirmed directly with the Planning Division on 949-497-0713. For an heir the practical point is simple: order it in the first week, because everything else in the listing sequence waits behind it.
The parcel sits where the city does not issue the permit
Laguna Beach has had a certified Local Coastal Program since 13 January 1993, but four areas inside the city limits are not covered by it: Irvine Cove, Blue Lagoon, Hobo Canyon and Three Arch Bay. In those four the California Coastal Commission issues coastal development permits.
That is a material fact for any buyer intending to renovate, and it is the kind of thing an heir has no reason to know. A buyer who plans a remodel in one of those four is applying to Sacramento on the Commission's calendar, not to Laguna Beach. Say so early, because the buyer who finds out late cancels.
The deck, the wall and the addition have no paper
Substandard lots, steep access and an intensive design review regime make this the city where a past addition is most likely to have been built quietly. The heir who never lived in the house cannot say what was approved, and neither can anybody else in the family.
The route is the city's public permit portal for permit, plan and inspection history, the scanned property file in OnBase, and Laserfiche for other records, searched by address with an asterisk for the street type or by assessor's parcel number in the XXX-XXX-XX format. Do it before listing rather than during a buyer's inspection period.
The buyer's insurance quote decides the closing date
The City Council adopted the updated CAL FIRE local responsibility area maps on 24 June 2025, covering Moderate, High and Very High classifications. Laguna Beach runs its own fire department rather than sitting under the Orange County Fire Authority, so defensible space work and AB 38 documentation under Civil Code 1102.19 go through the city's Fire Marshal on 949-397-0352.
Insurance availability is the constraint buyers raise first, with the FAIR Plan as the fallback market. The Department of Insurance Sustainable Insurance Strategy pairs catastrophe modelling and net cost of reinsurance in rate making, finalised in December 2024, with a commitment that insurers write at least eighty five percent of properties across 662 designated distressed ZIP codes. CAL FIRE states separately that the hazard maps themselves do not set rates or availability.
Something recorded against the property binds whoever buys it
Historic listing here is voluntary under Chapter 25.45 and requires the owner's agreement, and the city has expressly recognised the older Ordinance 82.111 inventory as ineffective for creating a presumption of historicity. But once a property is registered, the Heritage Committee reviews alterations and a preservation agreement is recorded with the county, binding subsequent owners.
New Mills Act applications are temporarily suspended, which changes the calculus for a buyer weighing the obligation against the benefit. Check title for a recorded preservation agreement before anybody tells a buyer the house can be remodelled freely. Check the tax bill too, because a Rule 20B utility undergrounding assessment district is a disclosure item and those projects run four to six years.
The geology report the estate does not have
Bluebird Canyon slid on 2 October 1978 and again on 1 June 2005, the second destroying homes. Buyers on any hillside parcel ask for a soils and slope stability report, prior grading permits and evidence of remediation, and they ask early. The parcel specific check starts with the California Geological Survey Earthquake Zones of Required Investigation viewer.
The city's own requirements are extensive: an engineering geologic report by a registered engineering geologist for habitable structures, grading and major additions exceeding fifty percent of existing floor area, addressing landslide, slump, mudflow, creep, faulting and erosion, slope stability, ground and surface water, and performance under saturation plus the maximum probable earthquake, on a minimum fifty year project life.
Sell the Laguna House, or Have One Heir Take It On
The tax rules pull in opposite directions everywhere. Here a third question joins them, because holding a hillside cottage means carrying its insurance, its geology and its maintenance rather than merely its mortgage.
Sell it
Basis resets to fair market value at the date of death under IRC 1014, so decades of appreciation on a cove cottage disappear for income tax purposes. Gain runs only from the date of death forward, which is why a sale soon after death often produces close to no gain and sometimes a small loss once selling costs are counted.
Where the property was held as community property by a married couple, IRC 1014(b)(6) gives the surviving spouse's own half a new basis as well, so both halves step up at the first death. Under IRC 1223(9), property taking its basis from section 1014 and sold within a year of death is treated as long term regardless of how briefly the estate actually held it.
What protects all of it is a qualified date of death appraisal, and in this city that means an appraiser who understands that the parcel, the access, the parking and the slope are the property. The second mechanic is who recognises the gain: estates and trusts reach the top long term rate at 16,250 dollars of taxable income against 613,700 dollars for a married couple filing jointly, so selling inside the estate or distributing first is a question for the accountant before anything is listed.
The honest downside: selling here is not quick even when the decision is. The Real Property Report comes first, the geology questions come next, and the buyer's insurance quote can move a closing date by weeks. An estate that wants speed above all will be disappointed, and a house with 1930s systems behind a beautiful facade will be priced by buyers who have read the inspection report rather than the history.
Keep it, or one heir buys the others out
Proposition 19 is the rule that rewards keeping. For transfers on or after 16 February 2021 the parent to child exclusion applies only to a family home that was the parent's principal residence and becomes the child's principal residence. A cottage the parents used at weekends, or rented, is fully reassessed. The child must claim the homeowners' exemption within one year of the transfer or date of death and file form BOE-19-P within three years or before any transfer to a third party.
