An Entitlement Is Part of the Value, and It Does Not Travel Automatically
The Land of Gracious Living is the city's own motto rather than an advertisement, and horse keeping here is a code entitlement rather than a neighbourhood custom. That makes it checkable, which is exactly why it has to be checked.
Yorba Linda incorporated on 2 November 1967 and covers 19.97 square miles with a population of 68,336 at the 2020 census. The name joins Yorba, after the Californio ranchero Don Bernardo Yorba, with the Spanish linda, coined in 1908 by the Janss Investment Company. The eastern two thirds of the city, east of the Yorba Linda Country Club, stayed cattle and agricultural ranch land far longer than the west, which is why the eastern build is newer and why the ranch names survive as tract names. The Richard Nixon Presidential Library sits on a nine acre campus at 18001 Yorba Linda Boulevard, incorporating a birthplace that is a National Historic Landmark.
The code does the work that CC and Rs do elsewhere. Municipal code section 18.20.620 permits keeping animals in residential districts subject to restriction, with domesticated farm animals, horses and cleft hoofed animals allowed outdoors given proper drainage and waste disposal. The thresholds are explicit: fifteen thousand square feet in Residential Agriculture, Residential Low Density or Residential Estate is permit free, while Residential Suburban and Residential Urban require a conditional use permit at a minimum of ten thousand square feet. Section 18.20.630 then sets the count by lot size, and it also caps dogs and cats at three, prohibits roosters citywide and permits up to three beehives.
Which is where a dissolution gets specific. If the parcel is sixteen thousand square feet, it permits two animals and not three, and a valuation built on three is built on a violation. If the zone is Residential Suburban, the entitlement exists only while the conditional use permit is in good standing. If the arena sits within fifty feet of a neighbouring dwelling, it carries a two hour daily use limit and a dust control obligation that pass to the buyer as a restriction rather than a feature. None of that is negotiable between two spouses, and all of it is verifiable in a week.
The second variable is fire, and here it is the largest number in the file. The Freeway Complex Fire ran from 15 to 25 November 2008, burned 30,305 acres including ninety percent of Chino Hills State Park, destroyed 314 homes, 43 outbuildings and 4 commercial properties, injured 14 firefighters and forced roughly 40,000 people out. Yorba Linda's own share was 113 homes destroyed and 50 damaged, with erratic winds carrying embers up to half a mile. The Freeway Fire began with a faulty catalytic converter and the Landfill Fire with arcing from inadequately maintained power lines supplying the Brea Olinda Oil Field. In October 2020 the Blue Ridge Fire burned over 13,000 acres over largely the same ground.
The 2025 maps, released on 24 March 2025 and adopted by the Council after a public review completed with the Orange County Fire Authority, converted that history into a per parcel legal fact. That half mile ember cast is why the phrase my house is not next to the brush does not answer anything here. It is also why a post 2008 rebuild is worth naming clearly rather than burying: a home built on or after 1 January 2010 is exempt from the fire hardening disclosure as compliant with the wildland urban interface standard. On an equestrian parcel the two subjects collide, because the hundred foot defensible space obligation under Government Code 51182 has to be reconciled with pasture, arena footing, hay storage, bedding and shade trees. That reconciliation is a project, and in a dissolution it needs both signatures before it starts.
How a Yorba Linda Home Is Sold During a Dissolution

Measure the lot against the animal schedule
The code ties horse keeping to lot square footage. Ten thousand to fifteen thousand square feet permits one animal, fifteen thousand and one to seventeen thousand permits two, seventeen thousand and one to twenty thousand permits three, and thirty thousand and one square feet up to one acre permits six plus two per additional acre. Take the figure from the assessor and the survey, never from the listing history.
Confirm the zone, and any conditional use permit behind it

There are thirty planned developments in the city, numbered PD-1 through PD-30, each with its own standards, which is why a parcel can carry a base zone and an overlay that says something different. Pull the applicable planned development document and read it alongside the zone. This is the check that most often changes what a parcel is actually entitled to do.
Measure the fifty foot separations and the arena
No equine or cleft hoofed animal may be kept in a required front, side or street side yard. Animals, coops, aviaries and rabbit cages must sit at least fifty feet from any neighbouring dwelling, measured to its nearest edge excluding garages, and barns or stables need the same fifty feet. Where an easement crosses the parcel, obtain the recorded document, confirm its width and alignment, and confirm no fence, corral, arena, planting or structure encroaches. Establish the fire zone class and the insurance position
The updated maps were released on 24 March 2025 and the city worked with the Orange County Fire Authority to complete public review before the Council adopted them. Over 6,500 acres of the city are mapped, of which over 4,700 acres are Very High. Confirm the parcel's class, order the natural hazard report against the current adoption, and get the household's carrier arrangement in writing for both parties.
Instruct one appraiser with the entitlement file attached

The waterfront homes inside East Lake Village. Confirm which entity owns and maintains the lake, the shoreline and any dock or waterfront improvement, because these parcels carry obligations the interior lots do not.
Vista del Verde
The newest large master planned area, wrapped around the Black Gold Golf Club, with Vista Del Verde Park as a city park. Verify any assessment on the parcel from the tax bill rather than from a general description of the tract.
Kerrigan Ranch
Eastern, later build, hillside sited with larger newer product and high fire zone exposure. Hillside development standards apply at a gradient of fifteen percent or more, which governs grading, retaining walls and ridgeline siting.
Bryant Ranch
An eastern ranch name tract with its own elementary school in Placentia Yorba Linda Unified. Built on land that was cattle and agricultural ranch far longer than the western half of the city.
Travis Ranch
Eastern, and the address for Travis Ranch School, the district's kindergarten through eighth grade campus, which is unusual in Placentia Yorba Linda Unified and a genuine draw for a buyer with children.
Hidden Hills
Tucked interior siting with the trail network as the selling point. Where a recorded trail easement crosses a parcel here, obtain the document and check the alignment against the fences before anyone agrees a number.
Amberhill
Small, high identity newer hillside product. A thin comparable set, which is one more reason a single jointly instructed appraiser produces a transaction where two competing ones produce a hearing.
Stonehaven
A later planned tract with consistent product and association governance. Order the association documents in the first week, because every request needs approval from two separated households and a second packet found late costs weeks.
Woodgate
Established mid city tract with mature landscaping. Build era puts it inside the polybutylene window, which is the most likely plumbing finding in this city and the one that turns into a repair negotiation.
Country Club Village
Around the Yorba Linda Country Club, the historic line dividing the older western city from the later eastern build. Older stock, so aluminium branch circuit wiring and cast iron drains are live inspection items.
Main Street Historic District
The old town area, the pre incorporation layer of the city near the Nixon birthplace. The smallest permit files in Yorba Linda and the ones most likely to need a records request rather than a database search.
Equestrian parcels in R-A, R-E, RLD and OSR

Six Yorba Linda Assumptions That Cost a Number or a Closing

Each of these is a permission, a measurement or a recorded document that somebody described from memory in a file where memory is exactly what the two parties no longer share.
The lot was marketed for more animals than the schedule allows
The count runs by square footage. Ten thousand to fifteen thousand square feet permits one animal, fifteen thousand and one to seventeen thousand permits two, seventeen thousand and one to twenty thousand permits three, and thirty thousand and one square feet up to one acre permits six with two more per additional acre. Unpermitted equestrian structures are among the most common permit problems in this city, because a shelter became a barn and a barn became a structure across two owners.
Completed building permits are held in the city's WebLink database, with inspection scheduling and results in Accela Citizen Access and anything else available through a public records request. In a dissolution, run the search before the appraiser is instructed, because a structure the record does not support is a structure the appraisal should not count.
A recorded trail easement runs through the back of the lot
The city maintains over one hundred miles of trails coordinated for hikers, bikers and equestrians, with thirty horse trails and a Riding, Hiking and Bikeway Trails Element updated in 2024. Where an easement crosses a parcel it is a recorded encumbrance, and it belongs in the preliminary title review rather than in the description of the grounds.
Obtain the recorded document, confirm its width and alignment, and confirm that no fence, corral, arena, planting or structure encroaches on it. A buyer who discovers after closing that the public rides through the rear of the property has a complaint, and in a dissolution that complaint lands on two former spouses who have already divided the proceeds.
The fire package was assembled after the offer instead of before