The exclusion is capped at the parent's factored base year value plus 1,044,586 dollars for transfers between 16 February 2025 and 15 February 2027. Above that sum the new taxable value is market value minus the adjusted amount. On a factored base year value of 400,000 dollars and a home worth 2,200,000 dollars the threshold is 1,444,586 dollars and the new taxable value becomes 1,155,414 dollars. Confirm the current figures with the Orange County Assessor before anyone relies on them.
A buyout among heirs is a real purchase. The heir keeping the house needs financing, and the lender will require its own appraisal rather than accepting a date of death figure that is by then several months old. The heirs being bought out need a value they can defend to each other years later. Put the valuation, the offer and the acceptance in writing, and disclose the buying heir's position to everyone else before anybody signs.
The honest downside: the two rules fight. Proposition 19 rewards the heir who occupies and holds, IRC 1014 rewards the heir who sells promptly at a documented value, and a child who moves in only to keep the tax base and sells at month twenty gets neither, because section 121 requires twenty four months of ownership and use. Then add what holding costs here: insurance in a fire exposed city, defensible space obligations, a hillside that needs watching, and a house where roughly seven in ten in this city predate 1980.
The Reason This Work Comes by Referral
Paula Aragone has worked Orange County transactions for 23 years, across 900+ transactions and $900M+ sold, and she came to it after four years of law school. She holds the CPRES and SRES designations. That background is why estate and family law attorneys send inherited property files here rather than to a general listing agent.
An inherited Laguna Beach property fails in specific ways. The seller never lived in the house, so the disclosure file has to be rebuilt from the permit portal and the scanned property record rather than recalled. The city's own sequence, the Real Property Report before any agreement of sale, sits ahead of everything the family wants to do. And on most parcels here there is a geology question that a buyer will raise in the first week and an estate cannot answer in the fourth.
The work that prevents all of that is done at the beginning: the date of death appraisal ordered early, the Real Property Report applied for in week one, the permit history and property file pulled before listing, the fire zone and defensible space position established, and title checked for a recorded preservation agreement or an undergrounding assessment. None of it is glamorous and all of it is the difference between a sale on the family's schedule and a sale on somebody else's.
For the attorney, the value is a record that answers a beneficiary's questions before they are asked: why this value, why this buyer, why this price, why these repairs and not those. Broad exposure with every offer kept in writing does more to protect the person signing than any argument made afterwards. That is what this office produces, and it is why the same offices keep sending the work.
Inherited Laguna Beach Property, Answered
The questions heirs ask first, answered for California law and for a hill town where the city, the geology and the insurer all get a say.
How do we work out which procedure the estate needs?
From the date of death, which is what fixes the thresholds. For deaths on or after 1 April 2025, the personal property affidavit under Probate Code 13100 covers a gross estate up to 208,850 dollars, a petition to determine succession to real property under Probate Code 13151 reaches 750,000 dollars but only for the decedent's California primary residence, and the affidavit for real property of small value under Probate Code 13200 covers 69,625 dollars. For deaths between 1 April 2022 and 31 March 2025 the first two figures are 184,500 dollars.
What is the Real Property Report and when does an heir need it?
It is a city report the municipal code requires before entering into an agreement of sale or exchange of any real property, and applications and payment go through the city's online permit portal only. That means it comes before a listing agreement leads anywhere, not during escrow. An industry summary describes roughly a seven day turnaround with no inspection component, but confirm the current fee and timing with the Planning Division on 949-497-0713 rather than relying on a third party figure.
The property is in Irvine Cove. Who issues the coastal permits there?
The California Coastal Commission, not the city. Laguna Beach has had a certified Local Coastal Program since 13 January 1993, but four areas inside the city limits remain outside it: Irvine Cove, Blue Lagoon, Hobo Canyon and Three Arch Bay. In those areas the Commission issues coastal development permits directly. For a buyer intending to renovate this is a real timeline difference, and it is better disclosed in the marketing than discovered during their inspection period.
Does the estate have to produce a geologic report to sell?
Not simply to sell, but expect a buyer to ask and expect the question to matter. The municipal code requires an engineering geologic report by a registered engineering geologist for habitable structures, grading, and major additions exceeding fifty percent of existing floor area, with geologic review for pools, spas, smaller additions and retention devices over five feet. Reports must address landslide, slump, mudflow, creep, faulting and erosion, slope stability, ground and surface water, and performance under saturation plus the maximum probable earthquake, on a minimum fifty year project life.
Do we have to mention the Bluebird Canyon landslides?
Yes, and it is better raised by the seller than found by the buyer. Bluebird Canyon slid on 2 October 1978 and again on 1 June 2005, the second destroying homes. Buyers on any hillside parcel here ask for a soils and slope stability report, prior grading permits and any evidence of remediation. Check the specific parcel against the California Geological Survey Earthquake Zones of Required Investigation viewer, and put what you find in the file rather than in a conversation.