The fire hardening disclosure changed on 1 July 2025 and the change is the part most often missed: it now has to list the low cost retrofits available under Government Code 51189 and state which of them the seller has completed. On a large equestrian parcel the hundred foot defensible space obligation also has to be reconciled with pasture, hay and bedding, which is a project rather than an afternoon.
Nobody decided who takes the horses
The animals are not the real property, and a judgment that divides the house and the land can be silent about what is standing in the corral. Boarding, feed, farrier and veterinary costs also continue throughout the case, and Family Code 2040 requires each party to notify the other of proposed extraordinary expenditures at least five business days before incurring them and to account for them to the court.
There is a second consequence for a deferred sale request. Under Family Code 3801 the court has to find it economically feasible to maintain the note payments, taxes, insurance and the condition of the home during any deferral, and on an equestrian parcel the condition of the home reasonably includes the fencing, the drainage and the manure management the code requires. Put those numbers in front of counsel early.
Sell the Property, or One Spouse Keeps the Land and the Animals
There are two real outcomes. On an equestrian or hillside parcel the second one carries obligations that do not appear on a mortgage statement, and they should be counted before anyone agrees to it.
Sell the house
A sale converts a contested asset into a number, and a number divides under Family Code 2550 without either party depending on the other afterwards. It also ends a set of running obligations that are unusually heavy here: the defensible space clearance, the manure and dust management the code makes enforceable, the association assessments where one applies, and the insurance premium on a parcel that may sit in the Very High area.
The tax position is usually better while the marriage is intact. Under IRC section 121 the exclusion is 250,000 dollars per individual taxpayer and 500,000 dollars on a joint return where either spouse meets the ownership test, both meet the use test, and neither is disqualified by the two year look back. Both tests run on twenty four months out of the five years ending on the date of sale, so selling while still married and filing jointly in the year of sale can preserve the whole 500,000 dollars.
The mechanics need designing before escrow opens. Both parties sign the escrow instructions and both must sign any amendment, and if they later give conflicting instructions the escrow holder does not choose between them, it interpleads and the funds sit with the court. State withholding is a standard 3 1/3 percent of the sales price on form 593 unless an exemption applies, including certification that the property qualified as a principal residence under section 121, with forms 593 and 593-V due by the twentieth day of the month following close.
The honest downside: an equestrian buyer pool is narrower than a general one, and the file that sells the entitlement is the same file that documents its limits. A sale is public, it moves at the speed of two signatures, and where children are settled in a Placentia Yorba Linda Unified placement, that cost is real and a court is entitled to weigh it under Family Code 3802 on a request to defer.
One spouse buys the other out
The arithmetic starts with fair market value at the applicable date, less encumbrances, which gives gross equity. Any Family Code 2640 reimbursement for traced separate property contributions comes off the top, along with any separate interest established under Moore and Marsden, adjusted for Epstein credits and Watts charges. The remainder is community equity and each spouse's interest is half. Whether hypothetical costs of sale are deducted when no sale is happening is contested, so treat it as negotiable rather than settled.
The valuation itself is where a Yorba Linda buyout most often goes wrong, because part of what is being bought is a permission. If the retaining spouse intends to keep horses, the entitlement is real value and its conditions apply to them. If the retaining spouse intends to remove the animals and use the land differently, the entitlement is not something they are buying and it should not be priced as though it were. The lender then applies its own rules. All parties must sign a written agreement stating the terms of the transfer and the disposition of proceeds, the retaining spouse may not receive any of those proceeds, incidental cash back is capped at the greater of one percent of the new loan amount or 2,000 dollars, and the retaining spouse must qualify alone. On a Very High zone parcel the insurance line inside that qualification is not a small one.
The honest downside is tax plus carrying cost. A transfer between spouses incident to divorce is not a taxable event under IRC section 1041 and the receiving spouse takes carryover basis rather than a stepped up one, so the entire built in gain lands on the buying spouse, who may have only 250,000 dollars of exclusion at the eventual sale. Removing a spouse from title is also not removing them from the loan: a deed changes ownership while the promissory note is a contract with a lender who is not a party to the divorce, so the exits are a refinance or an assumption with an express written release of liability. And the spouse who stays carries the clearance, the drainage, the manure management and the premium alone.
Verifying What the Property Is Allowed to Be, for Both Parties at Once

Yorba Linda rewards that approach more than most cities, because so much of what is in dispute is written down somewhere. Lot square footage against the animal schedule, the zone and any conditional use permit, the planned development overlay, the fifty foot separations, the permits on the barn and the arena, the recorded trail easement, the fire zone class: every one of those is a fact a third party can produce, and a fact produced for both households on the same day cannot be characterised later as one spouse's argument.

Answer it from the parcel, not from the tract name. The reliable route is the secured property tax bill and its direct assessment lines, through the Orange County Treasurer Tax Collector, followed by the good faith request to the levying agency that Civil Code 1102.6b requires for Mello Roos special taxes, Improvement Bond Act of 1915 assessments and contractual assessments including PACE liens. The city does have a street lighting and landscaping maintenance assessment district with defined zones. Do not describe any special tax as expiring, because districts can levy indefinitely unless voters repeal them.
We are in East Lake Village. What has to be checked before we agree a number?
Whether the parcel sits under the master association alone or under a sub association as well; which entity owns and maintains the lake, the shoreline and any dock or waterfront improvement, because the Shores waterfront homes carry obligations the interior lots do not; what fire insurance the association carries on common area and at what deductible; and whether any special assessment is pending. An association of two thousand two hundred and forty homes with a fifteen acre lake, two recreation centres and a championship swim facility is a substantial operating entity.
Is a Yorba Linda address automatically a Placentia Yorba Linda Unified address?
No. Most of the city is in Placentia Yorba Linda Unified, with Yorba Linda High School at 19900 Bastanchury Road, opened in 2009 and serving the city plus a small portion of Anaheim Hills north of Yorba Regional Park, alongside El Dorado and Esperanza which took Yorba Linda students before it opened. But Orange Unified serves parts of the city, and Canyon High School takes a section north of La Palma Avenue and east of Yorba Linda Boulevard. Verify by address and put the answer in writing.
Which date does the court value the property at?
Family Code 2552(a) makes the default a valuation as near as practicable to the time of trial, not the date of separation and not the date of filing. Under 2552(b), on thirty days notice and for good cause shown, the court may value all or any portion of the assets and liabilities at a date after separation and before trial to accomplish an equitable division. The practical effect is that the community usually shares the movement in value between separation and trial.
How does escrow disburse when the two of us disagree?
Exactly as the signed instructions say and not otherwise. Escrow is a limited agency governed entirely by the written instructions of the principals, and once joint instructions are signed neither principal may change them alone. If the parties give conflicting instructions the escrow holder is a neutral stakeholder rather than a referee, and its remedy is an interpleader that deposits the funds with the court. The clean structure is a judgment stating the disbursement formula and escrow instructions repeating it word for word.