Will a buyer be able to insure a house we inherited here?
It is the first practical question most buyers raise, and the answer varies by parcel. The Council adopted the updated CAL FIRE local responsibility area maps on 24 June 2025, covering Moderate, High and Very High classifications, and the FAIR Plan is a realistic fallback market: it held 668,609 homeowner and commercial policies as of December 2024. CAL FIRE states that the hazard maps themselves do not set insurance rates or availability, which is a distinction worth making rather than conflating.
Nobody can find permits for the deck and the retaining wall. What now?
That is normal here, not a sign of anything sinister. Substandard lots, steep access and an intensive design review regime make this the city where a past addition is most likely to have been built quietly. Pull the city's public permit portal history, the scanned property file in OnBase and the other records in Laserfiche, searching by address with an asterisk for the street type or by assessor's parcel number in XXX-XXX-XX format. Establish the position before listing, then disclose what you found.
There is a short term rental in the property. Does that survive a sale?
Possibly, and it is worth checking rather than assuming. Short term lodging is prohibited in the R-1, R-2 and R-3 residential districts, but units predating the ban are grandfathered as legal nonconforming uses, and that nonconforming right runs with the land rather than with the owner, so it transfers with the property. New short term lodging is permitted only in specified commercial and mixed use districts under a citywide cap of 300 units. Pull the paperwork, because a documented grandfathered status is a saleable attribute.
Emerald Bay is unincorporated. Does that change anything for an heir?
It changes which authorities you deal with rather than the tax or probate position. Emerald Bay is a gated community of approximately 538 residences and the only unincorporated populated place on the Orange County coastline, with a single entrance on Pacific Coast Highway, a tunnel connecting the inland and ocean sides, a private beach, its own fire station and a community services district alongside the association. Three Arch Bay also runs a community services district, which means an entity with assessment powers beyond ordinary dues.
Why is the date of death appraisal the document everyone asks for?
It is a retrospective appraisal valuing the property as of the day your parent died. Under IRC 1014 that value becomes the basis, so it determines whether a later sale produces taxable gain. It is the most valuable single document in an inherited property file and it costs a small fraction of what an unsupported number can cost afterwards. In Laguna it needs an appraiser who treats the parcel, the access, the parking and the slope as part of the property, because they are.
Is there tax to pay if the estate sells quickly?
Usually very little. Basis resets to the date of death value under IRC 1014, so gain is measured only from that date forward, and IRC 1223(9) treats the sale as long term even where it happens inside a year. Where the property was community property of a married couple, IRC 1014(b)(6) steps up both halves at the first death. California has no preferential capital gains rate, so the state taxes the gain as ordinary income. This is general information, not tax advice.
Can we claim the home sale exclusion on an inherited property?
Not as an heir who never lived there. IRC section 121 excludes 250,000 dollars for a single filer and 500,000 dollars for a married couple filing jointly, but it requires ownership for at least twenty four months and use as a residence for at least twenty four months within the five years before the sale. Inheriting and selling meets neither test. The stepped up basis under IRC 1014 is what does the work, which is why the appraisal matters more than most people expect.
Should we repair the house first or sell it as is?
Decide it with numbers rather than instinct. A buyer inspects either way, so repairs move who pays rather than whether an item is found. In a city where roughly 69 percent of the stock predates 1980 and a fifth predates 1940, an estate can spend a great deal and still hand over a long report. Selling as is with a complete inspection package on the table is often cleaner, with exceptions for items that are genuinely gating a buyer's financing or insurance.
Can a child keep the parents' property tax base on a Laguna house?
Only under Proposition 19 and only in a narrow case. For transfers on or after 16 February 2021 the exclusion covers a family home that was the parent's principal residence and becomes the child's principal residence. The child claims the homeowners' exemption within one year of the transfer or date of death and files form BOE-19-P within three years or before any transfer to a third party. The cap is the parent's factored base year value plus 1,044,586 dollars for transfers from 16 February 2025 through 15 February 2027.
Four of us inherited it and we do not agree. What actually happens?
Usually one of two things. An heir who wants the property buys the others out, which is a purchase needing financing and a documented value, not a family estimate. Or, where co owners cannot agree at all, one of them asks a court to force a division or sale. That route is slow, spends money from the same estate everyone is arguing over, and hands the outcome to somebody outside the family. Document the valuation early and most of these disputes never start.
None of us ever lived in the house. What are we expected to disclose?
Everything you can establish from a record, and nothing you are guessing at. The permit portal history, the property file, the Real Property Report, the natural hazard report and the inspections take the place of the knowledge an ordinary seller would have. Whether the estate is exempt from delivering a Transfer Disclosure Statement depends on the procedure and is a question for the estate's attorney. An exemption from a form is never permission to stay quiet about something the family knows.
